ISSUING REGULATIONS ON RESPONSIBILITIES AND FORMS OF DISCIPLINARY ACTION AGAINST ORGANIZATIONS AND INDIVIDUALS FOR VIOLATIONS IN THE ACTIVITY OF CHARGING FEES ON NATIONAL ROADS UNDER STATE MANAGEMENT.
THE MINISTER OF TRANSPORTATION
BASED ON THE LABOR CODE ON JUNE 23, 1994 AND THE LAW AMENDING AND COMPLEMENTING CERTAIN PROVISIONS OF THE LABOR CODE ON APRIL 12, 2002;
WHEREAS, the Road Traffic Law dated June 29, 2001;
BASED ON THE ORDINANCE ON CIVIL SERVANTS ON FEBRUARY 26, 1998, THE ORDINANCE AMENDING AND COMPLEMENTING CERTAIN PROVISIONS OF THE ORDINANCE ON CIVIL SERVANTS ON APRIL 28, 2000 AND APRIL 29, 2003; THE ORDINANCE ON ANTI-CORRUPTION ON FEBRUARY 26, 1998;
BASED ON THE ORDINANCE ON FEES AND CHARGES ON AUGUST 28, 2001, DECREE NO. 57/2002/ND-CP OF JUNE 3, 2002 OF THE GOVERNMENT PROVIDING GUIDELINES FOR THE IMPLEMENTATION OF THE ORDINANCE ON FEES AND CHARGES;
Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
PURSUANT TO THE PROPOSAL OF THE DIRECTOR OF THE VIETNAM HIGHWAY ADMINISTRATION, THE HEAD OF THE CIVIL SERVICE DEPARTMENT, THE HEAD OF THE LEGAL AFFAIRS DEPARTMENT,
DECISION:
Article 1. ATTACHED TO THIS DECISION ARE "REGULATIONS ON RESPONSIBILITIES AND FORMS OF DISCIPLINARY ACTION AGAINST ORGANIZATIONS AND INDIVIDUALS FOR VIOLATIONS IN THE ACTIVITY OF CHARGING FEES ON NATIONAL ROADS UNDER STATE MANAGEMENT".
Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER ITS PUBLICATION IN THE OFFICIAL GAZETTE AND SHALL REPLACE DECREE NO. 318/2003/QD-BGTVT OF JANUARY 30, 2003 OF THE MINISTER OF TRANSPORTATION.
Article 3. THE CHAIRMAN OF THE PEOPLE'S COMMITTEE OF PROVINCES AND MUNICIPALITIES DIRECTLY UNDER THE CENTRAL GOVERNMENT, THE DIRECTOR OF THE OFFICE, THE DIRECTOR OF THE INSPECTION DEPARTMENT, THE HEADS OF DEPARTMENTS UNDER THE MINISTRY, THE DIRECTOR OF THE VIETNAM HIGHWAY ADMINISTRATION, THE DIRECTOR OF THE DEPARTMENT OF TRANSPORTATION (PUBLIC TRANSPORTATION), THE HEADS OF AGENCIES AND UNITS RELATED TO THESE MATTERS SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION.
