OF THE MINISTRY OF FINANCE NO. 11597 TC/ĐT ON OCTOBER 28, 2002
REGARDING ADVANCING PART OF THE INVESTMENT CAPITAL PLAN FOR CONSTRUCTION AND DEVELOPMENT PROJECTS IN 2003

 

Respected: - Ministries, agencies equivalent to ministries, and government agencies,

General Company No. 91, central bodies of mass organizations.

- People's Committees of provinces and centrally-administered cities.

 

To ensure proactive capital availability for projects in the plan for 2003 to commence and continue construction right from the beginning of the year while awaiting formal allocation decisions for 2003, the Ministry of Finance proposes advancing a portion of the investment capital from the State budget for 2003 as follows:

1. The target is important and urgent projects, particularly dike and flood control projects currently under continuous construction transitioning from 2002 to 2003, requiring immediate payment in early 2003 and committed by relevant ministries or sectors (for central projects) and local departments or agencies (for provincial projects) for inclusion in the 2003 plan.

2. The amount of advanced capital corresponds to the funds needed for payment in January and February 2003 for these projects.

3. Implementation method:

- For projects under central ministries or sectors' management:

+ Based on implementation progress and projected plans for 2003 of the aforementioned projects, relevant ministries or sectors prepare capital advance requirements for each project to send to the Ministry of Finance (Investment Department) in October 2002.

+ The Ministry of Finance will review and announce the amount of advanced capital in November 2002 and transfer funds to the State Treasury for payment. Payment procedures follow current regulations. + Upon receiving investment plan targets for construction and development projects in 2001, ministries or sectors are responsible for allocating plans ensuring that the minimum allocation equals the advanced amount.

- For projects under local management:

+ Based on implementation progress and projected plans for 2003 of the aforementioned projects, departments or agencies (assigned by provincial People's Committees) prepare capital advance requirements for each project to send to the Department of Finance and Prices in October 2002.

+ The Department of Finance and Prices will review and announce the amount of advanced capital in November 2002 and transfer funds to the State Treasury for payment. Payment procedures follow current regulations. For provinces facing difficulties after balancing available resources, they should report to the Ministry of Finance for resolution.

+ Upon receiving investment plan targets for construction and development projects in 2003, departments or agencies are responsible for allocating plans ensuring that the minimum allocation equals the advanced amount. 4. Method of advancing capital:

- Relationship between financial authorities and State Treasury; when transferring advanced funds to KBNN (State Treasury), financial authorities process expenditures before the 2003 budget estimate

(account 303) without processing a refund of provisional advances.

- Relationship between financial authorities and projects: advanced capital is included in the allocated capital for the 2003 plan and clearly communicated by financial authorities in the payment plan for 2003. If a project does not receive a 2003 allocation or receives an insufficient allocation, financial authorities will deduct from the total plan amount of ministries or sectors (for central projects) and local departments or agencies (for provincial projects). 5. Implementation period in Q4/2002. The Ministry of Finance and Departments of Finance and Prices transfer advanced funds to the State Treasury in December 2002. For urgent projects requiring commencement in 2002 or accelerated progress due to insufficient initial funding, ministries or sectors should report to the Ministry of Finance for resolution. recover the advance payment.

- Relationship between the Finance Authority and the project: The advance capital is included in the allocated capital under the 2003 plan and clearly stated in the 2003 disbursement plan. In cases where the project does not have a 2003 plan or has a lower allocation than the advanced capital, the Finance Authority will deduct from the total budget plan of the Ministry or sector (for central projects) and the Department or agency at the local level (for local projects). If the plan amount is lower than the capital advance, the financial authority shall deduct it from the total planned amount of the Ministry or sector (for central projects) and the Department or agency at the provincial level (for local projects).

5. Implementation period in Q4/2002. The Ministry of Finance and Provincial Finance Departments - Prices transfer the advance capital to the State Treasury by December 2002.

For urgent projects with a government directive requiring commencement in 2002 or acceleration of progress where the initial plan did not allocate sufficient funds, relevant Ministries and sectors shall report to the Ministry of Finance for resolution.
