Issuing regulations on technical procedures for inspecting objects subject to plant quarantine and procedures for preparing plant quarantine records

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to the Ordinance on Plant Protection and Quarantine promulgated on February 15, 1993, and Decree No. 92/CP dated November 27, 1993 of the Government on the Regulations on Plant Quarantine;
Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government stipulating the functions, tasks, and organizational structure of the Ministry of Agriculture and Rural Development;
At the proposal of the Director of the Plant Protection Department.
DECISION:
Article 1. Attached to this Decision are "Regulations on Technical Procedures for Inspecting Objects Subject to Plant Quarantine and Procedures for Preparing Plant Quarantine Records".
Article 2. This Decision shall take effect fifteen days from the date of signature. This Decision replaces Decision No. 91/1998/QĐ/BNN-BVTV dated July 2, 1998 and Decision No. 106/1999/QĐ/BNN-BVTV dated July 26, 1999 of the Minister of Agriculture and Rural Development.
Article 3. The Heads of the Ministry's Office, the Director of the Plant Protection Department, and the Heads of related agencies are responsible for implementing this Decision.

REGULATIONS
TECHNICAL PROCEDURES FOR INSPECTING OBJECTS SUBJECT TO PLANT QUARANTINE AND PROCEDURES FOR PREPARING PLANT QUARANTINE RECORDS
(Attached to Decision No. 118/2000/QĐ-BNN-BVTV dated November 20, 2000 of the Ministry of Agriculture and Rural Development)
Article 1. Technical procedures for inspecting objects subject to plant quarantine shall be uniformly applied according to TCVN 4731-89, concerning "Plant Quarantine, Sampling Methods".
Article 2. The Plant Protection Department shall detail technical procedures for inspecting objects subject to plant quarantine for various modes of transport, packaging, storage, and specific groups of objects subject to plant quarantine; it shall also specify inspection procedures for each type of harmful organism within each group of objects and investigation procedures for harmful organisms on each type of plant.
Article 3. The plant quarantine business record includes:
1. Application for a permit for importing plant seeds (Form 1).
2. Permit for importing plant seeds (Form 2).
3. Declaration for plant quarantine (Form 3).
4. Inspection report for plant quarantine on means of transport (vessels, aircraft, trains, automobiles, etc.) (Form 4).
5. Report on plant quarantine and sampling (Form 5).
6. Report on investigating harmful organisms in plant resources (Form 6).
7. Temporary certificate of plant quarantine results (Form 7).
8. Certificate of plant quarantine results (Form 8).
9. Certificate of plant quarantine (Form 9).
10. Certificate of imported plant quarantine, transit, and domestic transportation (Form 10).
11. Record of violation of the Ordinance on Plant Protection and Quarantine (Form 11).
12. Decision on penalty for violating the Ordinance on Plant Protection and Quarantine (Form 12).
13. Declaration for plant quarantine of plant products (Form 13).
14. Order to detain and process imported plant products (Form 14).
15. Supervision report on processing objects subject to plant quarantine (Form 15).
16. Notification on plant quarantine (Form 16).
Article 4. These regulations apply to organizations and individuals involved in plant quarantine activities within the territory of Vietnam.
