 THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Now amending and supplementing some articles of the Registration and Certification Regulation for high-quality and reputable trade Vietnamese agricultural and forestry products issued together with Decision No. 3699/QD-BNN-CB dated December 29, 2005 of the Minister of Agriculture and Rural Development as follows:

- Clause 2, Article 2: The scope of application is supplemented and amended as follows:

DECISION:

Article 1. Agricultural and forestry products are goods produced by the agricultural sector, including fresh, processed, preserved, and manufactured products, salted products, animal feed, excluding handicraft products, plant and animal breeding materials, and agricultural supplies (fertilizers, plant protection chemicals, veterinary drugs).

- Clause 1, 2, 3, Article 6: The registration procedures are supplemented and amended as follows:

1. Annually, at least 60 days before the evaluation date, the Ministry of Agriculture and Rural Development shall widely announce the plan, time, contribution amount, and organization form of certification for high-quality and reputable trade Vietnamese agricultural and forestry products.

2. Organizations and individuals prepare one set of registration files according to Article 7 of this Regulation and send them to the grassroots Evaluation Council (Department of Agriculture and Rural Development under the locality where the organization or individual operates or the industry association of the registered product). The choice of the preliminary evaluation council belongs to the registering organization or individual.

3. The grassroots Evaluation Council organizes the preliminary evaluation, sends the report and successful files to the Permanent Secretariat of the Ministry-level Evaluation Council located at the Department of Processing and Salt Industry, Ministry of Agriculture and Rural Development.

- Clause 5, Article 7: The registration file is supplemented as follows:

A description explaining the quality of the product and the applied standards, along with the standard announcement file of the organization or individual and the confirmation file from the competent authority.

- Clause 1, Article 8: The contribution and use of registration fees are amended and supplemented as follows:

Organizations and individuals submit the registration fee for certification together with the registration file to the grassroots Evaluation Council and it will not be refunded.

- Clause 5, Article 9: The evaluation criteria are supplemented as follows:

The registration file of enterprises must have written confirmation from the competent authority for criteria 1, 2, and 3, while criterion 4 requires confirmation from large-scale product consumers.

- Clause 2, Article 10: The Evaluation Council is amended and supplemented as follows:

The Director of the Department of Agriculture and Rural Development and the Chairman of the Association decide to establish the grassroots Evaluation Council (preliminary evaluation council) consisting of five to seven people, including one Chairperson, one Deputy Chairperson, two opposing members, and one Secretary. Both preliminary evaluation councils have the same functions, duties, and powers.

- Clause 2, Article 11: Receiving and processing files are amended and supplemented as follows:

The Permanent Secretariat of the Ministry-level Evaluation Council receives the evaluation reports and successful preliminary files from the grassroots Evaluation Council, prepares a report to submit to the Minister.

- Clause 4, Article 14: Certification is amended and supplemented as follows:

Annually, the Ministry of Agriculture and Rural Development announces the list of certified products and those whose certification decisions have expired.

- Clause 1, 2, Article 15; Clause 2, Articles 16, 18; Clause 2, 3, 4, Article 19: Add the phrase "industry associations" after "Departments of Agriculture and Rural Development".

The Head of the Office of the Ministry, the Director of the Department of Processing and Salt Industry, and the Heads of related units are responsible for implementing this Decision./.

Clause 1, 2 of Article 15; Clause 2 of Articles 16, 18; Clauses 2, 3, 4 of Article 19: supplement the phrase "associations" after the phrase "Department of Agriculture and Rural Development"

Article 2. This Decision takes effect from the date of signature.

Article 3. The Head of the Ministry's Office, the Director of the Processing Department under the Ministry of Agriculture and Rural Development, and the Heads of related units shall be responsible for implementing this Decision./.
