DECREE
Regulations on forms for administrative violations penalties of border guards and maritime police

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Ordinance on Handling Administrative Violations 2002, and the Ordinance amending and supplementing certain articles of the Ordinance on Handling Administrative Violations 2008;
Pursuant to the Ordinance on Border Guard Forces 1997;
Pursuant to the Ordinance on the Vietnam Maritime Police Force 2008;
Upon the proposal of the Minister of National Defense,
DECREE:
Article 1. Scope of Regulation
This Decree stipulates the forms, issuance, printing, management, and use of various forms for administrative violations penalties of Border Guard Forces and Maritime Police.
Article 2. Applicability
This Decree applies to agencies, units, and individuals with authority to impose administrative violations penalties of Border Guard Forces and Maritime Police; related agencies, organizations, and individuals.
Article 3. Forms and use of forms
1. The Appendix attached to this Decree includes forms for administrative violations penalties of Border Guard Forces and Maritime Police, comprising the following types:
a) Decision forms, totaling 21 types;
b) Record forms, totaling 18 types;
c) Other forms, totaling 5 types.
2. These forms shall be uniformly used by agencies, units, and individuals with authority to impose administrative violations penalties of Border Guard Forces and Maritime Police within their respective areas of jurisdiction.
Article 4. Issuance and Management of Forms
1. Decision forms, record forms, and other types of forms as specified in Clause 1 of Article 3 of this Decree shall be printed and issued in either printed form or electronic form.
a) Printed form refers to a document printed out on printing devices, computer equipment, or other types of machines;
b) Electronic form refers to a collection of electronic data messages regarding the contents of decision forms, record forms, and other types of forms, initiated, created, and issued on electronic devices.
2. When decision forms, record forms, and other types of forms are issued on electronic devices for use, they must be in printed form.
3. The Ministry of National Defense shall uniformly manage forms for administrative violations penalties of Border Guard Forces and Maritime Police; specify detailed regulations on printing and issuing printed forms and electronic forms, and managing and using forms.
Article 5. Implementation Provisions
This Decree takes effect from February 15, 2012.
2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally governed city People's Committees are responsible for implementing this Decree./.
