Pursuant to the Ordinance on Preferential Treatment for Persons Engaged in Revolutionary Activities, Martyrs and Their Families, War Invalids, and Persons Who Have Rendered Meritorious Service to the Revolution dated August 29, 1994, and Decree No. 28/CP dated April 29, 1995 of the Government detailing and guiding the implementation of the Ordinance;
At the proposal of the Minister of Construction, the Minister of Labor, Invalids and Social Affairs, the Minister of Finance, and the Director General of the Land Administration Bureau,
DECISION:
Article 1.
1. Persons who have rendered meritorious service to the revolution as stipulated in Article 1 of the Ordinance on Preferential Treatment for Persons Engaged in Revolutionary Activities, Martyrs and Their Families, War Invalids, and Persons Who Have Rendered Meritorious Service to the Revolution include:
- Persons engaged in revolutionary activities prior to the August 1945 Revolution;
- Families of martyrs;
- National Heroic Forces, Mothers of Vietnam's Heroes, National Labor Heroes;
- War invalids, veterans, and persons receiving benefits equivalent to war invalids;
- Persons engaged in revolutionary activities or anti-French resistance activities who were captured and imprisoned by the enemy;
- Persons engaged in national liberation, national defense, and international duty;
- Persons who have rendered meritorious service to the revolution.
Persons who have rendered meritorious service to the revolution and are facing difficulties with housing shall be supported to improve their housing conditions.
2. The support for persons who have rendered meritorious service to the revolution to improve their housing conditions must ensure the following principles:
- In accordance with the economic and social situation of the country;
- Based on the merit and specific circumstances of each individual, and the conditions and capabilities of the locality;
- Not providing support uniformly or equally to all categories.
3. Supporting persons who have rendered meritorious service to the revolution to improve their housing conditions is the responsibility of the entire society. Therefore, apart from the state budget, funding for supporting persons who have rendered meritorious service to the revolution to improve their housing conditions will also be raised from contributions of organizations, individuals, and other sources.
Article 2.
1. Depending on the conditions and capabilities of the locality, the support for persons who have rendered meritorious service to the revolution to improve their housing conditions may apply one of the following forms:
- Presenting houses of goodwill;
- Providing financial assistance for building or repairing houses;
- Providing full or partial land use fees when purchasing state-owned houses or when allocating land for residential purposes;
- Other forms of support.
2. Conditions and levels of support.
a) Persons who have rendered meritorious service to the revolution with particularly difficult circumstances unable to establish housing and have not been rented state-owned housing or lost their houses due to natural disasters, fires... shall be considered for the award of "Houses of Goodwill," allocation of land for residential purposes, or purchase of houses on installment basis depending on the conditions of the locality, circumstances, and merit of each individual.
b) Persons who have rendered meritorious service to the revolution who already own houses but the houses are extremely dilapidated, cramped, and do not meet the average living conditions compared to the community where they reside and cannot afford to repair them shall be supported to renovate and repair their houses depending on their circumstances and the capability of the locality.
c) If persons who have rendered meritorious service to the revolution purchase state-owned houses, they:
Shall be provided with full land use fees for multi-story houses shared by multiple households.
Shall be provided with full or partial land use fees for single-story houses and multi-story houses occupied by a single household, according to the following specific levels:
- Persons engaged in revolutionary activities prior to the August 1945 Revolution; National Heroic Forces, Mothers of Vietnam's Heroes, National Labor Heroes; war invalids, disabled veterans, persons receiving benefits equivalent to war invalids with a disability rate of 81% or higher; dependents of martyrs receiving monthly maintenance allowances shall be provided with full land use fees.
- War invalids and persons receiving benefits equivalent to war invalids with a disability rate of 61% to 80% shall be provided with 90% of the land use fees.
- War invalids and persons receiving benefits equivalent to war invalids with a disability rate of 41% to 60% shall be provided with 80% of the land use fees.
- Dependents of martyrs, persons who have rendered meritorious service to the revolution receiving monthly subsidies, war invalids, and persons receiving benefits equivalent to war invalids with a disability rate of 21% to 40% shall be provided with 70% of the land use fees.
- Persons engaged in revolutionary activities, anti-French resistance activities who were captured and imprisoned by the enemy, persons engaged in national liberation, national defense, and international duty awarded the First-Class Resistance Medal or the First-Class Victory Medal shall be provided with 65% of the land use fees.
3. The levels of support for land use fees specified in Clause c Point 2 Article 2 of this Decision shall also apply to cases supported through the form of allocating land for residential purposes.
4. The support for land use fees for persons who have rendered meritorious service to the revolution shall only be considered once for a household, and the level of support for land use fees shall be calculated based on the actual area of land allocated but shall not exceed the maximum standard for residential land for a household as prescribed by the People's Committee of the province or centrally-administered city.
The land use fee shall be calculated based on the land price list issued by the People's Committee of the province or centrally-administered city pursuant to Decree No. 87/CP dated August 17, 1994 of the Government.
5. In cases where a person falls under multiple preferential categories and is eligible for support to improve their housing conditions, the highest preferential treatment that the person enjoys shall be the basis for support.
6. In a household where multiple members fall under preferential categories for housing, if they are eligible for support to improve their housing conditions, the preferential treatments of each individual shall be combined into the preferential treatment of the entire household, but the maximum level of support shall not exceed the highest preferential level prescribed in this Decision.
7. The provisions above apply to persons who have rendered meritorious service to the revolution as stipulated in Point 1, Article 1 of this Decision. In cases where a person who has rendered meritorious service to the revolution has passed away and their main dependents (father, mother, spouse, children, or direct caregivers) are truly facing difficulties with housing, the locality shall consider supporting them to improve their housing conditions according to the current policy.
8. The consideration for supporting persons who have rendered meritorious service to the revolution to improve their housing conditions must be based on recommendations from the People's Committee of the commune, ward, or town where the person resides, and these recommendations must be verified by the People's Committee of the district, county, or provincial city before being submitted to the People's Committee of the province or centrally-administered city for decision.
Article 3.
1. Annually, localities must organize statistics to grasp the housing situation of those who have rendered meritorious service to the Revolution, classify according to the actual condition of housing and economic circumstances of each individual to provide appropriate forms of support.
2. Based on the actual land and housing conditions, localities need to carry out the establishment of housing development projects to contribute to creating conditions for those who have rendered meritorious service to the Revolution to improve their housing.
3. The Chairman of the People's Committee of provinces and centrally governed cities shall be responsible for directing all levels, sectors, socio-economic organizations, people's armed units, and all individuals to participate in the movement to build "Compassionate Houses" from contributions of organizations and individuals, contributing together with the State to support those who have rendered meritorious service to the Revolution, especially those in particularly difficult circumstances, to have fixed places of residence.
Article 4. This Decision takes effect from January 1, 1995.
Article 5. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and municipal People's Committees directly under the Central Government are responsible for implementing this Decision.
