Decision No. 1150/QD-TTg Establishes the Management Board for the Southeast Nghe An Economic Zone in Nghe An Province

ESTABLISHING THE MANAGEMENT BOARD OF THE EASTERN NAM NGHE KINETIC ECONOMIC ZONE, NGHE AN PROVINCE

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law;

Pursuant to Decision No. 85/2007/QĐ-TTg dated June 11, 2007 of the Prime Minister on the establishment and issuance of the operational regulations for the Eastern Nam Nghe Economic Zone, Nghe An Province;

Considering the proposal of the Chairman of the People's Committee of Nghe An Province at Report No. 4899/TTr-UBND dated August 3, 2007; and that of the Minister of Home Affairs at Report No. 2361/TTr-BNV dated August 17, 2007,

DECISION:

Article 1. On the establishment, position, and functions of the Management Board of the Eastern Nam Nghe Economic Zone, Nghe An Province

1. Establish the Management Board of the Eastern Nam Nghe Economic Zone, Nghe An Province (hereinafter referred to as the Management Board) and integrate the Management Board of the Industrial Zones of Nghe An Province (established pursuant to Decision No. 107/1999/QĐ-TTg dated April 23, 1999 of the Prime Minister) into the Management Board.

2. The Management Board is a state management agency under the People's Committee of Nghe An Province; it has the function of managing investment, construction, and development of the Eastern Nam Nghe Economic Zone and industrial zones within the territory of Nghe An Province according to the operational regulations, planning, plans, and implementation schedules approved by competent state agencies.

3. The Management Board has legal personality, bank accounts, office premises, and a seal with the National Emblem; it is the focal point for the provincial budget plan of Nghe An Province; it is allocated separate development capital from the central government budget. Operating expenses of the Management Board and operating expenses for public services are provided from the state budget according to the provisions of the law.

Article 2. Duties and powers of the Management Board

The Management Board performs duties and powers as prescribed in:

1. Article 81 of Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law;

2. Article 29 of the Operational Regulations of the Eastern Nam Nghe Economic Zone, Nghe An Province issued together with Decision No. 85/2007/QĐ-TTg dated June 11, 2007 of the Prime Minister;

3. Other relevant legal documents.

Article 3. Organizational structure and staffing of the Management Board

1. Organizational Structure:

a) The Management Board has a Director appointed and relieved of duty by the Chairman of the People's Committee of Nghe An Province; several Deputy Directors and some members appointed and relieved of duty by the Chairman of the People's Committee of Nghe An Province upon the recommendation of the Director of the Management Board;

b) The Management Board has an administrative support staff including: an office, specialized departments, and a representative office in Hanoi City;

c) Affiliated units providing public services.

Based on the requirements and tasks for developing the Eastern Nam Nghe Economic Zone and industrial zones in Nghe An Province at each specific stage, the Director of the Management Board shall take the lead and coordinate with relevant departments and agencies to submit to the Chairman of the People's Committee of Nghe An Province for decision within their authority regarding the organizational structure of the Management Board.

2. Staffing:

a) Staffing of the Management Board includes: the Director, specialized Deputy Directors, and the staffing of the office, specialized departments, and the representative office in Hanoi City are administrative positions;

b) Staffing of the Management Board is decided by the Chairman of the People's Committee of Nghe An Province in accordance with the provisions of the law on the decentralization of administrative and public service staffing management and the staffing management mechanism for public service units.

3. The Director of the Management Board shall submit to the People's Committee of Nghe An Province for detailed regulations on the functions, duties, powers, and organizational structure of the Management Board in accordance with the provisions of the law.

Article 4. Effectiveness

This Decision takes effect from the date of issuance and replaces Decision No. 107/1999/QĐ-TTg dated April 23, 1999 of the Prime Minister on the establishment of the Management Board of the Industrial Zones of Nghe An Province.

Article 5. Responsibilities for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairman of the People's Committee of Nghe An Province, Director of the Management Board of the Eastern Nam Nghe Economic Zone, Nghe An Province, Director of the Management Board of the Industrial Zones of Nghe An Province, Heads of agencies, units, organizations, and individuals concerned are responsible for implementing this Decision./.
