THE MINISTER OF CONSTRUCTION

Pursuant to the Construction Law No. 16/2003/QH11 dated November 26, 2003;

Pursuant to Decree No. 36/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Implementing Circular No. 122/TB-VPCP dated April 24, 2006 of the Office of the Government assigning the Ministry of Construction to study and issue the Regulation on Architectural Management of Construction in the Surrounding Area of the National Convention Center;

At the proposal of the Director of the Department of Architecture and Urban Planning,

DECISION:

Article 1.The attached to this Decision "Regulation on Architectural Management of Construction in the Surrounding Area of the National Convention Center" is hereby promulgated.

Article 2.This "Regulation on Architectural Management of Construction in the Surrounding Area of the National Convention Center" replaces the previous "Regulation on Architectural Management of Construction in the Surrounding Area of the National Convention Center" issued under Decision No. 31/2005/QĐ-BXD dated September 28, 2005 of the Minister of Construction.

This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 3The People's Committee of Hanoi City, the People's Committee of Cau Giay District, the People's Committee of Thanh Xuan District, the People's Committee of Tu Liem District, the People's Committee of Me Tri Commune, construction investors in the area, relevant agencies, organizations, and individuals are responsible for implementing this Decision.

REGULATIONS

ARCHITECTURAL MANAGEMENT OF CONSTRUCTION IN THE SURROUNDING AREA OF THE NATIONAL CONVENTION CENTER

(issued pursuant to Decision No. 12/2007/QĐ-BXD dated March 23, 2007 of the Minister of Construction)

Chapter 1:

GENERAL PROVISIONS

Article 1.Scope of Application

This Regulation governs architectural and construction management in the surrounding area of the National Convention Center, including:

Total area: 256 hectares (1,600m x 1,600m)

+ North bordering the new Mê Trì Lower urban area;

+ South bordering Thanh Xuan Bac Ward, Thanh Xuan District;

+ East bordering the Nam Trung Yen New Urban Area;

+ West bordering Mê Trì Upper Village, Mê Trì Commune.

- The eastern boundary is 460 meters from the center of the intersection of Pham Hung Street and Lang Hoa Lac Road along Tran Duy Hung Street.

- The southwestern boundary is 1,140 meters from the center of the intersection of Pham Hung Street and Lang Hoa Lac Road along Lang Hoa Lac Road.

- The northwestern boundary is 1,250 meters from the center of the intersection of Pham Hung Street and Lang Hoa Lac Road along Pham Hung Street.

- The southeastern boundary is 350 meters from the center of the intersection of Pham Hung Street and Lang Hoa Lac Road along Khut Duy Tien Street.

Article 2.Principles

1. The National Convention Center complex (within an area of 64 hectares), including the National Convention Center, high-end hotel, Hanoi Museum, and auxiliary facilities such as water bodies, parking lots, parks, and the front plaza must comply with Decision No. 739/QĐ-BXD dated April 22, 2005 of the Minister of Construction approving the detailed planning for the construction area of the National Convention Center.

2. The architectural ensemble in the area must meet modernity and convenience requirements. All existing unsuitable buildings must be completed in accordance with the general style, and all future constructions must comply with this Regulation.

3. Surrounding constructions must not obstruct activities at the National Convention Center, especially along main traffic routes.

4. The entire architectural landscape ensemble must be harmoniously arranged, rhythmically structured, and not negatively impact primary and adjacent view corridors (using the National Convention Center and Hanoi Museum as the main viewing points to determine control areas).

5. Architectural works must comply with security and safety regulations during important events held at the National Convention Center.

Article 3Functional Areas

Land plots are determined according to their functions and structures based on approved detailed planning projects. The list of land plots is presented in the table below:

Chapter 2:

SPECIFIC PROVISIONS

Article 4General Provisions for the Entire Area

1. Building Height:

- The datum level 0,00 shall be determined as the finished sidewalk elevation of the National Convention Center to calculate the allowable height of buildings.

- The standard floor height corresponds to 3.6 meters.

2. Architectural Form:

These areas must be constructed in a coordinated and unified style with a modern and convenient trend. Attention should be paid to the external space of the building to create a landscape for the area.

3. Space Outside the Building:

- All technical pipeline systems must be buried and connected synchronously with the common infrastructure system of the area without affecting the National Convention Center.

- The following materials are prohibited: glazed ceramic tiles, washed stone, granite on large areas.

- Buildings shall not use overly strong colors such as purple, green, red; overly dark colors, or adjacent color blocks with high contrast.

- Upon completion, paint colors may use light colors such as white, eggshell... Excessive use of multiple colors for one building is discouraged.

- On the facade of the building, it is strictly forbidden to use glass and similar reflective materials.

- For residential buildings, air conditioning systems and clothes drying areas must be studied, arranged, and designed to enhance aesthetics. Households are prohibited from independently altering the building's facade.

- Advertising signs shall not be placed on rooftops or along the main roads of Pham Hung, Tran Duy Hung, Lang Hoa Lac, and Khuat Duy Tien, which would obstruct the view of the National Convention Center.

- Solid fences are not allowed, with a maximum fence height of 1.5 meters. It is encouraged to use greenery fences or metal fences with a ratio of solid/open spaces of 3/7.

- Vacant land areas must be allocated for gardens, landscaping trees, and parking lots. The garden area must occupy at least 60% of the vacant land area.

- It is encouraged that construction projects be set back from the approved building boundary.

4. Parking Lots:

- Underground parking lots shall primarily be located in the basement levels of buildings.

- Surface parking lots will be arranged in areas where sufficient space remains for parking.

Article 5.National Convention Center Area (64 hectares)

All provisions within this area must comply with the detailed planning that has been approved.

Article 6.Construction Land for Public Projects (CC1, CC2, CC3, CC4)

1. Southeast Urban Area Along Tran Duy Hung Road (CC1):

- The applicable area is limited to 340 meters wide along Khuat Duy Tien Road and 440 meters long along Tran Duy Hung Road.

- Main Function: Administrative offices, public services, rental service housing, and residential housing.

- Building Density: 35%-40%.

- Maximum Floor Area Ratio: 4.0 times.

- Maximum building height within the project area is 120 meters.

- The maximum length of a single building block along Tran Duy Hung and Khuat Duy Tien Roads is 60 meters. The minimum distance between building blocks is 25 meters.

- Building Boundary:

+ Minimum setback from the red line of Tran Duy Hung Road is 25 meters.

+ Minimum setback from the red line of Khuat Duy Tien Road is 25 meters.

- Primary View Orientation:

+ Towards the traffic island;

+ Along Khuat Duy Tien Road axis;

+ Along Tran Duy Hung Road axis.

- Uniformity in architectural form must be maintained among adjacent buildings, especially in height and window placement across floors.

- For office building areas, adequate parking facilities both inside and outside the building must be organized to accommodate traffic flow.

- Public service areas must be located in central and primary viewing directions.

- Enhancing the greenery and water surfaces is encouraged to create a landscape and ecological environment for the area.

2. Thang Long Bourbon Shopping Center (CC2):

- Main Function: Supermarket, office, hotel, residential.

- Building Density: 30%-35%.

- Maximum Floor Area Ratio: 5.0 times.

- Maximum building height is 130 meters for buildings within Zone 2 control area (refer to Diagrams 4, 5) with a distance of 600 meters from the center of the main entrance of the National Convention Center; beyond 600 meters, the maximum height is 174 meters (refer to Diagrams 4, 5).

- Building Boundary:

+ Minimum setback from the red line of Pham Hung Road is 25 meters.

+ Minimum setback from the red line of Tran Duy Hung Road is 25 meters.

- Primary View Orientation:

+ Towards the traffic island;

+ Along Pham Hung Road axis;

+ Along Tran Duy Hung Road axis.

- Adequate parking lot area must be ensured and additional broad-leaved trees must be added to provide shade for the parking lot.

- Buildings facing Pham Hung Road must not exceed 20 meters in height and must be constructed in a coordinated and consistent architectural form and style with surrounding buildings.

- Hotels and high-rise residential buildings are to be located behind.

- Greenery decoration systems must be studied, and flowering plants must be combined, particularly creating green spaces on the facade by arranging plants on balconies and roof terraces.

3. Commercial Office Complex Viglacera, Vinata, Vinaconex 1 (CC3):

- Main Function: Office, commercial services, hotel, residential.

- Building Density: 35%-40%.

- Maximum Floor Area Ratio: 6.0 times.

- Maximum Height: 130 meters.

- Building Boundary:

+ Minimum setback from the red line of Lang Hoa Lac Road is 30 meters.

+ Minimum setback from the red line of Khuat Duy Tien Road is 25 meters.

- Primary View Orientation:

+ Towards the traffic island;

+ Along Lang Hoa Lac Road axis;

+ Along Khuat Duy Tien Road axis.

- Buildings must be constructed in a coordinated and consistent architectural form and style.

- The architectural form must be modern and shall not have sharp corners or gables facing the National Convention Center.

- Relocate production workshops and convert this area into high-rise residential, hotel, and office functions.

- For buildings within the special control zone with a distance of 600 meters from the center of the main entrance of the National Convention Center: maximum height is 20 meters; beyond 600 meters, the maximum height is 37 meters; beyond 1000 meters, the maximum height is 54 meters (refer to Diagram 4).

- For buildings within Zone 1 control area with a distance of 500 meters from the center of the main entrance of the National Convention Center: maximum height is 109 meters; within 500-600 meters, the maximum height is 130 meters; beyond 600 meters, the maximum height is 174 meters.

4. Auction Area (CC4):

- Main Function: Public services, office.

- Building Density: 25%-30%.

- Maximum Floor Area Ratio: 5.0 times.

The maximum building height in the project area is 90 meters.

- Building Boundary:

+ Minimum setback from the red line of Tran Duy Hung Road is 25 meters.

- Primary View Orientation:

+ Along Tran Duy Hung Road axis.

- Uniformity in architectural form must be maintained among adjacent buildings, especially in height and window placement across floors.

Parking lots must be organized both inside and outside buildings to adequately accommodate the traffic flow to the area.

, Clause 1, Clause 2 Article 7a of this Regulation..Cultural facility and hotel construction site (VH-KS)

- The applicable area is along Pham Hung Street within a length of 300 meters.

- Main function: The land is permitted to construct mixed-use cultural and commercial service facilities.

1. For the construction area of the Cultural House (VH):

- Building density: 20%-25%.

- Maximum building height: 30 meters.

- Construction boundaries must comply with the following regulations:

+ Minimum distance from the red line of Pham Hung Street: 30 meters.

+ Minimum distance from the red line of newly opened streets: 25 meters.

- Primary View Orientation:

+ Facing towards the National Convention Center.

+ Facing the axis of Pham Hung Street.

- Modern architectural style with national characteristics.

2. For the construction area of high-end hotels (KS):

- Building density: 30%-35%.

- Maximum Floor Area Ratio: 4.0 times.

- Maximum building height: 70 meters.

- Construction boundaries must comply with the following regulations:

+ Minimum distance from the red line of Pham Hung Street: 30 meters.

+ Minimum distance from the red line of newly opened streets: 25 meters.

- Primary View Orientation:

+ Facing towards the National Convention Center.

+ Facing the axis of Pham Hung Street.

- Modern architectural style.

Article 8.Office construction site (VP1 – VP2)

1. Area VP1: Area of State-owned Enterprises.

- The applicable area is along Pham Hung Street within a length of 200 meters.

- Main function: The land is permitted to construct mainly office buildings and headquarters.

- Maximum building density: 30%.

- Maximum Floor Area Ratio: 5.0 times.

- Buildings at the corner of Pham Hung Street and the boundary separating the Long Bien Thang Long Commercial Center from the State-owned Enterprises area have a maximum height of 100 meters and serve as landmark structures.

- Other buildings have a maximum height of 80 meters.

- Construction boundaries must be at least 20 meters away from the red line of Pham Hung Street.

- The main view for buildings should face the axis of Pham Hung Street.

- Buildings constructed on this land must have a modern architectural style, creating a harmonious transition among them.

2. Area VP2: Area of State-owned Enterprises.

- The applicable area is along Pham Hung Street within a length of 300 meters.

- Main function: The land is permitted to construct mainly office buildings and headquarters.

- Maximum building density: 30%.

- Maximum Floor Area Ratio: 5.0 times.

- Maximum height in the area: 80 meters.

- Buildings adjacent to the construction boundary have a maximum height of 80 meters.

- The main view for buildings should face the axis of Pham Hung Street.

- The architectural style of the blocks of State-owned Enterprises must be in harmony and have a modern architectural style.

Article 9.Urban residential construction site (H1 – H2 – H3 – H4)

Includes projects:

- New urban residential area in Nam Trung Yen

- VIMECO residential area

Regulations:

- Main function: The land is permitted to construct mainly high-rise residential buildings.

- Maximum building density: 30%

- Buildings adjacent to the construction boundary have a maximum height of 72 meters.

- Blocks must be built uniformly and consistently in architectural style.

- Create dynamic facades for buildings to avoid monotony.

- Blocks must have sloping roofs with dark green color.

- Within the residential area, studies on decorative greenery systems and shade must be conducted, combining colorful flower patches, especially creating green spaces on the facade by arranging plants on balconies and roof levels.

- Infrastructure and social services must be fully provided. Residential amenities must ensure the best for users.

- Public spaces (playgrounds, green areas, water surfaces...) must be organized for the elderly, children, and community.

- Urban residential areas with high population density require multiple entrances and exits to ensure vehicle circulation.

Article 10Village construction site (LX1 – LX8)

- Main function: The land is permitted to construct mainly low-rise garden houses.

- Maximum building density: 80%.

- Maximum floor height: 18 meters.

- In the LX1, LX3, LX6, LX7 areas along the western and northwestern axis of the National Convention Center, buildings will be divided into three layers:

+ Layer 1: Planting wide-canopy trees along the western and northwestern perimeter of the National Convention Center with a minimum width of 5 meters. The height of these green belts must reach at least 5 meters.

+ Layer 2: With a depth of 20 meters adjacent to the green belt, it is allowed to build garden houses with a minimum area of 150 square meters, with a maximum building density of 50%. These houses have a maximum height of 12 meters equivalent to 3 floors, built with beautiful and harmonious architectural styles with the landscape in front.2+ Layer 3: Behind the row of garden houses: Rows of houses belonging to nearby villages are expected to be renovated in terms of architectural style and village roadscapes.

- Architectural style must achieve the goal of preserving the identity of the village areas and improving the quality of life and landscape.

- Project plans for the first layer construction area must be established according to specific conditions.

Military construction site (QS)

Article 11.Headquarters of the Military Command of Hanoi City.

- The applicable area is 270 meters wide along Pham Hung Street and 140 meters deep.

- Main function: The land is permitted to construct military office buildings.

- Maximum building height: 25 meters.

- Building density: 20%-25%.

- Construction boundaries must be at least 30 meters away from the red line of Pham Hung Street.

- The main view should face the axis of Pham Hung Street.

- Buildings constructed on this land must have the same architectural style as surrounding buildings.

- Renovate the low fence with trimmed trees combined with metal railings.

- The color of the buildings must harmonize with the colors of surrounding buildings, with sloping roofs colored dark green and walls in light colors such as light blue or cream.

- Parking lots must be arranged within the project plot.

Sports and entertainment construction site Me Tri (G)

Article 12.- Main function: Sports training and entertainment.

- Building density: 3%-5%.

- Maximum floor height: 12 meters.

- Construction boundaries must be at least 30 meters away from the red line of Lang Hoa Lac Street.

- The main view should face the axis of Lang Hoa Lac Street.

 

- The spatial organization of this project needs to connect with surrounding projects and also align with the main spatial axis from the National Convention Center.

- This area mainly organizes greenery and water surfaces to create additional green space for the city, contributing to the surrounding landscape environment.

- Architectural structures must choose forms and positions that do not turn their backs, with roofs pointed towards the National Convention Center, aiming to create a beautiful view when seen from the National Convention Center.

Educational and vocational training center construction site (TH)

Article 13.- Main function: Schools and vocational training centers.

- Maximum floor height: 20 meters.

- Building density: 30%-35%.

Maximum height: 20 meters.

- Construction boundary: At least 25 meters from the red line of newly opened roads.

- Preferred main view direction: Facing the National Convention Center.

- Modern architectural style.

Article 14.Green area (CX1-CX2)

CX1: The flower garden to the north of the National Convention Center.

CX2: The flower garden near the intersection of Pham Hung – Lang – Hoa Lac, adjacent to the Viglacera area.

Requirements for green space organization:

- Street trees must be planted with wide canopies to provide shade and contribute to urban environmental quality.

- Decorative plants when planted on traffic islands, median strips, and flower gardens should pay attention to the color of flowers to create beautiful scenery for the area.

- Trees should be planted along axes, lines, clusters, and have a minimum height to immediately contribute practical benefits.

Article 15.Technical infrastructure

- Power lines, pipelines (high voltage lines, water supply, communication cables, street lighting...) within the area must be buried underground.

- Drainage channels must not be open ditches.

- Consider connections and interfaces with future underground transportation systems.

- Redesign pedestrian access routes to underground roads to ensure aesthetics, lighting, and security for pedestrians.

Article 16.Urban amenities

1. Lighting:

Detailed designs for street lighting systems and structures should be modern and diverse in form.

2. Sidewalk paving:

Sidewalk paving materials should be durable, with elegant colors, avoiding monotonous designs.

3. Fences:

- Encourage the use of low fences, trimmed plant fences, or architectural elements to divide spaces.

- Metal fences allowed to be constructed must be sparse, with a solid/void ratio of 3/7, painted dark green, chestnut, or dark blue.

4. Signage:

Advertising signs, directional signs, and warning signs must be designed attractively, placed low, ensuring they do not obstruct views of the National Convention Center, impede traffic, or affect pedestrian pathways, aiming for effectiveness and ease of use.

5. Other urban amenities:

- Design paths for people with disabilities and the visually impaired.

- The style of public trash bins, seating, public telephone booths, and their placement must also be studied and determined specifically.

6. Supporting technical facilities:

Main stations, supporting systems such as manhole covers, substations, public telephone poles, street lighting poles, and other amenities must all be designed aesthetically.

7. Public art monuments:

- The form and location of public art monuments in the area must be researched and specifically determined by relevant specialized units.

Chapter 3:

IMPLEMENTATION

Article 17.The People's Committee of Hanoi City directs specialized agencies, district, town, and commune authorities within the area to manage construction according to this Regulation.

Article 18.Assign specialized management agencies (Hanoi Department of Planning and Architecture, Hanoi Department of Construction) to inspect ongoing projects to develop reasonable adjustment plans, while organizing the dissemination of this regulation to localities, units, agencies, and residents with construction projects in this area.

Article 19.This architectural construction management regulation shall be issued, disseminated, published, and stored at the following agencies so that organizations, agencies, and the public may be informed and comply.
