Article 1: Object and Scope of Regulation
1. This Decision applies to the carrying of jewelry gold, art gold, gold bars, raw gold, and international standard gold when exiting and entering the country by the following subjects:
a. Individuals from Vietnam and foreign countries carrying gold when exiting and entering through Vietnamese border gates with passports issued by competent authorities in Vietnam or abroad (hereinafter referred to as "individuals exiting and entering the country");
b. Vietnamese individuals permitted to settle abroad carrying gold when exiting or foreign individuals permitted to settle in Vietnam carrying gold when entering;
c. Individuals from Vietnam and foreign countries carrying gold when exiting and entering through Vietnamese border gates with travel documents or border identity cards;
2. Individuals from Vietnam and foreign countries are not allowed to send gold out of the country or receive gold sent from abroad under the form of gifts or presents via postal services, air transport, or maritime transport.
Article 2: Definitions
In this Decision, the following terms are understood as follows:
1. "Jewelry gold" refers to gold products with or without precious stones, precious metals, or other materials for personal adornment needs such as rings, necklaces, bracelets, earrings, brooches, and other types of jewelry.
2. "Art gold" refers to gold products with or without precious stones, precious metals, or other materials for decorative purposes such as picture frames, statues, and other types.
3. "Gold bars" refers to gold that has been stamped into various shapes, marked with weight and quality indicators, and imprinted with the manufacturer's code.
4. "Raw gold" refers to gold in forms such as blocks, ingots, sheets, grains, wires, solutions, powders, semi-finished products for jewelry and art, and other types but not international standard gold.
5. "International standard gold" refers to gold blocks or ingots with a purity of 99.5% and a weight of at least 1 (One) kilogram, bearing the manufacturer's mark recognized by the Gold Association and the International Gold Exchange.
Article 3: Carrying international standard gold when exiting and entering the country with a passport
1. Individuals entering the country may carry international standard gold with a weight of 1 (One) kilogram and must declare to Customs. If exceeding 1 (One) kilogram, they must process storage procedures at the Customs warehouse for the excess amount to be taken out upon exit or process transfer abroad and bear all related costs incurred.
2. Individuals exiting the country wishing to carry international standard gold must have a permit issued by the Director of the Branch of the State Bank of Vietnam in their place of residence and must declare to Customs. If individuals have carried international standard gold upon entry according to Clause 1 of this Article and declared to Customs, they can take it out upon exit with a maximum weight equal to the declared weight upon entry without needing a State Bank permit but must present the Customs declaration form upon entry.
Article 4: Carrying non-international standard gold when exiting and entering the country with a passport
1. Individuals exiting the country carrying jewelry gold, art gold, gold bars, and raw gold with a total weight of 300 (Three hundred) grams or more must declare to Customs. If carrying art gold, gold bars, and raw gold with a total weight of 1 (One) kilogram or more, they must have a permit issued by the Director of the Branch of the State Bank of Vietnam in their place of residence.
Individuals who have carried jewelry gold, art gold, gold bars, and raw gold upon entry can take them out upon exit with a weight not exceeding the declared weight upon entry without needing a State Bank permit but must present the Customs declaration form upon entry.
2. Individuals entering the country carrying jewelry gold, art gold, gold bars, and raw gold with a total weight of 300 (Three hundred) grams or more must declare to Customs. If carrying gold bars and raw gold with a total weight exceeding 1 (One) kilogram, they must process storage procedures at the Customs warehouse for the excess amount to be taken out upon exit or process transfer abroad and bear all related costs incurred.
Article 5: Carrying gold when exiting and entering the country with travel documents or border identity cards
1. Vietnamese and foreign individuals exiting and entering the country with travel documents or border identity cards are not allowed to carry art gold, gold bars, raw gold, or international standard gold.
2. Vietnamese and foreign individuals exiting and entering the country with travel documents or border identity cards may carry jewelry gold worn on the person for adornment purposes and do not need to declare to Customs.
Article 6: Carrying gold when exiting and entering the country in the case of settlement
1. Foreign individuals permitted to settle in Vietnam upon entry may carry jewelry gold, art gold, gold bars, and raw gold with a total weight of 300 (Three hundred) grams or more or carry international standard gold and must declare to Customs but do not need a State Bank permit.
2. Vietnamese individuals permitted to settle abroad upon exit carrying jewelry gold, art gold, gold bars, and raw gold with a total weight of 300 (Three hundred) grams or more must declare to Customs. Individuals carrying art gold, gold bars, and raw gold with a total weight of 3 (Three) kilograms or more or carrying international standard gold with a weight of 1 (One) kilogram or more must have a permit issued by the Director of the Branch of the State Bank of Vietnam in their place of residence.
Article 7: Documents and procedures for issuing permits
Individuals wishing to apply for a permit to carry gold when exiting the country must submit the application to the Branch of the State Bank of Vietnam in their place of residence. The documents include:
1. An application for a permit to carry gold when exiting the country according to the model attached as Appendix 1 to this Decision;
2. Purchase invoices or other documents proving the legitimate source or a personal declaration by the individual carrying gold regarding the legality of the quantity of gold to be carried.
3. A copy of the passport (the original passport must be presented for verification) and entry visa for countries requiring such a visa;
4. The decision of the competent authority permitting settlement (in cases where individuals bring gold for settlement purposes).
Within ten (10) working days from the date of receipt of complete and valid application materials, the Director of the Branch of the State Bank of Vietnam in provinces and centrally governed cities shall consider issuing a permit or refusing to issue a permit to the individual. In case of refusal, a written explanation of the reasons must be provided.
Article 8: Effectiveness
1. This Decision takes effect fifteen (15) days after the date of signature and replaces Decision No. 416/1998/QĐ-NHNN7 dated December 8, 1998 of the Governor of the State Bank of Vietnam on carrying gold by individuals when entering and exiting the country.
2. The Head of the Office of the State Bank of Vietnam, the Director of the Department of Foreign Exchange Management, the Heads of relevant units of the State Bank of Vietnam, the Directors of the Branches of the State Bank of Vietnam in provinces and centrally governed cities, and related individuals are responsible for implementing this Decision.
