FOR ADMINISTRATIVE AND PUBLIC SERVICE ORGANIZATIONS

In Circular No. 5859 TC/QLCS dated June 12, 2002, the Ministry of Finance requested localities to accelerate progress and expand the scope of reporting, registration, and issuance of certificates for management and use rights of headquarters for administrative and public service organizations within their jurisdictions, including houses and land allocated to units such as hospitals, schools, museums, scientific research stations, sports facilities, art performance venues...; striving to complete this task by the end of 2003 so that the Ministry of Finance can compile and report to the Prime Minister.

Implementing the guidance of the Ministry of Finance in the above circular, up to now, some provincial Finance and Price Departments have developed plans to implement the reporting and registration and issuance of certificates for all public service units, which have been submitted to the People's Councils of provinces for approval and directed the Land Administration Department, Construction Department to cooperate with the Finance and Price Department to conduct surveys on houses and land for each plot to establish reporting files; striving to complete this work before the time stipulated by the Ministry of Finance such as Ha Tay, Tien Giang, Gia Lai, Kien Giang, Binh Duong, Nghe An, Thanh Hoa, Ninh Binh, Ha Nam, Phu Tho, Da Nang, Nam Dinh, Lai Chau, Ben Tre, Ha Giang, Hoa Binh... Some Ministries and sectors have instructed subordinate units located in localities to implement Decision No. 20/1999/QD-BTC of the Ministry of Finance well such as the Prosecution Service, State Treasury...

However, some localities have implemented slowly such as Khanh Hoa, Hai Phong... and some Ministries and sectors with vertical systems have not urged subordinate agencies and units located in localities to carry out reporting and registration of headquarters.

To complete the task of reporting and registering, issuing certificates for management and use rights of houses and land belonging to headquarters for administrative and public service organizations, including the house and land assets of public service units, according to the guidance of the Ministry of Finance in Circular No. 5859 TC/QLCS dated June 12, 2002, the Ministry of Finance requests the Director of the Finance and Price Departments to pay attention and direct the implementation of the following matters:

1. For those localities where the People's Committees of provinces and cities have approved plans to implement the task of reporting and registering headquarters for administrative and public service organizations, it is necessary to closely coordinate with the Land Administration and Construction Departments to establish files for houses and land belonging to headquarters for agencies and units under the jurisdiction of administrative and public service organizations and issue certificates for management and use rights of headquarters for these agencies according to the classification of the Chairman of the People's Committee of provinces and centrally-administered cities and within the prescribed time limit.

2. For localities that have implemented slowly, the Finance and Price Departments need to report to the People's Committees of provinces and cities on the progress of implementing the task of reporting and registering, issuing certificates for management and use rights of headquarters for administrative and public service organizations in their localities and seek instructions from the People's Committees regarding cooperation between the Finance, Land Administration, Construction Departments as well as district-level People's Committees to guide and urge administrative and public service organizations to implement this task according to the guidance of the Ministry of Finance in Circular No. 5859 TC/QLCS dated June 12, 2002 on reporting and registering, issuing certificates for management and use rights of headquarters for administrative and public service organizations.

3. Prepare a report on the results of implementing the task of reporting and registering, issuing certificates for management and use rights of headquarters for administrative and public service organizations (attached model); clearly stating the advantages, difficulties, and obstacles encountered during the implementation process, the situation of reporting and registering headquarters for administrative and public service organizations managed by central authorities located in the locality, and the plan to implement this task in the subsequent period.

This report should be sent to the Ministry of Finance before November 30, 2002, for the State Asset Management Agency to compile a national report to the Prime Minister and promptly report to the Ministry's Competition Board about localities that have completed the task of reporting and registering, issuing certificates for management and use rights of headquarters for administrative and public service organizations located in their localities early.
