Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;

Considering the proposals of the Director of the Radiation and Nuclear Safety Control Department and the Director of the Cadre and Civil Servant Affairs Department;

DECISION:

Article 1. This Decision promulgates the Charter on Organization and Operation of the Radiation and Nuclear Safety Control Department.

Article 2. This Decision takes effect fifteen days after its publication in the Official Gazette and replaces Decision No. 159/QĐ-TCCB dated March 4, 1995 of the Minister of Science, Technology and Environment (now the Ministry of Science and Technology) promulgating the Charter on Organization and Operation of the Radiation and Nuclear Safety Board.

Article 3. The Heads of the Office, the Director of the Cadre and Civil Servant Affairs Department, the Director of the Radiation and Nuclear Safety Control Department, and the Heads of related units shall be responsible for implementing this Decision.

CHARTER

Organization and operation of the Radiation and Nuclear Safety Control Department

PART I

FUNCTIONS, TASKS, AND POWERS

Article 1. The Radiation and Nuclear Safety Control Department (abbreviated as the Radiation and Nuclear Safety Control Department) is a subordinate agency under the Ministry of Science and Technology with the mission to assist the Minister in performing state management functions regarding radiation and nuclear safety and control.

The Radiation and Nuclear Safety Control Department has legal personality, possesses its own seal, and is entitled to open domestic and foreign currency accounts at the State Treasury and banks.

The international name of the Radiation and Nuclear Safety Control Department is Vietnam Agency for Radiation and Nuclear Safety & Control, abbreviated as VARANSAC.

Article 2. The Radiation and Nuclear Safety Control Department has the following tasks and powers:

1. Organizing and participating in drafting regulatory legal documents, guidelines, procedures, and norms concerning radiation and nuclear safety and control. Participating in building the system of standards for radiation and nuclear safety, special regimes and policies for those working directly with radiation.

2. Building and submitting to the Ministry's leadership policies, directions for development, priority areas, programs, and annual plans for the field of radiation and nuclear safety and control. Implementing approved plans and master plans.

3. Organizing and implementing registration, issuance, extension, modification, and revocation of permits for radiation facilities, nuclear facilities, radiation sources, radiation workers, and activities related to radiation and nuclear. Conducting site assessment, design, construction, and safety and security justification for radiation and nuclear facilities.

4. Directing and guiding radiation and nuclear safety work for provincial Science and Technology Departments. Cooperating with other Ministries and Sectors to implement state management of radiation and nuclear safety and control according to the Ministry of Science and Technology's directives.

5. Carrying out specialized inspections for radiation and nuclear safety in accordance with the law. Resolving complaints and handling violations of laws on radiation and nuclear safety within its jurisdiction.

6. Managing radioactive waste. Organizing environmental monitoring, emergency response, and handling of radiation and nuclear incidents; controlling radiation doses and assessing safety in occupational, public, and medical irradiation.

7. Organizing nuclear inspection activities.

8. Establishing a statistical, archival, information, and data system on radiation and nuclear safety.

9. Organizing research on applying scientific and technological progress to radiation and nuclear safety and control activities.

10. Coordinating in organizing training, education, propaganda, and dissemination of regulatory legal documents, knowledge on radiation and nuclear safety, and safety culture.

11. Organizing and implementing international cooperation activities in the field of radiation and nuclear safety according to the division of labor by the Ministry. Participating in organizing the implementation of international treaties and agreements related to radiation and nuclear safety issues.

12. Performing other tasks assigned by the Minister of Science and Technology.

Managing cadres, assets, files, and documents of the Radiation and Nuclear Safety Control Department according to the classification and regulations of the Ministry.

Chapter II

ORGANIZATIONAL STRUCTURE

Article 3. The Radiation and Nuclear Safety Control Department operates under the chief executive system combined with collective discussion.

The Director of the Radiation and Nuclear Safety Control Department is responsible to the Minister for all activities of the Department.

Deputy Directors have the responsibility to assist the Director in general leadership of the Department's work, are accountable to the Director for the assigned tasks, and have the authority to decide matters within their assigned duties.

When the Director is absent, a Deputy Director authorized by the Director will lead and manage the Department's affairs within the Director's authority.

Article 4. The organizational structure of the Radiation and Nuclear Safety Control Department includes:

The Department Office.

Registration and Licensing Division.

Inspection, Control, and Emergency Response Division.

International Cooperation, Legal Affairs, and Information Division.

Technical Support for Radiation and Nuclear Safety Division.

Article 5. The Heads of units specified in Article 4 of this Charter are directly responsible to the Director for all aspects of their unit's work.

Article 6. The Director of the Radiation and Nuclear Safety Control Department is responsible for defining specific functions and tasks of units within the Department.

Article 7. Human resources of the Radiation and Nuclear Safety Control Department include:

Personnel within the establishment;

2) Personnel working under labor contracts. The Director of the Radiation and Nuclear Safety Control Department signs labor contracts with employees in accordance with the Labor Code, taking into account the workload and financial capacity of the Department.

Article 8. The Radiation Control and Nuclear Safety Department implements labor management systems, salary, wage, and other income systems, and social insurance and health insurance regimes for state employees and contractual workers from the Department's budget according to current State regulations and those of the Ministry of Science and Technology.

Chapter III

WORK RELATIONSHIPS

Article 9. The Director of the Radiation Control and Nuclear Safety Department implements work systems and working relationships with heads of subordinate units under the Ministry in accordance with the Ministry's operational regulations and other provisions issued by the Minister.

Article 10. The Radiation Control and Nuclear Safety Department is responsible for maintaining regular relations with relevant agencies within the Ministry and sector to perform state management functions and tasks related to radiation and nuclear safety as assigned by the Minister.

Chapter IV

FINANCIAL MANAGEMENT

Article 11. Financial Work

Sources of Revenue:

a) Revenue from the State budget;

b) Revenue from registration and licensing activities for facilities related to radiation and nuclear matters and related service activities;

c) Other revenue as prescribed by law: grants, loans, gifts, etc.

2. Expenditures include:

a) Regular operational expenses according to the functions and tasks assigned by competent authorities;

b) Service supply activity expenses;

c) Labor hire costs;

d) Other expenditures as prescribed.

Article 12. The Director of the Radiation Control and Nuclear Safety Department is responsible for managing and using the Department's financial resources effectively; fulfilling national contribution obligations and accounting systems according to current State regulations.

Chapter V

IMPLEMENTING PROVISIONS

Article 13. The Director of the Radiation Control and Nuclear Safety Department coordinates with the Personnel Organization Department Director to implement this Charter.

Article 14. Any amendments or supplements to this Charter shall be proposed by the Director of the Radiation Control and Nuclear Safety Department in coordination with the Personnel Organization Department Director, and decided upon by the Minister of Science and Technology./.
