JOINT CIRCULAR

Regulations on the preparation of budgets, management, use, and settlement of funds to ensure activities for popularizing, educating about laws, standardizing access to laws, and grassroots mediation

Pursuant to the State Budget Law and guiding documents;

Pursuant to Decree No. 12/2011/NĐ-CP dated January 30, 2011 of the Government on organization and policies for youth volunteers;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating functions, tasks, authorities, and structure of the Ministry of Finance;

Pursuant to Decree No. 61/2012/NĐ-CP dated August 10, 2012 of the Government stipulating functions, tasks, authorities, and structure of the Ministry of Home Affairs;

The Minister of Finance and the Minister of Home Affairs issue this Joint Circular guiding the preparation of budgets, management, use, and settlement of expenses for implementing policies for youth volunteers as follows:

Article 1. Scope and Applicability

Article 1. Scope of Application:

This Joint Circular stipulates the preparation of budgets, management, use, and settlement of annual operating funds provided by the state budget to implement policies for youth volunteers as prescribed in Article 19 of Decree No. 12/2011/NĐ-CP dated January 30, 2011 of the Government on organization and policies for youth volunteers.

a) Youth Volunteer Force Command.

b) Youth Volunteer Corps.

c) Centers and Schools of Social Labor Education for Youth Volunteers.

Article 2. Principles for allocating operating funds from the state budget for youth volunteer organizations

1. Operating funds for the Youth Volunteer Force Commands at all levels shall be guaranteed by the state budget according to the current budget decentralization based on the staffing assigned annually by the competent authority, administrative management cost allocation standards, and other expenditures as prescribed; these funds shall be allocated in the annual state budget expenditure plan of the Communist Youth Union Ho Chi Minh at the same level.

2. The state shall support operating funds for Youth Volunteer Corps, Centers, and Schools of Social Labor Education for Youth Volunteers according to the current regulations applicable to public service units. The portion of funds supported by the state budget (if any) shall be allocated in the annual state budget expenditure plan of the Communist Youth Union Ho Chi Minh at the same level.

3. Ensuring funds for the Youth Volunteer Force Commands at provincial level and supporting funds for Youth Volunteer Corps, Centers, and Schools of Social Labor Education for Youth Volunteers established before the effective date of Decree No. 12/2011/NĐ-CP dated January 30, 2011 of the Government shall be decided by the Chairman of the People's Committee of the province or centrally governed city according to the expenditure items and amounts specified in this Circular.

Article 3. Expenditure Items of Youth Volunteer Organizations

1. Expenditure items for Youth Volunteer Force Commands at all levels:

a) Salaries, allowances, and contributions for the Commanding Officer, Deputy Commanding Officers, and non-simultaneous duty staff members as stipulated in the decision regarding the organizational and operational regulations of the Youth Volunteer Force Command issued by the Communist Youth Union Ho Chi Minh at the same level.

b) Hiring labor costs (if any).

c) Costs for organizing mid-year and year-end meetings; travel expenses; public service payment costs; office supply purchase costs; information, propaganda, and communication costs; rental costs for organizational activities.

d) Training and capacity building costs for staff managing youth volunteers at all levels of Youth Volunteer Force Commands.

đ) Reward costs for staff managing youth volunteers and team members who have outstanding achievements in completing assigned tasks as stipulated by the Central Communist Youth Union Ho Chi Minh.

e) Uniform costs for the Commanding Officer, Deputy Commanding Officers, and staff members as stipulated in the decision regarding the organizational and operational regulations of the Youth Volunteer Force Command issued by the Communist Youth Union Ho Chi Minh at the same level according to the authorized level.

g) Costs for issuing membership cards for youth volunteers, certificates of completion of youth volunteer tasks, and commemorative medals for youth volunteers and staff managing youth volunteers under the same level of youth volunteer force as stipulated by the Central Communist Youth Union Ho Chi Minh.

h) One-time allowance and transportation costs for staff managing youth volunteers working in areas with extremely difficult socio-economic conditions after completing their tasks and returning to their localities.

i) Costs for purchasing and regular maintenance of assets.

k) Other costs as prescribed.

2. Expenditure items for Youth Volunteer Organizations that are Youth Volunteer Corps or Centers and Schools of Social Labor Education:

a) Salaries, allowances, and contributions for the assigned staff members.

b) Labor costs and living expenses (if any) for youth volunteers.

c) Travel expenses; public service payment costs; office supply purchase costs; information, propaganda, and communication costs; rental costs for organizational activities.

d) Costs for organizing mid-year and year-end meetings annually or according to programs and projects.

đ) Training and capacity building costs for improving skills for the staff managing youth volunteers.

e) Reward costs for staff managing youth volunteers and team members who have outstanding achievements in performing tasks and other notable achievements.

g) Uniform costs for managers and team members as stipulated by the Central Communist Youth Union Ho Chi Minh.

h) Costs for training new team members.

i) Costs for issuing membership cards for youth volunteers and certificates of completion of youth volunteer tasks for team members and staff managing youth volunteers as stipulated by the Central Communist Youth Union Ho Chi Minh.

k) To provide a one-time allowance and travel expenses for transportation when completing tasks and returning to their localities for management cadres and members of voluntary youth teams working in areas with particularly difficult socio-economic conditions.

l) To pay for public services; to purchase office supplies; to cover information, propaganda, and communication costs.

m) To purchase and regularly repair assets.

n) Other expenditures as prescribed.

Article 4. Levels of expenditure

1. The above-mentioned expenditure items shall be implemented at the current expenditure levels for funds allocated from the state budget. Depending on the financial capacity of each locality, the Chairman of the People's Committee of provinces and centrally governed cities shall report to the People's Council to decide on support policies for voluntary youth organizations, management cadres, and members of voluntary youth teams within their jurisdictions in accordance with actual circumstances.

2. This Circular specifies certain expenditure levels as follows:

a) Regarding wages, living allowances, and subsidies for members of voluntary youth teams:

- Members of voluntary youth teams shall enjoy wages and social insurance, health insurance, and unemployment insurance benefits according to current laws, which are reflected in their labor contracts. The wage level shall be determined based on the actual labor wage rate in the locality, as stipulated by the Department of Labor - War Invalids and Social Affairs in coordination with the Department of Finance and submitted for approval by the provincial People's Committee;

- For members of voluntary youth teams performing tasks in areas with particularly difficult socio-economic conditions as provided for in Clause 2, Article 1 of Decree No. 116/2010/NĐ-CP dated December 24, 2010 of the Government, in addition to the provisions set forth in Article 16 of Decree No. 12/2011/NĐ-CP dated January 30, 2011 of the Government regarding the organization and policies for voluntary youth teams, they shall also enjoy the following benefits:

+ They shall receive a living allowance for the first six months from the date of joining the voluntary youth team. Each month of work entitles them to a living allowance equivalent to one times the minimum wage as prescribed by law;

+ After completing their tasks at the voluntary youth unit, if members of voluntary youth teams return to their localities, they shall be provided with travel expenses for transportation, including: transportation fees (excluding air transport) of organizations and individuals operating passenger transport services as prescribed by law, comprising: transportation fees from the voluntary youth unit to railway stations or bus terminals; tickets for train or bus transport to their place of residence;

Payment amount: According to the price marked on the ticket or receipt for purchasing the ticket (the ticket price does not include other service charges such as sightseeing tours or special services upon request). In cases where members of voluntary youth teams use air transport with valid tickets, the maximum payment will be made according to the fare for public passenger transport by road, rail, or waterway suitable for the route from the voluntary youth unit to their place of residence.

For sections of the journey without passenger transport vehicles of organizations and individuals operating passenger transport services as prescribed by law, if members of voluntary youth teams have to hire other transport vehicles, the head of the agency or unit shall consider and decide to reimburse the hired vehicle rental fees based on the rental contract or payment receipt issued by the vehicle owner, according to the actual kilometers traveled and the fixed rate specified in the internal expenditure regulations of the agency or unit.

If members of voluntary youth teams use their own personal means of transportation, they shall be reimbursed for self-provided transportation expenses based on the actual kilometers traveled, corresponding to the common transportation rates of public vehicles in the locality but not exceeding the self-provided transportation expense allowance when traveling on official business and must be stipulated in the internal expenditure regulations of the agency or unit;

+ After completing their tasks at the voluntary youth unit, members of voluntary youth teams shall receive a one-time allowance equivalent to one month's wage or salary for each year worked in the voluntary youth organization. If less than one year (12 months), if the working period is from one month to six months, they shall receive half a month's wage, and if the working period exceeds six months, they shall be considered as one month's wage.

The payment of the one-time allowance and travel expenses for returning to their localities mentioned above shall be carried out before management cadres and members of voluntary youth teams return to their localities.

b) Regarding salaries, allowances, living allowances, and subsidies for management cadres of voluntary youth teams:

- They shall enjoy the general salary system as prescribed by law applicable to cadres, civil servants, and public officials;

- Management cadres working in areas with particularly difficult socio-economic conditions as provided for in Clause 2, Article 1 of Decree No. 116/2010/NĐ-CP dated December 24, 2010 of the Government, shall enjoy living allowances and subsidies similar to those for members of voluntary youth teams performing tasks in areas with particularly difficult socio-economic conditions as stipulated in point a, clause 2 of this article.

c) Regarding uniform standards for members of voluntary youth teams and management cadres of voluntary youth teams: To be implemented according to the regulations of the competent authority.

Article 5. Budget preparation, management, and settlement of funds:

The preparation of budgets, management, and settlement of funds for policies concerning volunteer organizations shall be carried out in accordance with the State Budget Law and guiding documents.

Article 6. Effectiveness

1. This Circular takes effect from October 15, 2013.

2. During the implementation of this Joint Circular, if there are any difficulties, agencies and units are requested to report to the Ministry of Finance and the Ministry of Home Affairs for study, amendment, and supplementation as necessary./.
