THE MINISTER OF INDUSTRY

Pursuant to Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry;

Pursuant to Decree No. 50/CP dated August 28, 1996 of the Government on the establishment, restructuring, dissolution, and bankruptcy of state-owned enterprises, and Decree No. 38/CP dated April 28, 1997 of the Government amending and supplementing certain articles of Decree No. 50/CP;

Pursuant to Decision No. 183/QĐ-TTg dated February 19, 2003 of the Prime Minister approving the overall plan for the reorganization and modernization of state-owned enterprises under the Vietnam Chemicals Corporation for the period 2003-2005;

Acting on the authority delegated by the Prime Minister in Circular No. 855/CP-ĐMDN dated June 25, 2003 regarding the merger of the Pirít Company into the Vietnam Apatít Company, Vietnam Chemicals Corporation;

Considering the proposal of the Board of Directors of Vietnam Chemicals Corporation in Circular No. 377/CV-HĐQT dated May 6, 2003;

At the proposal of the Director of the Cadre and Civil Servant Department,

Pursuant to …;

Article 1. Merge the Pirít Company into the Vietnam Apatít Company, Vietnam Chemicals Corporation.

Article 2. Direct the Board of Directors of Vietnam Chemicals Corporation to organize and implement this merger in accordance with current regulations of the State.

Article 3. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

The Head of the Office, the Inspector General, the Heads of Departments, the Directors of Bureaus under the Ministry, the Chairman of the Board of Directors, and the General Director of Vietnam Chemicals Corporation, the Director of the Pirít Company, and the Director of the Vietnam Apatít Company are responsible for enforcing this Decision./.
