Regarding the division of work between the Prime Minister and Deputy Prime Ministers. 

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Operational Regulations of the Government issued together with Decree No. 11/1998/NĐ-CP dated January 24, 1998,

DECISION:

Article 1. The main principles regarding the division of work between the Prime Minister and Deputy Prime Ministers:

1. Deputy Prime Ministers assist the Prime Minister in directing specific areas of government work as assigned by the Prime Minister, using the authority of the Prime Minister to resolve matters within their assigned area.

2. Within the scope of their authority and assigned tasks, Deputy Prime Ministers take the initiative to resolve matters. If issues arise that relate to the areas overseen by another Deputy Prime Minister, they actively coordinate with each other to resolve them. In cases where Deputy Prime Ministers cannot reach agreement, the Deputy Prime Minister currently overseeing the matter reports to the Prime Minister for a decision.

3. Deputy Prime Ministers are responsible to the Prime Minister for decisions related to the implementation of tasks assigned by the Prime Minister.

4. Weekly meetings are held between the Prime Minister and Deputy Prime Ministers to provide information and address matters that the Prime Minister deems necessary for collective discussion.

5. Depending on the situation and work requirements, the division of work between the Prime Minister and Deputy Prime Ministers (as stipulated in Article 3 of this Decision) may be changed at the discretion of the Prime Minister.

Article 2. Within the scope of their assigned areas, Deputy Prime Ministers have responsibilities and authorities:

1. To direct Ministries, agencies equivalent to Ministries, and governmental agencies in developing strategies, plans, and policies for economic and social development; mechanisms and policies; draft laws, ordinances, and regulatory documents of the Government and the Prime Minister.

2. To inspect and urge Ministries, agencies equivalent to Ministries, and governmental agencies, People's Councils, and Provincial People's Committees in implementing policies and laws within their jurisdiction, identifying and proposing amendments and supplements. If violations of national laws, regulations, and directives are discovered, they suspend the implementation of such documents and instruct on their revision.

3. To resolve specific issues within the Prime Minister's authority, inter-ministerial issues that ministers cannot agree upon; report to the Prime Minister for handling policy issues not yet regulated by the Government; refrain from addressing issues within the authority of a Minister.

4. To oversee personnel organization work and direct the resolution of internal issues within agencies assigned by the Prime Minister.

5. Due to the nature of the Government's operational management, the Prime Minister assigns a Permanent Deputy Prime Minister to represent and perform the duties of the Prime Minister when the Prime Minister is absent from the Government headquarters.

Article 3. Division of Work:

1. The Prime Minister leads and manages all aspects of the Government's activities and work, including members of the Government, heads of governmental agencies, Chairpersons of People's Councils, and Provincial People's Committees.

a. Directly oversees the following areas of work:

- Comprehensive economy, including: Strategies and planning for important industries, regions, and sectors; long-term and annual socio-economic development plans; major investment projects; finance, prices, currency, banking, securities, statistics, auditing, national reserves, foreign borrowing and repayment;

- Administrative reform; institutional building, specifically implementing Party Resolutions, Laws, Ordinances on organizational structures and cadres; domestic non-governmental organizations; commendation and disciplinary work; rules and working procedures of the Government;

- National defense and security; significant, urgent, and sensitive issues in economic, cultural, social, and foreign affairs; special and critical measures for leadership and management during specific periods;

- Coordination relations between the Government and the National Assembly, Supreme People's Court, Supreme People's Procuracy, Central Committee of the Vietnam Fatherland Front, and people's organizations.

b. Supervises and directs relevant agencies: Ministry of Planning and Investment, Ministry of Finance, Ministry of Justice, Ministry of Home Affairs, State Bank of Vietnam, and other governmental agencies.

2. Deputy Prime Minister Nguyen Tan Dung serves as the Permanent Deputy Prime Minister, leading and coordinating the overall activities of the Government when the Prime Minister is absent or authorized by the Prime Minister.

a. Directly oversees the following areas of work:

+ Industry;

+ Postal services, telecommunications, and information technology; agriculture, forestry, fisheries, water resources, meteorology and hydrology; industrialization of agriculture and rural areas, village craft development, cooperative economy;

+ Product consumption (both domestic market and export-import according to specific industries);

+ Construction, architecture, urban development; transportation;

+ Reform and development of state-owned enterprises; Group 91 companies;

+ Development of enterprises under various economic components;

+ Natural resources and environment;

+ Inspection, examination, anti-corruption, crime prevention;

+ Search and rescue; flood and storm prevention;

+ Policy reform on salaries;

+ National defense and security work as assigned by the Politburo and the Prime Minister.

b. Supervises and directs relevant agencies: Ministry of Construction, Ministry of Industry, Ministry of Posts and Telecommunications, Ministry of Transport, Ministry of Agriculture and Rural Development, Ministry of Fisheries, Ministry of Natural Resources and Environment, Ministry of Defense, Ministry of Public Security, State Audit Office, Government Office, and other governmental agencies.

3. Deputy Prime Minister Vu Khoan:

a. Directly oversees the following areas of work:

+ Foreign affairs and international relations;

+ Economic cooperation and integration;

+ Foreign economic relations, including: foreign direct investment (general policies and mechanisms), official development assistance (ODA) and non-governmental aid, relations with international economic organizations, non-governmental organizations, regional economic organizations, negotiations for joining the World Trade Organization (WTO);

+ General trade policy mechanisms: domestic market and import-export activities;

+ Combating smuggling and commercial fraud, market management, protecting consumer rights;

+ Tourism work;

+ Border affairs;

+ East Sea - Islands, including both marine economy and island economy;

+ Human rights issues;

+ Ethnic and religious affairs;

+ Other related tasks;

b- Coordination of work between the Government and the Secretariat of the Central Committee of the Communist Party; monitoring and directing relevant agencies: Ministry of Foreign Affairs, Ministry of Commerce, Commission for Ethnic Minorities, and other government agencies within their respective areas of responsibility;

4. Deputy Prime Minister Phạm Gia Khiêm:

a- Directly overseeing the following areas of work:

+ Science and technology;

+ Education and training;

+ Culture, arts; information, press, radio, television;

+ Health, physical education and sports;

+ Labor and social issues; labor export;

+ Poverty reduction;

+ Population, family and children.

b- Monitoring and directing relevant agencies: Ministry of Science and Technology, Ministry of Education and Training, Ministry of Labor, Invalids and Social Affairs, Ministry of Culture, Sports and Tourism, Ministry of Health, National Population Family Planning Commission, National Physical Education and Sports Commission, and other government agencies within their respective areas of responsibility;

Article 4. This Decision takes effect from the date of issuance.

Members of the Government, heads of government agencies, Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decision.
