DECISION OF THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Regarding the establishment of the Plant Variety Protection Office
THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decree No. 13/2001/NĐ-CP dated April 20, 2001 of the Government on plant variety protection;
Pursuant to Circular No. 119/2001/TT-BNN dated December 21, 2001 of the Minister of Agriculture and Rural Development guiding the implementation of Decree No. 13/2001/NĐ-CP dated April 20, 2001 of the Government on plant variety protection;
At the suggestion of the Director of the Department of Organization and Cadres,
DECISION:
Article 1. Establish the Plant Variety Protection Office under the Department of Science, Technology and Product Quality.
The Plant Variety Protection Office shall have an official seal for administrative transactions within the scope of its assigned tasks.
Article 2. The Plant Variety Protection Office shall perform the following tasks:
1. Receiving, examining files, and submitting them to the competent authority for review; advising and handling procedures for the Ministry to issue, suspend, revoke, or withdraw plant variety protection certificates.
2. Collecting fees and charges for reviewing application files and maintaining the validity of certificates according to regulations. Revenue from fees and charges shall be deposited into the account of the Ministry of Agriculture and Rural Development.
3. Assisting leadership in compiling, statistics, storing files, and performing other administrative procedures related to the field of plant variety protection as assigned.
4. Using revenue from fees and charges in accordance with the provisions of the competent authority.
Article 3. The Plant Variety Protection Office shall be headed by a Director who concurrently serves as a leader of the Department of Science, Technology and Product Quality.
The staffing of the Plant Variety Protection Office shall consist of two professional staff members appointed by the Director of the Department of Science, Technology and Product Quality within the authorized quota assigned by the Ministry. In case of necessity, the Plant Variety Protection Office may accept personnel transferred for special assignment.
The operational regulations of the Plant Variety Protection Office shall be submitted by the Director of the Department of Science, Technology and Product Quality to the Ministry for decision.
Article 4. The Plant Variety Protection Office shall have its headquarters at the Ministry of Agriculture and Rural Development, No. 02 Ngoc Ha - Ba Dinh - Hanoi.
Article 5. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.
Article 6. The Head of the Ministry's Office, the Director of the Organizational and Cadre Affairs Department, the Director of the Department of Science, Technology and Product Quality, and the Heads of relevant units under the Ministry are responsible for implementing this decision./.
