APPROVING THE URBAN SETTLEMENT PLAN FOR BORDER COMMUNITIES IN VIETNAM-LAO BORDER PROVINCES OF HA TINH, QUANG BINH, QUANG TRI, THUA THIEN-HUE, QUANG NAM AND KON TUM TO 2015

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decision No. 160/2007/QĐ-TTg dated October 17, 2007 of the Prime Minister approving the "Program for Socio-Economic Development of Border Villages between Vietnam and Laos and Vietnam and Cambodia until 2010";
Considering the proposal of the Minister of Agriculture and Rural Development at Circular No. 2233/TTr-BNN-KTHT dated July 29, 2009,

DECISION:

Article 1. Approves the Urban Settlement Plan for Border Communities in Vietnam-Lao Border Provinces of Ha Tinh, Quang Binh, Quang Tri, Thua Thien-Hue, Quang Nam and Kon Tum to 2015 with the main contents as follows:

1. Scope of Planning

The scope of planning includes 64 border villages of Vietnam-Lao located in 15 districts of Ha Tinh, Quang Binh, Quang Tri, Thua Thien-Hue, Quang Nam and Kon Tum provinces, including:

- Ha Tinh Province: 8 villages in 3 districts: Huong Son (3 villages), Vu Quang (1 village), Huong Ke (4 villages);

- Quang Binh Province: 9 villages in 5 districts: Minh Hoa (4 villages), Tuyen Hoa (1 village), Bo Trach (1 village), Quang Ninh (1 village), Le Thuy (2 villages);

- Quang Tri Province: 16 villages in 2 districts: Huong Hoa (11 villages), Dakrong (5 villages);

- Thua Thien-Hue Province: 12 villages in A Luoi district;

- Quang Nam Province: 12 villages in 2 districts: Nam Giang (4 villages), Tay Giang (8 villages);

- Kon Tum Province: 7 villages in 2 districts: Dak Glei (3 villages), Ngoc Hoi (4 villages).

Clause 2. Objectives

a) General Objective: By 2015, basically stabilize the population in border villages of Vietnam-Lao in Ha Tinh, Quang Binh, Quang Tri, Thua Thien-Hue, Quang Nam and Kon Tum provinces to effectively exploit potential resources, develop socio-economic conditions, eradicate poverty, improve and enhance material and spiritual living standards for ethnic communities, while firmly protecting border security.

b) Specific Objectives:

- Stabilize in place 16,260 households in poor categories within border villages; stabilize 9,609 households, including: integrate into existing hamlets and villages 3,756 households, relocate and resettle 5,853 households;

- Open up new land for agricultural production totaling 9,970 hectares, including 1,580 hectares of rice fields;

- Invest in building a comprehensive infrastructure system, including: roads, irrigation, electricity, clean water supply, and public facilities to ensure stable living conditions and productive development for residents in hamlets and villages;

- Regarding community life: strive to increase average income per capita by 1.5 times compared to 2009. Reduce the rate of poor households by 4-5% annually; the rate of households using clean water reaches 85%; the rate of households using electricity reaches 95%; 100% of communes have television broadcast coverage; 85% of hamlets and villages have communal houses; 100% of the population is cared for in terms of health and medical treatment.

3. Orientation for Urban Settlement Planning

a) Urban Settlement Planning along the Border Line:

- Stabilize in place 16,260 households with 81,300 people in the poor category;

- Stabilize 9,609 households, 43,564 individuals through integration with existing local communities or relocation to new communities, including: within the commune 4,987 households, outside the commune (from other places) 866 households:

- Establish 118 new communities in border villages.

b) Agricultural and Forestry Development and Rural Industries:

- Agricultural Production Arrangement: grain crops area: 17,300 hectares, rubber planting 6,000 hectares, coffee planting 3,100 hectares, pepper planting 300 hectares, fruit trees planting 2,551 hectares, other crops planting 3,308 hectares; livestock development: 23,768 cattle, 56,873 buffalo, 77,197 pigs, over 400,000 poultry;

- Forestry Production Development Arrangement: encircle and protect forests 42,105 hectares, plant new forests 18,255 hectares; forest cover ratio reaches 74%;

- Industrial Processing, Industry, and Services Development: encourage the development of blacksmithing, casting, weaving of traditional fabrics, wood carving; build border markets; construct international border gates; invest in restoring and renovating historical sites, scenic spots to develop tourism industry.

c) Infrastructure Investment Construction:

- Village and Hamlet Road System: build 812 kilometers of new roads, upgrade 442 kilometers;

- Irrigation System: build 161 irrigation works, 218 kilometers of canals, 6 kilometers of water pipes serving irrigation of 1,798 hectares;

- Community Infrastructure: build and upgrade 42,970 square meters of schools, 3,000 square meters of health clinics, 17,700 square meters of community cultural houses in hamlets and villages; 5,108 square meters of People's Committee offices; 17 border markets with an area of about 19,300 square meters; 3,200 clean water supply facilities; 221 TV relay stations, 24 radio relay clusters; 102 transformer stations and 834 kilometers of power transmission lines.² school, 3,000 m² health station, 17,700 m² community cultural house of village, commune; 5,108 m² People's Committee office of commune; 17 border markets with an area of approximately 19,300 m²; 3,200 water supply facilities; 221 television relay stations, 24 radio broadcasting clusters; 102 transformer substations and 834 km of power transmission lines.

4. Implementation Measures

a) Support Policies for Population Stabilization and Production Development:

Support policies for population stabilization and production development shall be implemented according to the provisions of the Prime Minister's Decisions: No. 160/2007/QĐ-TTg dated October 17, 2007 approving the "Program for Socio-Economic Development of Border Villages between Vietnam and Laos and Vietnam and Cambodia until 2010", No. 78/2008/QĐ-TTg dated June 10, 2008 on some support policies for implementing the Population Resettlement Program under Decision No. 193/2006/QĐ-TTg dated August 24, 2006 of the Prime Minister, and other current relevant policies.

b) Science and Technology:

- Supply crop and livestock seeds for production, prioritizing export-oriented varieties.

- Strengthen agricultural extension work, introduce advanced techniques into production, establish models: multiple cropping, specialty crop cultivation, animal husbandry, aquaculture; apply scientific and technological methods in food preservation.

- Strengthen quarantine work for animals and plants.

c) Market and Product Consumption:

- Develop the economy at border gates and border markets, creating favorable conditions for people to exchange goods;

- Border trade cooperation, activities of exchanging goods and buying and selling with the Lao People's Democratic Republic and other countries in the region;

- Implement mechanisms and policies for mountainous, island, and ethnic minority areas' commercial development according to current regulations consistent with market economic mechanisms and international commitments.

d) Training cadres, developing human resources, and enhancing the literacy level of the population: organizing training courses for village cadres to guide ethnic groups in developing production activities; striving to achieve a vocational training rate for rural households of 40% by 2015.

đ) National defense and security:

- Building a people's national defense posture, forming a strong front and people's security along the entire border line;

- Propaganda and education to encourage border residents to participate in managing the border;

- Mastering the border area, combating activities that infringe upon national security;

- Establishing a national defense economic zone along the border, developing national defense economy.

e) Investment capital and sources of investment capital:

- The total investment amount is approximately 3.518 billion VND;

- Sources of investment capital: investment capital integrated from existing programs and projects on the local territory; targeted support funds from the central budget for investing in projects to stabilize the population in border communes between Vietnam and Laos, totaling 1.748 billion VND (accounting for 49.7% of the total investment capital demand).

Article 2. Implementation

To take the lead and coordinate with the Ministry of Finance and relevant ministries and sectors to urge, inspect, supervise, and resolve issues arising during the implementation of this Decree.

a) Taking the lead and coordinating with relevant ministries and sectors to guide the People's Committees of border provinces between Vietnam and Laos:

- Developing plans for stabilizing the population in border communes of each province, establishing investment projects to submit for approval by competent authorities;

- Formulating five-year and annual plans for stabilizing the population to compile and submit to the Prime Minister for approval;

- Establishing models for stabilizing the population in border communes to draw lessons before implementing them on a wider scale.

b) Taking the lead and coordinating with relevant ministries and sectors and the People's Committees of the provinces to review, adjust, and supplement planning when necessary;

c) Coordinating with the Ministry of Finance to study and adjust policies for stabilizing the population in border communes, submitting them to the Prime Minister for approval;

d) Inspecting, supervising, and evaluating the results of implementing population stabilization in local areas.

2. The Ministry of Planning and Investment: taking the lead and coordinating with the Ministry of Finance to balance and allocate annual capital for the provinces and participating ministries and sectors based on consensus with the Ministry of Agriculture and Rural Development.

3. Ministry of Finance:

a) Coordinating with the Ministry of Planning and Investment to allocate annual capital for localities and participating ministries and sectors for implementation of the projects under the Plan;

b) Guiding mechanisms for management, allocation, settlement, and final accounting of investment capital for projects under the Plan.

4. The Ministry of National Defense: directing subordinate units to assist in guiding and helping ethnic groups in production and stabilizing their lives; implementing the construction of national defense economic zones and ensuring national defense and security in border areas.

5. Relevant ministries and sectors: based on assigned functions and tasks, formulating plans to coordinate with the People's Committees of the provinces to implement the contents of this Plan effectively.

6. The People's Committees of Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Quang Nam, and Kon Tum Provinces:

a) Directing and organizing the establishment, examination, and approval of the Plan for stabilizing the population in border communes of the province and investment projects according to regulations;

b) Preparing annual and phase budgets (2009-2015) for targeted support funds from the central budget to implement projects for stabilizing the population in border communes between Vietnam and Laos, sending them to the Ministries of Agriculture and Rural Development, Planning and Investment, and Finance for consolidation and submission to the Prime Minister for approval;

c) Implementing the integration of capital from other programs and projects within the territory with projects for stabilizing the population in border communes between Vietnam and Laos;

d) Directing departments, agencies, and all levels of government to closely cooperate with mass organizations in propaganda and mobilization to encourage the public to actively participate in implementing the Plan for stabilizing the population in border communes between Vietnam and Laos, and strengthening supervision and inspection of project implementation on the local territory to ensure investment effectiveness.

Article 3. This Decision shall take effect from the date of signing.

Article 4. Ministers, heads of ministerial-level agencies, heads of governmental agencies, and Chairmen of the People's Committees of Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Quang Nam, and Kon Tum Provinces are responsible for enforcing this Decision.
