REGARDING THE CORRECTION OF CIRCULAR NO. 184/2009/TT-BTC DATED SEPTEMBER 15, 2009 OF THE MINISTRY OF FINANCE ON REGULATIONS FOR THE COLLECTION, PAYMENT AND MANAGEMENT OF USE OF FEES FOR GRANTING LICENSES FOR MINERAL ACTIVITY OPERATIONS AND EXCLUSIVE PROSPECTING FEES FOR MINERALS
THE MINISTER OF FINANCE
Pursuant to the Law on Legislative Issuance of Regulatory Legal Documents No. 17/2008/QH12 dated June 3, 2008;
Pursuant to Decree No. 104/2008/ND-CP dated November 27, 2008 of the Government on the Official Gazette of the Socialist Republic of Vietnam;
Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Policy Department;
DECISION:
Article 1. Correcting the Table of Fee Levels for Granting Licenses for Mineral Extraction Operations issued together with Circular No. 184/2009/TT-BTC dated September 15, 2009 of the Ministry of Finance on Regulations for the Collection, Payment and Management of Use of Fees for Granting Licenses for Mineral Activity Operations and Exclusive Prospecting Fees for Minerals as follows:
1. In Point 2.2, under the Column of Groups of Mineral Extraction Activities of the Table of Fee Levels for Granting Licenses for Mineral Extraction Operations issued together with Circular No. 184/2009/TT-BTC dated September 15, 2009, it was printed:
"License for extracting common construction materials minerals, mud coal except minerals specified in Item 1 and Point 2.1"
Now it is corrected to read:
"License for extracting common construction materials minerals with an area of 10 hectares or more and extraction volume less than 100,000 m3/year or type of activity for extracting common construction materials minerals with an area less than 10 hectares and extraction volume of 100,000 m3/year or more, mud coal except activities for extracting sand and gravel from riverbeds specified in Item 1 of this Table of Fee Levels."
2. In Point 3, under the Column of Groups of Mineral Extraction Activities of the Table of Fee Levels for Granting Licenses for Mineral Extraction Operations issued together with Circular No. 184/2009/TT-BTC dated September 15, 2009, it was printed:
"Activities for extracting minerals as raw materials for cement; common construction materials minerals without using industrial explosives; except activities specified in Points 1 and 2 of this Table of Fee Levels"
Now it is corrected to read:
"Activities for extracting minerals as raw materials for cement; common construction materials minerals with an area of 10 hectares or more and extraction volume of 100,000 m3/year or more without using industrial explosives, except activities for extracting sand and gravel from riverbeds specified in Item 1 of this Table of Fee Levels"
Article 2. This Decision shall take effect at the same time as Circular No. 184/2009/TT-BTC dated September 15, 2009 of the Ministry of Finance and is an integral part of Circular No. 184/2009/TT-BTC.
