Decision No. 119/2008/QD-BTC On the regulation of toll collection rates, collection, payment, management, and use of road usage fees at the Phan River Toll Station on National Highway 1A in Binh Thuan Province

Pursuant to Decree No. 57/2002/ND-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;

Pursuant to Decree No. 24/2006/ND-CP dated March 6, 2006 of the Government amending and supplementing certain articles of Decree No. 57/2002/ND-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;

Pursuant to Decree No. 77/2003/ND-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

After receiving the opinion of the Ministry of Transport at Circular No. 8812/BGTVT-TC dated December 2, 2008 regarding the location of the toll station for the BOT project to construct the new Dong Nai Bridge;

At the proposal of the Director of the Policy Department;

Article 1. Issuing with this Decision the Toll Rate Table for the toll station on the Phan River, National Highway 1A, Binh Thuan Province.

Article 2. The subjects subject to the toll for using the road at the toll station on the Phan River, National Highway 1A, Binh Thuan Province shall be implemented according to the provisions in Section III, Part I of Circular No. 90/2004/TT-BTC dated September 7, 2004 of the Ministry of Finance guiding the collection, payment, management, and use of road usage fees (hereinafter referred to as Circular No. 90/2004/TT-BTC).

Article 3. The toll for using the road at the toll station on the Phan River, National Highway 1A, Binh Thuan Province shall be collected, paid, managed, and used according to the regulations applicable to roads invested for business purposes as detailed in Section IV, Part II of Circular No. 90/2004/TT-BTC.

Article 4. The Dong Nai Bridge Investment and Construction Joint Stock Company is responsible for organizing ticket sales points at the toll station to facilitate traffic controllers and avoid traffic congestion; selling tickets promptly and fully according to the requirements of buyers without limiting the target group or quantity sold; implementing registration, declaration, collection, payment, and use of toll revenue receipts in accordance with the provisions in Part III of Circular No. 90/2004/TT-BTC.

Article 5. This Decision takes effect 15 days after its publication in the Official Gazette and will apply for toll collection from January 1, 2009.

Article 6. Organizations and individuals subject to payment, units assigned by the Ministry of Transport to organize the collection of tolls for using the road at the toll station on the Phan River, National Highway 1A, Binh Thuan Province, and related agencies are responsible for implementing this Decision./.
