Regarding the provision of functions, tasks, powers, and organizational structure
of the Industrial Safety Technology Department

THE MINISTER OF INDUSTRY
Pursuant to Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry;
Considering the proposal of the Director of the Technical Inspection and Supervision Department for Industrial Safety (Report No. 178/TTr-KTAT dated June 18, 2003);
At the suggestion of the Director of the Department of Organization and Cadres,
DECIDES:
Article 1. The Industrial Safety Technology Department under the Ministry of Industry assists the Minister in guiding, inspecting, and organizing the implementation of industrial safety technology, including registration, safety testing of pressure equipment, lifting devices, electrical safety, mining and oil exploitation safety (excluding offshore oil exploration and exploitation equipment), chemical safety, and industrial explosives safety in accordance with the law.
The Industrial Safety Technology Department has legal personality; it may open accounts at the State Treasury and the State Bank of Vietnam; its operating funds are provided by the state budget, and it has a separate seal for operations and transactions in accordance with the law; its main office is located at No. 54 Hang Bai Street, Hoan Kiem District, Hanoi City;
Article 2. The Industrial Safety Technology Department has the following tasks and powers:
1. Drafting or participating in drafting normative legal documents; mechanisms and policies on technical safety in the industry to be submitted to the Minister for issuance or to competent authorities for issuance and guidance on their implementation;
Drafting and submitting to the Minister for issuance regulations and inspection systems for industrial safety technology and guidance on the implementation of issued documents.
2. Inspecting the implementation of:
a) Industrial safety technology standards and norms;
b) Resolving disputes in the supply and use of electricity.
3. Organizing the implementation of registration, testing, and issuing certificates of technical safety for machinery, equipment, materials, and substances requiring strict labor safety according to the list issued by the Ministry of Labor, Invalids, and Social Affairs; machinery, equipment, materials, and substances with special safety requirements according to the list issued by the Ministry of Industry.
Reviewing and submitting to the Minister for recognition units that meet the technical safety conditions for manufacturing, installing, repairing pressure equipment, lifting devices, and periodic inspections of gas cylinders and liquefied gas containers of units within the industry.
4. Leading and coordinating with relevant Departments to review files and submit to the Ministry of Industry for issuing business licenses and permits for the use of industrial explosives in accordance with the law.
Organizing technical safety inspections during production, storage, transportation, and use of industrial explosives.
5. Being the focal point for managing radiation safety, fire prevention, and firefighting in the industry.
6. Reviewing or participating in reviewing technical safety solutions in investment projects, technical designs, and construction designs of basic engineering works of units under the Ministry of Industry.
7. Leading or coordinating with relevant state management agencies to investigate causes of work accidents related to technical safety in the industry and proposing remedial measures.
8. Leading and providing specialized training and vocational guidance on industrial safety technology for units in the industry.
9. Organizing professional training and vocational training for electrical inspectors.
10. Implementing international cooperation in the field of industrial safety technology in accordance with the law.
11. Managing organizational structure, staffing, and assets allocated in accordance with the law and the delegation of the Ministry.
Article 3. The organizational structure of the Industrial Safety Technology Department includes:
1. Leadership:
a) Director.
b) Deputy Directors.
The Director of the Industrial Safety Technology Department is responsible to the Minister of Industry for leading and managing all activities of the Department. Deputy Directors assist in specific areas assigned by the Director.
The Director and Deputy Directors are appointed and relieved of duty by the Minister.
2. The support staff of the Director includes:
a) Office,
b) Personnel Organization, Training, and International Cooperation Division,
c) Electrical Safety Technology Division,
d) Power Monitoring Division,
đ) Mining and Oil Safety Technology Division,
e) Mechanical and Pressure Safety Technology Division,
g) Chemical Safety, Industrial Explosives, and Consumer Industry Technology Division.
3. Service units with income:
a) Industrial Safety Technology Testing Center I,
b) Industrial Safety Technology Testing Center II.
4. Service unit: Industrial Safety Technology Support Center.
The Director of the Industrial Safety Technology Department is responsible for defining functions, tasks, and arranging personnel of the Department to ensure efficiency and streamlined operation.
Article 4. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
The Head of the Ministry's Office, the Inspector General, Department Heads, Directors of other agencies and units under the Ministry, and the Director of the Industrial Safety Technology Department are responsible for implementing this Decision./.
