THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
I. Department of Labor, Invalids, and Social Affairs:
Pursuant to the Labor Code dated June 23, 1994; Law Amending and Supplementing Certain Provisions of the Labor Code dated April 2, 2002;
After receiving the opinion of the Ministry of Health in Circular No. 7263/YT-DP/AIDS dated July 24, 2003 regarding the delegation to the Ministry of Labor-Social Affairs and War Invalids to issue the list of occupations and jobs that are arduous, hazardous, and particularly arduous, hazardous;
DECISION:
Article 1. Attached to this Decision is the provisional list titled: "Occupations and Jobs Particularly Arduous, Hazardous, and Arduous, Hazardous."
Article 2. Workers engaged in the occupations and jobs mentioned in Article 1 shall enjoy labor protection, wage, and social insurance benefits as prescribed in the Labor Code, the Law Amending and Supplementing Certain Provisions of the Labor Code, and guiding documents for implementation.
Article 3. Workers in ministries and sectors engaged in occupations and jobs listed in this Decision and Decisions No. 1453/LDTBXH-QD dated October 13, 1995, Decision No. 915/LDTBXH-QD dated July 30, 1996, Decision No. 1629/LDTBXH-QD dated December 26, 1996, Decision No. 190/1999/QD-LDTBXH dated March 3, 1999, and Decision No. 1580/2000/QD-LDTBXH dated December 26, 2000 issued by the Minister of Labor-Social Affairs and War Invalids shall be subject to and entitled to labor protection, wage, and social insurance benefits as prescribed for the occupations and jobs already issued.
Article 4. This Decision takes effect fifteen days after its publication in the Official Gazette. For occupations and jobs not specified in the lists attached to the aforementioned Decisions, ministries and sectors must review and prepare a list to submit to the Ministry of Labor-Social Affairs and War Invalids and the Ministry of Health for examination and supplementary issuance./.
