Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government stipulating the functions, tasks, powers, and organizational structure of AND Upon consideration of the proposal of the Director of the Ministry’s Office,

Pursuant to Decision No. L067/QD-TTG dated October 27, 2000 of the Government on supporting coffee for export in the 2000-2001 crop year;

DECISION:

Article 1. Issuing the "Interim Storage Regulation and Management of the Quantity of Interim Stored Coffee attached to this Decision."

Article 2. This Decision takes effect from the date of signature.

Article 3. Chairmen of People's Committees of Dak Lak, Giai Rai, Lam Dong, and Dong Nai Provinces; Chairman of the Board of Directors of Vietnam Coffee Corporation; Heads of competent agencies under the Ministry and enterprises assigned to store coffee temporarily shall be responsible for implementing this Decision./.

REGULATION ON INTERIM STORAGE AND MANAGEMENT OF THE QUANTITY OF INTERIM STORED COFFEE

(Issued by Decision No. 116/2000/QĐ-BNN-KH dated November 15, 2000 of the Ministry of Agriculture and Rural Development)

Article 1 General Provisions

Provincial People's Committees of Dak Lak, Giai Rai, Lam Dong, and Dong Nai Provinces and Vietnam Coffee Corporation organize the implementation of purchasing interim stored coffee according to the quota allocated in Decision No. 1067/QĐ-TTG dated October 27, 2000 of the Prime Minister.

The People's Committees of the aforementioned provinces decide to select and assign quotas for purchasing interim stored coffee to enterprises within their province (including private enterprises voluntarily participating).

The Board of Directors of Vietnam Coffee Corporation decides to select and assign interim storage quotas to member enterprises under the Corporation.

The provincial People's Committees and Vietnam Coffee Corporation shall notify the list of enterprises and the quantity of coffee assigned to each enterprise to the Ministry of Agriculture and Rural Development, Ministry of Finance, Ministry of Trade, State Bank of Vietnam, Government Price Control Board, and Vietnam Coffee-Cocoa Association for coordination and guidance to implement before November 30, 2000.

Enterprises assigned to implement interim storage of coffee from various economic sectors must meet the conditions specified in Article 2 of this Regulation.

Article 2 Conditions for enterprises implementing interim storage of coffee:

Must have warehouses with sufficient area to implement the interim storage quota;

Warehouses must meet technical requirements to ensure that coffee does not deteriorate during interim storage;

Do not mix interim stored coffee with coffee being traded.

Article 3 Time for purchasing and interest rate support:

The time for purchasing interim stored coffee starts from November 15, 2000 to January 31, 2001. The state will only provide interest rate support for lots of coffee purchased for interim storage during this period.

The period for interest rate support runs from the date of purchase until May 15, 2001.

Article 4 Types and prices of coffee purchased for interim storage:

Coffee purchased for interim storage is Robusta Grade 2 (R2).

Purchase price is based on market prices at the time in each locality.

Article 5 Loan procedures and interest rate support

Enterprises participating in implementing the interim storage quota can borrow funds from banks according to the guidelines of the State Bank of Vietnam in Circular No. 1071/CV-NHNN dated November 3, 2000 regarding support for coffee exports in the 2000-2001 crop year.

Procedures and documentation for interest rate support for bank loans shall be carried out according to the guidelines of the Ministry of Finance.

Article 6 Management of the quantity of stored coffee

Enterprises are responsible for preserving the quantity and quality of interim stored coffee themselves.

During the interim storage period, if coffee shows signs of deterioration, enterprises must report and obtain written approval from the Chairman of the Provincial People's Committee (for enterprises assigned by the Chairman of the Provincial People's Committee); from the Chairman of the Board of Directors of Vietnam Coffee Corporation (for units assigned by Vietnam Coffee Corporation).

When the interim storage period ends as prescribed, enterprises may proactively release coffee into circulation.

, Clause 1, Clause 2 Article 7a of this Regulation. Guidance and inspection of implementation:

Provincial People's Committees of Dak Lak, Giai Rai, Lam Dong, Dong Nai, and Vietnam Coffee Corporation shall instruct enterprises assigned to interim storage to fully comply with all regulations in this Regulation to achieve the goal set by the Prime Minister of maintaining coffee prices for farmers in the 2000-2001 production season, using interim storage capital for its intended purpose, purchasing the required amount of coffee according to the assigned quota, and not including existing inventory in interim storage.

The Ministry of Agriculture and Rural Development assigns the Planning and Master Planning Department to coordinate with the Vietnam Coffee-Cocoa Association to monitor the purchase of interim stored coffee; to report periodically monthly and quarterly to the Ministry of Agriculture and Rural Development and related Ministries and Departments. If any new issues arise, they should promptly propose solutions to report to the Prime Minister for consideration and decision.
