REGULATIONS
The entity responsible for implementing tasks
Is the organization assigned by the Steering Committee and the Ministry of Agriculture and Rural Development to implement the activities of the Steering Committee and the Office of the Steering Committee according to the annual plan approved.
Article 4. Activities requiring a work program and budget estimate
In this regulation, these activities include: Reviewing and developing policies; Developing programs and projects; Information and communication activities; Training and capacity building; Organizing conferences, seminars, training sessions; Establishing pilot models; Research, investigation, statistical information; and other activities as required by management decided by the Director of the Office of the Steering Committee./Article 1. Chapter 1.
GENERAL PROVISIONS
Article 1. Scope and Applicability
Article 2. Creating a suitable management mechanism, clearly defining responsibilities in managing and using the operating funds of the Steering Committee and the Office of the Steering Committee; between the Office of the Steering Committee and the entities responsible for implementing the activities.
Article 3. Practicing thrift, preventing waste in spending, and maximizing the effectiveness of the allocated funds.
Article 2. Interpretation of Terms
In this regulation, the following terms are understood as follows:
1. Issuing ;Article 4. The Office of the Steering Committee is responsible for financial management of all operating funds of the Steering Committee and the Office of the Steering Committee according to current regulations. Entities responsible for implementing activities are responsible for financial, professional, and technical management of the assigned tasks.
2. The Office of the Steering Committeeis the State Office for the Forest Protection and Development Plan for the period of 2011-2020.
3. The leading unit to implement tasks/internal control activitiesis the organization assigned by the Steering Committee and the Ministry of Agriculture and Rural Development to carry out the activities of the Steering Committee and its Office according to the annual plan approved.
4. Activities must develop outlines and budgetsherein referred to as activities including: Reviewing and establishing policies; Developing programs and projects; Information and communication activities; Training and capacity building; Organizing conferences, seminars, training sessions; Establishing pilot models; Research topics, surveys, statistical information; and other management activities as decided by the Director of the Office of the Steering Committee.
Article 3. Purpose and Requirements
1. Manage and utilize the operating funds of the Steering Committee and its Office for their intended purposes and to achieve efficiency.
2. Create a suitable management mechanism, clearly defining responsibilities in managing and utilizing the operating funds of the Steering Committee and its Office; between the Office of the Steering Committee and the leading units and those cooperating in implementing the activities.
3. Practice thrift, prevent waste in expenditures, and maximize the effectiveness of the allocated funds.
4. The Office of the Steering Committee is responsible for financial management of all operating funds of the Steering Committee and its Office in accordance with current regulations. Leading units implementing activities are responsible for financial, professional, and technical management of the tasks assigned to them.
Article 4. Principles for financial management and bidding
1. Expenditures from the operating funds of the Steering Committee and the Steering Committee Office must be included in the approved activity plan by the Steering Committee and the budget estimate approved by the Ministry of Agriculture and Rural Development; they must have sufficient reasonable and lawful vouchers, subject to inspection and control before, during, and after the disbursement process; they must ensure the correct content, nature, standard rates, and purpose.
2. Management of the operating funds shall be carried out in accordance with current state regulations, specifically detailed in Circular Joint No. 80/2013/TTLT-BTC-BNN dated June 14, 2013, issued by the Ministry of Agriculture and Rural Development and the Ministry of Finance, guiding the management and use of operating funds for forest protection and development activities.
3. The expenditure level: Shall be implemented according to current regulations applicable to administrative agencies and public institutions, applied specifically according to each type of task.
4. Organizations and individuals directly using the funds shall be responsible for the truthfulness, accuracy, and completeness of the indicators and contents recorded on payment request vouchers.
5. Organizations and individuals requiring advance payments must prepare a request for advance payment accompanied by a detailed budget estimate, clearly stating the repayment period and being responsible for the amount advanced.
6. Procurement system: in accordance with the provisions of the Bidding Law and current state regulations on procurement.
7. The Director of the Office and Deputy Directors of the Steering Committee are responsible for the approved expenditure decisions.
Chapter 2.
ESTABLISHMENT AND APPROVAL OF PLANS AND BUDGETS
Article 5. Establishment and Approval of Activity Plans
1. Before June 15 each year, the Office of the Steering Committee sends letters to members of the Steering Committee; related units within the Ministry and the Forestry General Department requesting proposals for activities according to the tasks specified in Decision No. 52/QĐ-BCĐBV&PTR Article 10 and Decision No. 1530/QĐ-BNN-TCCB Article 8, along with funding requirements to be submitted to the Office of the Steering Committee for consolidation by June 30.
2. The main content of the proposed activity plans by units includes:
- Activity content;
- Lead unit for the activity;
- Units cooperating in implementing the activity;
- Time frame and estimated funding.
3. Before July 1 each year, the Office of the Steering Committee completes the next year's activity plan for the Steering Committee and the Office of the Steering Committee, submitting it for approval by the Chairman/Deputy Chairman of the Steering Committee.
Article 6. Establishment and Allocation of Annual Operating Budgets for the Steering Committee and its Office
1. Before July 10 each year, based on the approved activity plan by the Steering Committee, the Office of the Steering Committee, in collaboration with relevant agencies and units, will develop the budget estimate and submit it to the Forestry General Department for consolidation and reporting to the Ministry of Agriculture and Rural Development.
2. The budget estimate shall be prepared in accordance with the provisions of Circular Joint No. 80/2013/TTLT-BTC-BNN dated June 14, 2013, issued by the Ministry of Agriculture and Rural Development and the Ministry of Finance, guiding the management and use of operating funds for forest protection and development activities; Decision No. 1707/QĐ-BNN-TC dated June 9, 2008, issued by the Ministry of Agriculture and Rural Development, regarding the establishment and allocation of annual state budget estimates for administrative agencies and public institutions under the Ministry of Agriculture and Rural Development, and any amendments, supplements, or replacements thereof.
3. The Financial Department, acting on behalf of the Minister of Agriculture and Rural Development, allocates the budget to the Office of the Steering Committee.
Article 7. Approval of the budget for operational expenses and bidding plans of the Steering Committee and the Steering Committee Office annually
1. Based on the allocated state budget, the Steering Committee Office proposes the budget and the main implementing unit submits it to the Ministry for approval.
2. The main implementing unit prepares the outline, budget, implementation plan, and bidding plan (for tasks that require bidding) and sends them to the Steering Committee Office within fifteen days from receiving the task assignment document from the Ministry. The preparation of the outline and budget follows the regulations of the State and the Ministry of Agriculture and Rural Development for each type of activity.
3. The Steering Committee Office prepares the budget and bidding plan for tasks directly implemented by the Office and compiles them together with the budgets and bidding plans of other main implementing units into the annual state budget expenditure plan, submitting it to the Ministry of Agriculture and Rural Development.
4. The Department of Finance, acting on behalf of the Minister of Agriculture and Rural Development, approves the annual state budget and bidding plan.
5. During the implementation process, if there are changes to the budget or bidding plan, the Steering Committee Office submits these changes for approval and supplementation to the Ministry of Agriculture and Rural Development.
Article 8. Review and Approval of Activity Outlines and Budgets
1. Within thirty days from the approval of the state budget by the Ministry of Agriculture and Rural Development, the Steering Committee Office organizes reviews and approvals for activities. For complex activities, in necessary cases, the Steering Committee Office may establish a review board or hire consultants for pre-approval review.
2. During the implementation of activities, in case of any arising issues or changes, the main implementing unit must submit a document to the Steering Committee Office for adjustment consideration and can only proceed after receiving approval from the Steering Committee Office.
Chapter 3.
MANAGEMENT OF IMPLEMENTATION OF ACTIVITIES
SECTION 1. RESPONSIBILITY CONTRACTS
Article 9. Responsibility Contracts
1. Responsibility contracts are signed between the Steering Committee Office and the main implementing unit with legal person status, serving as the basis for management, acceptance, and settlement.
2. SECTION 2. ADVANCE PAYMENTS, SETTLEMENTS AND MANAGEMENT OF ACCOUNTING DOCUMENTS
Article 10Advance Payments and Settlements
1. The Steering Committee Office only makes advance payments for activities with approved plans and budgets by the Office leadership.
2. For dedicated staff and concurrently assigned staff of the Steering Committee Office, advance payments and settlements follow the current regulations for administrative and public service units.
3. For collaborating units: According to the implementation plan and approved budget, the collaborating unit prepares a single settlement document upon completion of the activity or separate settlement documents for completed components of the activity, sending them to the Steering Committee Office for settlement..
4. By no later than December 15 of the fiscal year, the main implementing unit must send a document to the Steering Committee Office to conduct the acceptance of activity results, terminate the responsibility contract, and prepare the final settlement document and repayment statement. Collaborating units must submit the final settlement document for the entire activity to the Steering Committee Office.
5. Advance payments and settlements are made on a per-activity basis, through bank transfers, minimizing cash usage.
Article 11. Management of accounting documents
1. Retain accounting documents in accordance with the Accounting Law.
2. Units responsible for activities
a) For Departments and Committees under the General Department and Ministry: The Office of the Steering Committee retains accounting documents.
b) For units with full legal status: accounting documents are stored at the unit.
3. The Office of the Steering Committee retains the following accounting documents:
a) All accounting documents from activities directly carried out by the Office of the Steering Committee and activities carried out in coordination with Departments and Committees.
b) For units responsible for activities with full legal status, the Office of the Steering Committee retains the following accounting documents:
- Assignment documents; review and approval of outlines and budgets;
- Responsibility contracts;
- Acceptance certificates issued by the acceptance committee;
- Lists of vouchers and expenses;
- Accounting vouchers related to advance payments and expense settlements prepared by the Office of the Steering Committee.
Section 3. MANAGEMENT OF NON-CONTRACT WORK
Article 12. Payment of domestic travel expenses
1. Formation of working groups and travel permits
a) Units responsible proactively implement their work plans included in approved activity plans and budgets. Travel permits are issued by the unit. However, for Departments and Committees under the Forestry General Department, travel permits are issued by the Office of the Steering Committee.
b) For activities carried out by Steering Committee members or Ministries and sectors, or coordinated activities: when the Steering Committee decides to form a group to carry out tasks involving multiple agencies, the Office of the Steering Committee is responsible for organizing and settling accounts. Travel permits are issued by the Office of the Steering Committee.
c) For working groups assigned by the Steering Committee to be implemented by Ministries and sectors, the costs are covered from the annual state budget expenditure plan of the respective Ministries and sectors.
2. Means of transportation
a) Use official vehicles:
- For Departments and Committees under the Forestry General Department: the responsible unit sends a vehicle request to the General Department's Office for vehicle allocation.
- For working groups specified in point b, Clause 1, Article 12, the Office of the Steering Committee arranges transportation means. In cases where the decision to establish the group involves requisitioning vehicles from related units, the Office of the Steering Committee sends a requisition letter to the vehicle management unit.
b) During the journey, staff using the vehicle must verify and confirm the mileage according to the driver's logbook and comply with the regulations on vehicle management and usage of the vehicle management unit.
c) Settlement of transportation expenses for official duties is carried out in accordance with current state regulations. Transportation by hired means is settled according to the terms of the contract.
Article 13. Departure and return of delegations
Management of departure and return of delegations is conducted in accordance with current state regulations, the Ministry of Agriculture and Rural Development, and the Forestry General Department.
Article 14. Management and use of office supplies, tools, and equipment at the Office of the Steering Committee
1. Quarterly, the designated department compiles the demand for various types of materials, office supplies, and office equipment for serving the activities of the Office and submits it to the leadership of the Office of the Steering Committee for approval.
2. Administrative staff of the Office of the Steering Committee maintains records of the distribution of office supplies, detailed to each user. Monthly or quarterly, the Secretariat department collaborates with the accounting staff to conduct inventory checks and reconcile settlement accounts.
3. For printed and photocopied documents: documents for meetings may be outsourced for printing and photocopying services, subject to approval by the leadership of the Office of the Steering Committee. Monthly, administrative secretarial staff compile and reconcile with the service provider to prepare payment lists.
4. Providers of office supplies and document photocopying services are selected by the Office of the Steering Committee based on three competitive quotations, a selection record, and a general contract for the year.
Article 15. Activities to be carried out by the Units in charge of implementing activities
1. Management and use of office supplies, tools, equipment: purchase and use of office supplies according to the budget for activities implemented by the Unit in charge, similar to regulations applicable to the Office of the Steering Committee.
2. Other activities: implement in accordance with state regulations and those of the unit but must not contravene regulations of the Office of the Steering Committee.
Article 16. Allocated expenses
1. Electricity, water, environmental sanitation costs, and other common expenses of the Office of the Steering Committee shall be reimbursed based on the allocation from the Office of the Forestry General Department.
2. In cases where staff of the Office of the Steering Committee are assigned to work with task forces of the General Department or task forces of the General Department that also carry out activities of the Steering Committee and the Office of the Steering Committee, the costs for such activities and tasks shall be determined in the decision establishing the task force.
Article 17. Other expenses
Other expenses serving the management and operation of the Steering Committee and the Office of the Steering Committee shall be implemented in accordance with current state regulations applicable to administrative and public service units.
SECTION 4. MANAGEMENT OF ACTIVITIES UNDER CONTRACTS
Article 18. Management of activities directly implemented by the Office of the Steering Committee
1. For activities directly implemented by the Office of the Steering Committee, tendering, contract signing, and acceptance payment shall be conducted in accordance with current regulations applicable to public service institutions.
2. The Office of the Steering Committee shall take the lead and coordinate with the General Department and relevant units to review tender documents/bid request documents, selection results, submit for approval by the Director of the Office of the Steering Committee, and supervise implementation. Revenue from selling tender documents (if any) shall be managed and used by the Office of the Steering Committee in accordance with current regulations.
Article 19. Management of activities carried out by cooperating Units
1. Based on annual plans, budget estimates, and tender plans approved by the Ministry of Agriculture and Rural Development, and detailed cost estimates approved by the Office of the Steering Committee, the Office of the Steering Committee and the cooperating Units shall build or hire consultants to prepare tender documents/bid request documents, organize reviews, and tenders in accordance with current regulations. Revenue from selling tender documents (if any) shall be managed and used by the Office of the Steering Committee in accordance with current regulations.
2. Building and signing contracts
a) The cooperating Units and the Office of the Steering Committee shall draft the contract and conduct negotiations. Contracts in foreign languages must be translated into Vietnamese as required.
b) After completing the contract, the Director of the Office of the Steering Committee and the Head of the cooperating Unit shall sign the contract as Party A, affixing the seal of the Office of the Steering Committee.
c) Contract files including the contract and accompanying documents shall be managed by the Office of the Steering Committee in accordance with current regulations.
3. Management of contract implementation
a) Depending on the type of contract, management of contract implementation may include the following aspects: progress management; quality management; quantity and price management; contract amendment management, and other contract contents.
b) The Office of the Steering Committee and the cooperating Units shall be responsible for managing contract implementation. In case of contract amendments, the cooperating Units and the Office of the Steering Committee shall sign the contract amendments.
4. Acceptance and settlement of contracts
a) The cooperating Units and the Office of the Steering Committee shall organize acceptance, handover, and product management under the contract. For products requiring establishment of an acceptance committee, the cooperating Units shall propose to the Director of the Office of the Steering Committee to establish the committee in accordance with current regulations for each type of product.
b) Acceptance results and minutes shall be submitted to the Office of the Steering Committee for final settlement procedures.
6. Advance payments, settlements, and final settlements of contracts
a) The Office of the Steering Committee shall be responsible for advance payments, recovery of advances, and contract settlements in accordance with regulations for each type of contract and agreements in signed contracts.
b) After making advance payments or recovering advances or settling payments, the Office of the Steering Committee shall notify the cooperating Units.
c) Final settlement of contracts shall be conducted based on the acceptance minutes and the value determination table of completed works proposed for payment. The Office of the Steering Committee and the cooperating Units shall be responsible for final settlement of contracts.
Article 20. Management of activities for the Leading Unit carrying out activities with legal personality status
1. Based on the outline, budget, bidding plan approved by the Office of the Steering Committee, and the responsibility contract signed between the unit and the Office of the Steering Committee, the Leading Unit shall organize the construction or hire consultants to prepare tender documents/bid invitation documents, conduct reviews, and hold bids in accordance with current regulations. Revenue from selling tender documents (if any) shall be managed and utilized by the unit in accordance with current regulations.
2. Building and signing contracts
a) The Leading Unit shall enter into contracts and conduct contract negotiations. Contracts in foreign languages must be translated into Vietnamese in accordance with the regulations.
b) After completing the contract, the head of the Leading Unit (as the Party B) shall be responsible for signing the responsibility contract.
c) Contract files including the contract and accompanying documents shall be managed by the Office of the Steering Committee in accordance with current regulations.
3. Management of contract implementation
a) Depending on the type of contract, management of contract implementation may include the following aspects: progress management; quality management; quantity and price management; contract amendment management, and other contract contents.
b) The Leading Unit shall be responsible for managing the implementation of the contract.
4. Acceptance and settlement of contracts
a) The Leading Unit shall inspect, accept delivery, and manage the contract products in accordance with the regulations. For products that require the establishment of an Inspection Board according to the regulations, the Leading Unit may organize the Inspection Board itself or submit a written request to the Director of the Office of the Steering Committee to establish the Board and approve the inspection results in accordance with the current regulations for each type of product.
b) The inspection results and minutes of the Inspection Board shall be transferred to the Office of the Steering Committee.
6. Advance payments, settlements, and final settlements of contracts
a) The Leading Unit shall be responsible for provisional payments, recovery of provisional payments, and settlement of contracts in accordance with the regulations for each type of contract and the agreement in the signed contract.
b) The final settlement of the contract shall be carried out based on the inspection minutes of the contract, the table determining the value of completed work volume proposed for payment, and the contract termination. The Leading Unit shall be responsible for preparing a complete set of settlement documents to be submitted to the Office of the Steering Committee for settlement.
Article 21. Product Management
The Leading Unit and the cooperating units shall be responsible for managing the products of the Office of the Steering Committee and submitting them to the Office of the Steering Committee in accordance with the Decision approving the outline and budget. For basic investigation tasks/projects implemented in accordance with the regulations of the Ministry of Agriculture and Rural Development, they shall be monitored, managed, and summarized.

IMPLEMENTATION
Article 22. Implementation organization
1. Contents approved before the effective date of this Decision shall be implemented in accordance with the approval decisions.
2. During the implementation process, if there are difficulties or obstacles, relevant organizations and individuals shall report to the Office of the Steering Committee for consolidation and submission to the Ministry of Agriculture and Rural Development for timely review and adjustment./.
