DECISION

Regarding amendments and supplements to certain provisions of Decision No. 210/1999/QĐ-TTg dated October 27, 1999 of the Government on certain policies for overseas Vietnamese. ngày 27 tháng 10 năm 1999 của Thủ tướng Chính phủ về một số chính sách đối với người Việt Nam ở nước ngoài.

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Nationality Law of May 20, 1998;

To create favorable conditions and encourage overseas Vietnamese to maintain close ties with their homeland and actively contribute to the country's construction efforts;

At the request of the Minister of Foreign Affairs,

Pursuant to …;:

Article 1. Amending and supplementing certain provisions of Decision No. 210/1999/QĐ-TTg dated October 27, 1999 of the Government on certain policies for overseas Vietnamese as follows:

Article 2 shall be amended and supplemented as follows:

"1. When returning to Vietnam, Vietnamese citizens residing abroad shall carry a Vietnamese passport; Vietnamese-origin individuals carrying foreign passports and accompanying family members (including spouse, parents-in-law, children from the spouse, and legally adopted children) who have a confirmation letter from the Vietnamese representative office in the host country or the Committee for Overseas Vietnamese Affairs regarding the aforementioned family relationships shall enjoy the same service fees and transportation fares as Vietnamese citizens residing within the country.

2. Vietnamese-origin individuals carrying foreign passports who have made contributions to the national liberation cause and the country's construction, with a confirmation letter from the Vietnamese representative office in the host country or the Committee for Overseas Vietnamese Affairs, shall be exempted from visa fees when entering and exiting Vietnam.

3. Other types of fees and charges shall be applied to Vietnamese citizens residing abroad carrying Vietnamese passports; and Vietnamese-origin individuals carrying foreign passports as stipulated in Clause 2 of this Article, in the same manner as Vietnamese citizens residing within the country.

4. Ministries, central sector management agencies, and provincial People's Committees directly under the Central Government shall regularly report lists of Vietnamese-origin individuals carrying foreign passports belonging to the categories specified in Clause 2 of this Article to the Ministry of Foreign Affairs."

Article 5 shall be amended and supplemented as follows:

"To create favorable conditions and encourage overseas Vietnamese to maintain close ties with their homeland and make positive contributions to the country's construction efforts, relevant ministries and sectors shall implement the following tasks:

1. Based on the Law Amending and Supplementing Certain Provisions of the Land Law 2001, the Ministry of Construction shall take the lead, in coordination with the Ministry of Justice, the Ministry of Foreign Affairs, and related agencies, to study and submit to the Government for consideration and decision on housing policies for Vietnamese citizens residing abroad in Vietnam.

2. The Ministry of Culture, Sports and Tourism shall take the lead, in coordination with the Ministry of Foreign Affairs, to organize various forms of cultural activities for overseas Vietnamese, primarily in areas with large concentrations of Vietnamese residents.

3. The Ministry of Education and Training shall take the lead, in coordination with the Ministry of Foreign Affairs and related agencies, to study and organize Vietnamese language teaching programs for overseas Vietnamese communities based on compliance with the laws of the host countries.

4. The Voice of Vietnam Radio Station and Vietnam Television shall take the lead, in coordination with the Ministry of Foreign Affairs and related agencies, to cooperate with relevant organizations in other countries to expand the broadcasting of Vietnamese radio and television programs to serve the overseas Vietnamese community.

5. The Ministry of Foreign Affairs shall take the lead, in coordination with relevant ministries and sectors, to intensify information dissemination and propaganda work through the internet, press, cultural products, and promotional materials serving the overseas Vietnamese community.

6. The Ministry of Finance and the State Price Control Board shall coordinate with relevant ministries and sectors to base on the actual annual volume of goods transported abroad to provide subsidies for the transport costs of films, books, cultural products, promotional publications for tourism, and materials promoting the overseas Vietnamese community, as well as airfare for domestic artistic performance groups serving the overseas Vietnamese community. The subsidy amount shall be 50% of the actual transport costs and airfare paid to transportation units (by road, rail, waterway, air, and postal services).

The list of books, cultural products, promotional publications for tourism, and materials and films promoting the overseas Vietnamese community includes publications that have been widely published and distributed nationwide to serve political purposes, promote Party and State policies, and do not violate Article 22 of the Publishing Law.

Domestic artistic performance groups traveling abroad to serve the overseas Vietnamese community must be introduced by the Ministry of Culture, Sports and Tourism or the Ministry of Foreign Affairs."

Article 2. This Decision shall take effect fifteen days from the date of signature. All previous regulations that conflict with this Decision are hereby abolished.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and municipal people's committees directly under the central government are responsible for implementing this Decision./.
