Circular No. 117/2005/TT-BNV guiding the implementation of Decision No. 205/QĐ-TTg dated December 10, 2004 of the Prime Minister on certain policies and benefits for senior officials.

CIRCULAR

Guidelines for implementing Decision No. 205/2004/QĐ-TTg dated December 10, 2004 of the Prime Minister on the implementation of certain policies and regulationsfor senior officials.

Pursuant to Clause 2, Article 9 of Decision No. 205/2004/QĐ-TTg dated December 10, 2004 of the Prime Minister on the implementation of certain policies and regulations for senior officials (hereinafter referred to as Decision No. 205/2004/QĐ-TTg), after reaching consensus with the Central Organization Committee and the Central Financial and Administrative Management Committee, the Ministry of Home Affairs provides guidelines for the implementation of certain specific contents of Decision No. 205/2004/QĐ-TTg as follows:

I. OBJECTS OF IMPLEMENTATION:

The positions listed in Article 2 of Decision No. 205/2004/QĐ-TTg apply to incumbent and former senior officials who have ceased holding office, retired from work, or retired. It does not apply to cases where they have been disciplined with dismissal from their posts.

II. GUIDELINES FOR CONTENTS IN CERTAIN ARTICLES AND CLAUSES OF DECISION NO. 205/2004/QĐ-TTG:

1. For incumbent senior officials:

1.1. Salary and Allowances:

Senior officials of the Party and State as stipulated in Article 2 of Decision No. 205/2004/QĐ-TTg shall be entitled to the salary level according to the current regulations. 1. 2. Housing regime:

In accordance with Clause 1, Article 9 of Decision No. 205/2004/QĐ-TTg, the agency where senior officials work must arrange housing and official residences in accordance with prescribed standards. In cases where the agency cannot provide such arrangements, it shall coordinate with the Central Financial Management Board to consider and submit to the Politburo for decision. Upon ceasing to hold office, senior officials must return official residences to the competent authority and be reassigned housing in accordance with prescribed standards.

1. 3. Service personnel regime:

Principle: Service personnel and attendants must ensure political integrity, moral character, capability, and sense of responsibility. Regarding the standard and policy for assistants and secretaries serving senior officials of the Party and State, they shall implement the conclusion of the Political Bureau (Term VIII) as stated in Notification No. 75-TB/TW dated April 6, 1998, issued by the Central Organization Board. The health monitoring doctor shall be selected by the Central Board for Cadre Health Care; security officers shall be arranged by the Ministry of Public Security; drivers and attendants shall be provided by the managing agency.

- For senior officials specified in Clause 1, Article 2 of Decision No. 205/2004/QĐ-TTg, no more than 5 assistants and secretaries, 2 attendants, and 2 security officers shall be assigned. When considering work requirements that necessitate an increase or decrease in the number of personnel, the agency where the senior official works shall issue a document requesting the Central Organization Board to submit to the Politburo for consideration and decision.

- The implementation of policies for service personnel of senior officials specified in Clause 3, Article 3 of Decision No. 205/2004/QĐ-TTg shall be carried out by the agency where the senior official works, including payment, issuance, and settlement. Simultaneously, plans shall be coordinated with the Central Organization Board, the Central Financial Management Board, and the Central Board for Cadre Health Care to manage certain positions of service personnel according to specific regulations. When senior officials cease holding office, retire, or pass away and no longer work at the agency, the handling and reassignment of service personnel shall be implemented in accordance with Clause 2, Article 6 of Decision No. 205/2004/QĐ-TTg.

- For other regimes stipulated in Clauses 4, 5, 6, 7, 8, 9, and 10 of Article 3 of Decision No. 205/2004/QĐ-TTg, the agency where the senior official works shall implement payments and issuances according to the prescribed regime in Decision No. 205/2004/QĐ-TTg. If any regime is unclear or unimplementable, a report shall be submitted to the Central Organization Board and the Central Financial Management Board for coordination and resolution.

1. 4. On medical examination and treatment, health care regime as stipulated in Clause 7, Article 3 of Decision No. 205/2004/QĐ-TTg:

- The agency where senior officials work shall be responsible for:

+ Coordinating with the Central Board for Cadre Health Care to manage and assign doctors to monitor and provide regular health care for each senior official as prescribed.

+ Coordinating with the Central Board for Cadre Health Care and the Ministry of Health to direct hospitals to carry out regular and emergency medical examinations and treatments for senior officials as prescribed. Proposing overseas medical examinations and treatments for special cases for submission to the Central Organization Board and the Central Board for Cadre Health Care for the Politburo's consideration and decision.

- For each senior official of the Party and State specified in Clause 1, Article 2 of Decision No. 205/2004/QĐ-TTg, one doctor shall be assigned to monitor their health. For positions specified in Clauses 2 and 3, Article 2 of Decision No. 205/2004/QĐ-TTg, one doctor shall monitor the health of two to three senior officials. When senior officials travel on duty, if necessary, a doctor may accompany them (with the opinion of the health protection cadre expert committee).

- The food, examination, treatment, and medication regime shall be implemented in accordance with the Ministry of Health's regulations. In special cases, the Central Board for Cadre Health Care shall request the Central Organization Board to submit to the Politburo for consideration and decision.

1. 5. On recuperation, regular allowances, and emergency allowances regime as stipulated in Clause 8, Article 3 of Decision No. 205/2004/QĐ-TTg:

- Each year, senior officials holding positions specified in Article 2 of Decision No. 205/2004/QĐ-TTg shall have a 10-day domestic recuperation (summer vacation). The Central Organization Board shall notify the senior officials to take the vacation; the Central Financial Management Board shall develop a detailed plan: vacation period, location, allowance, and service organization. The agency where the senior official works shall be responsible for coordinating with the Central Financial Management Board to arrange for the senior official to take the vacation according to the regime.

- Senior officials during the period they hold positions as prescribed in Article 2 of Decision 205/2004/QĐ-TTg shall be entitled to monthly allowances for regular subsidies as stipulated, which shall not be included in health insurance and social insurance. The implementation period starts from the date Decision 205/2004/QĐ-TTg takes effect. The source of funds is from the Party budget, managed and implemented by the Central Finance and Administration Board.

- Senior officials as prescribed in Article 2 of Decision 205/2004/QĐ-TTg, when sick, injured, or facing particularly difficult circumstances in their families, the competent authority shall issue a letter requesting the Central Organization Board to consider granting emergency allowances according to specific circumstances as stipulated but not more than twice a year. The source of funds is from the Party budget, provided by the Central Finance and Administration Board.

1. 6. Regarding the electricity and clean water allowances as prescribed in Clause 9, Article 3 of Decision 205/2004/QĐ-TTg:

The agency where senior officials work shall implement supplementary payments in accordance with regulations, but the family shall directly sign contracts and settle accounts with the relevant management agencies for electricity and water.

1. 7. Regarding the gift allowance as prescribed in Clause 10, Article 3 of Decision 205/2004/QĐ-TTg:

The level of expenditure is not specifically defined, but if gifts have a value of VND 50 million or more, coordination with the Ministry of Finance is required to reach consensus before implementing the decision. For agencies that regularly implement gift allowances, coordination with the Ministry of Finance is necessary to establish expenditure regulations for each recipient and type of gift, serving as a basis for implementation.

2. For retired senior officials:

Specific benefits for retired officials as prescribed in Clause 2, Article 4 of Decision 205/2004/QĐ-TTg include allowances for servants, telephone, lighting, clean water, and summer vacation. The Central Finance and Administration Board will unify the management and implementation of expenditures, providing and settling accounts for policies according to regulations. Agencies where retired senior officials worked shall proactively coordinate with the Central Finance and Administration Board to promptly and properly implement policies.

3. Benefits when senior officials pass away:

- For senior officials (including current and retired officials) who pass away, the Central Finance and Administration Board shall implement expenditures and provide benefits according to regulations, including regular allowances for spouses as stipulated in Clause 4, Article 6; funeral day allowances as prescribed in Article 7 of Decision 205/2004/QĐ-TTg; and holiday allowances according to annual regulations of the Party and State.

- Agencies where senior officials (current or retired) have passed away shall proactively coordinate with the Central Organization Board, the Central Finance and Administration Board, and the Central Board for Cadre Protection and Health Care to organize funerals in accordance with Decree No. 62/2001/NĐ-CP dated September 12, 2001, issued by the Government, and other regulations of the Party and State.

4. Responsibilities for implementation:

- Agencies where senior officials work, including the Central Office, the National Assembly Office, the President's Office, the Government Office, the Ministry of Defense, the Ministry of Public Security, the Hanoi Municipal Committee, the Ho Chi Minh City Municipal Committee, and central agencies of the Party, shall implement according to Clause 1, Article 9 of Decision 205/2004/QĐ-TTg.

- The Ministry of Home Affairs, the Ministry of Finance, the Ministry of Defense, the Ministry of Health, and related agencies shall be responsible for coordinating with the Central Organization Board, the Central Finance and Administration Board, and the Central Board for Cadre Protection and Health Care to implement according to their assigned responsibilities as stipulated in Clauses 2 and 3, Article 9 of Decision 205/2004/QĐ-TTg.

5. Effective Date:

This Circular shall take effect from the date Decision No. 205/2004/QĐ-TTg dated December 10, 2004, issued by the Prime Minister comes into force. During the implementation process, any issues encountered should be addressed through correspondence with the Ministry of Home Affairs, the Central Organization Board, the Central Finance and Administration Board, and the Central Board for Cadre Protection and Health Care for coordinated resolution./.
