Amending and supplementing some articles of Decree No. 143/2003/NĐ-CP dated November 28, 2003 of the Government detailing certain provisions of the Ordinance on Exploitation and Protection of Irrigation Works.

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Water Resources dated May 20, 1998;
Pursuant to the Ordinance on Exploitation and Protection of Irrigation Works dated April 4, 2001;
Pursuant to the Ordinance on Fees and Stamp Duties dated August 28, 2001;
Considering the proposal of the Minister of Finance,
DECREE:
Article 1. Amending and supplementing some articles of Decree No. 143/2003/NĐ-CP dated November 28, 2003 of the Government detailing certain provisions of the Ordinance on Exploitation and Protection of Irrigation Works as follows:
1. Article 19 shall be amended and supplemented as follows:
"Article 19. Rates of irrigation fees and exemptions from irrigation fees.
1. The rates of irrigation fees and water charges prescribed in Clause 4, Article 14 of the Ordinance on Exploitation and Protection of Irrigation Works for works invested with state budget funds shall be specified as follows:

- In cases where irrigation and drainage are partially self-initiated, the fee will be 60% of the above rate.
- In cases where irrigation and drainage are gravity-fed, the fee will be 40% of the above rate.
- In cases where irrigation and drainage are power-driven, the fee will be 50% of the above rate.
- In cases where tidal currents are utilized for irrigation and drainage, the fee will be 70% of the gravity-fed irrigation and drainage rate.
The People's Committee of provinces and centrally governed cities shall specify the detailed list of works and methods of irrigation and drainage applicable to each irrigation work under their jurisdiction.
b. For areas planted with seedlings, vegetables, short-term crops, and short-term industrial crops including winter crops, the rate of irrigation fees will be 40% of the irrigation fee rate for paddy fields.
c. The rate of irrigation fees for salt production shall be calculated at 2% of the value of finished salt.
d. The rate table for water charges for organizations and individuals using water or services from irrigation works for non-food production purposes:

- In cases where water is taken based on volume, the water charge shall be calculated from the point where the organization or individual receiving water takes the water.
- In cases where water is supplied for long-term perennial crops, fruit trees, flowers, medicinal plants if it cannot be measured in cubic meters (m³), then the charge will be levied based on area (ha), at a rate equal to 40% of the irrigation fee rate for paddy fields.3If the land is for rice cultivation, it shall be charged based on area (ha), with the rate being 40% of the water management fee.

2. The water management fee levels specified in points a, b, and c of Clause 1 of this Article shall be calculated at the headgate of the cooperative organization's canal leading to the main waterworks facility.
The People's Committee of the province or centrally governed city shall specify the location of the headgate of the cooperative organization's canal for each system of works.
3. The cooperative organization using water shall negotiate with individuals or organizations using water regarding the service fee for water drawn from after the headgate to the field surface (field canals), but such fees shall not exceed the ceiling set by the People's Committee of the province or centrally governed city.
4. The water management fee level for waterworks projects funded by non-state budget sources or partially by state budget funds shall be agreed upon by the entity managing and operating the waterworks project with the water users and approved by the People's Committee of the province or centrally governed city.
5. Exemption from water management fees:
a. Scope of exemption from water management fees:
- Exempt water management fees for the land and water surface areas within the limit of agricultural land allocated to households and individuals for agricultural, forestry, aquaculture, and salt production purposes, including land granted by the State, inherited, given, received as gifts, legally transferred, and including the 5% public utility land managed by localities that households and individuals have been assigned or bid for the right to use.
- Exempt water management fees for all land and water surface areas used for agricultural, forestry, aquaculture, and salt production purposes by households and individuals in areas with special difficulties and difficulties in socio-economic conditions as defined by the Government.
The land and water surface areas exempted from water management fees under this point shall not be distinguished by irrigation or drainage from waterworks projects funded by state budget or other sources, and water management fees shall be collected according to the rates prescribed by the State or through agreement.
b. Level of exemption from water management fees:
- The level of exemption from water management fees for the use of water from waterworks projects funded by state budget sources shall be calculated according to the levels specified in points a, b, c, and sub-items 3 and 4 of the Water Fee Rate Table at point d of Clause 1 of this Article.
- The level of exemption from water management fees for the use of water from waterworks projects funded by non-state budget sources or partially by state budget sources shall be calculated according to the agreed water management fee level specified in Clause 4 of this Article.
6. Cases not falling within the scope of exemption from water management fees as stipulated in Clause 5 of this Article shall pay water management fees in accordance with the provisions of this Decree.”
2. Supplement Article 19a as follows:
"Article 19a. Policy towards entities managing and operating waterworks projects and state budget subsidies due to the implementation of water management fee exemptions.
1. Entities managing and operating waterworks projects shall receive state budget subsidies for the amount resulting from the implementation of water management fee exemptions as prescribed in this Decree.
2. The subsidy level shall be specifically as follows:
a. For management and operation units of water conservancy works invested with state budget funds, they shall be compensated for the amount of water conservancy fees waived according to the rates prescribed in points a, b, c and items 3, 4 of the Water Fee Collection Table at point d, Clause 1, Article 19 of this Decree.
b. For management and operation units of works invested with non-state budget funds or partially with state budget funds and collecting water conservancy fees based on agreement, they shall be compensated for the amount of water conservancy fees waived according to the rates prescribed in Clause 4, Article 19 of this Decree.
c. The expenditure responsibility of the central government budget
- Ensuring 100% of the water conservancy fees waived for central-level management and operation units of water conservancy works.
- Ensuring 100% of the water conservancy fees waived for localities receiving supplementary balanced budget from the central government. In the case of water conservancy fees waived for collecting water conservancy fees based on agreement, the central government budget will support the local government budget not exceeding 1.2 times the rate prescribed in Clause 1, Article 19 of this Decree.
- Supporting 50% of the water conservancy fees waived for localities with water revenue transferred to the central government budget below 50% (except for cases where localities have large increases in revenue, then the local government budget will ensure the funding itself). In the case of water conservancy fees waived for collecting water conservancy fees based on agreement, the central government budget will support the local government budget not exceeding 1.2 times the rate prescribed in Clause 1, Article 19 of this Decree.
- Supporting the shortfall difference for localities that must use the local government budget to implement part or all of the policy stipulated in point d of this clause, in cases where the local government budget has revenue shortfalls due to objective reasons or low revenue increases after using 50% of the increase in local government budget revenue (if any) and 50% of the local government budget reserve as planned by the Prime Minister.
d. Expenditure responsibilities of the local government budget:
- For localities with water revenue transferred to the central government budget of 50% or more, the local government budget ensures 100% of the water conservancy fees waived for local management and operation units of water conservancy works.
- For localities with water revenue transferred to the central government budget below 50%, the local government budget ensures 50% of the water conservancy fees waived for local management and operation units of water conservancy works.
- The local government budget ensures the compensation for the difference between the actual water conservancy fees waived and the central government budget support level for collecting water conservancy fees based on agreement as prescribed in Clause 4, Article 19 of this Decree.
3. Management and operation units of water conservancy works responsible for supplying and irrigating water shall enjoy subsidies, price supports, and financial assistance as prescribed by law.
The central government budget implements subsidies, price supports, and financial assistance for central-level management and operation units of water conservancy works.
The local government budget implements subsidies, price supports, and financial assistance for local management and operation units of water conservancy works.
4. State-owned water conservancy work exploitation companies implementing restructuring and changing management methods when waiving water conservancy fees, if surplus labor occurs, such surplus workers shall enjoy policies similar to those for surplus workers when transferring ownership, dissolving, or liquidating state-owned enterprises. Funding for resolving policies for surplus workers shall be taken from the Enterprise Restructuring Support Fund at the State Capital Investment Corporation.
5. State-owned water conservancy work exploitation companies shall be supported financially to handle overdue water conservancy fees and losses due to objective reasons.
The central government budget supports central-level management and exploitation companies of water conservancy works.
The local government budget supports local management and exploitation companies of water conservancy works.
In cases where the local government budget faces difficulties and lacks funds to support water conservancy work management and exploitation companies, the People's Committee of the province or centrally-administered city shall report to the Ministry of Finance for consolidation and submission to the Prime Minister for decision.
6. Management and operation units of water conservancy works shall be responsible for:
a. Providing sufficient, timely, and on schedule services for irrigation and drainage for agricultural, forestry, aquaculture, and salt production while fully implementing water-saving policies.
b. Each year, management and operation units of water conservancy works shall prepare budgets and develop business plans to report to competent authorities for approval as follows:
For management and operation units of water conservancy works under central management, reports shall be made to the Ministry of Agriculture and Rural Development and the Ministry of Finance.
For management and operation units of water conservancy works under local management, reports shall be made to the People's Committee of the province or centrally-administered city for reporting to the Ministry of Finance and the Ministry of Agriculture and Rural Development."
3. Amend and supplement Clause 4, Article 27 as follows:
"4. Draft and submit to the Government for promulgation or promulgate within its authority normative legal documents on the decentralization of management of water conservancy works, procedures, norms, standards, and quotas for managing, protecting, utilizing water, regular maintenance and repair of water conservancy works, and water-saving reward policies.
Organize and restructure state-owned water conservancy work management and exploitation companies under its direct control to effectively utilize water conservancy works under the new water conservancy fee collection policy.
Supervise the management and operation of the water conservancy work system."
4. Amend and supplement Clause 6, Article 28 as follows:
"6. The Ministry of Finance shall take the lead and coordinate with the Ministry of Agriculture and Rural Development and relevant ministries and sectors:
a. Guide the implementation of regulations on tendering, ordering, and assigning plans for irrigation and drainage tasks serving agricultural production by management and operation units of water conservancy works and financial management regulations for state-owned companies engaged in the management and operation of water conservancy works.
b. Issue guidelines for preparing budgets, allocating, managing, auditing, and finalizing accounts when implementing the waiver of water conservancy fees."
c. Compile the budget estimate for expenditures from the exemption of water resource fees collected by central-level water works management companies and provincial-level water works management units, which shall be reported to the Government for submission to the National Assembly for approval in accordance with the State Budget Law.
d. Implement inspections and oversight of the exemption of water resource fees and the use of the budget allocated to water works management projects and organizations using water.
5. Supplement Clause 10, 11, 12, 13, and 14 to Article 29 as follows:
“10. Implement specific levels of management for water works projects according to the guidelines of the Ministry of Agriculture and Rural Development.
11. Supervise the establishment and issuance of labor norms and economic and technical standards for water works management companies and water user organizations. Decide on the methods of assigning plans and placing orders for units responsible for managing and operating water works projects, approve budgets, allocate, manage, and settle accounts for the funds of units responsible for managing and operating water works projects.
12. Annually prepare the budget for compensating water resource fees exempted for water works management units, submit it to the People's Councils of provinces and centrally-administered cities for consideration and decision (for localities that have revenue redistribution to the central budget); compile and report to the Ministry of Finance and the Ministry of Agriculture and Rural Development on the level of financial support (for localities receiving subsidies from the central budget and localities with revenue redistribution to the central budget under 50%).
13. Supervise the implementation of revenue and expenditure, settlement of accounts for budgetary support funds.
14. Organize the restructuring of provincial water works management companies according to the new water resource fee collection policy.”
Article 2. This Decree takes effect from January 1, 2009, and replaces Decree No. 154/2007/NĐ-CP dated October 15, 2007, of the Government amending and supplementing certain articles of Decree No. 143/2003/NĐ-CP dated November 28, 2003, of the Government detailing certain provisions of the Water Works Operation and Protection Ordinance.
Article 3. The Ministry of Finance shall take the lead and coordinate with the Ministry of Agriculture and Rural Development to guide the implementation of this Decree.
Article 4. The Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairpersons of provincial People's Committees under the central city shall be responsible for implementing this Decree./.
