Regulations on the organization of issuing and revoking registration certificates and license plates for specialized motorcycles of the People's Public Security Forces

Based on the Road Traffic Law 2008;

Based on Decree No. 136/2003/NĐ-CP dated November 14, 2003 stipulating the functions, tasks, powers, and structure of the Ministry of Public Security;

The Ministry of Public Security stipulates the regulations on the organization of issuing and revoking registration certificates and license plates for specialized motorcycles used by the People's Public Security Forces for security purposes as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. Scope and Applicability

This Circular stipulates the issuance and revocation of registration certificates and license plates for specialized motorcycles serving security purposes of the People's Public Security Forces including armored vehicles, tracked crane trucks, bulldozers, excavators, drills, rollers, and other types of specialized motorcycles.

2. Classification of Authorities Issuing and Revoking Registration Certificates and License Plates for Specialized Motorcycles

2.1. The Highway Police Department under the Criminal Police General Corps (Ministry of Public Security): Organizes the issuance and revocation of registration certificates and license plates for specialized motorcycles of the General Departments and units directly under the Minister of Public Security with headquarters in Hanoi.

2.2. Provincial and Central City Traffic Police Departments: Organize the issuance and revocation of registration certificates and license plates for specialized motorcycles of local public security units and specialized motorcycles of units under the Ministry of Public Security located within their jurisdiction (excluding the subjects specified in Clause 2.1 of this Circular).

II. SPECIFIC PROVISIONS

1. Regulations on Issuing Registration Certificates and License Plates for Specialized Motorcycles

When registering a vehicle, the unit managing and using the vehicle must present an Introduction Letter clearly stating the name, position, and rank of the person registering the vehicle, accompanied by:

1.1. Vehicle registration application form

1.2. Decision allocating or dispatching the vehicle (for vehicles provided by the Ministry) or purchase receipt (for vehicles purchased by agencies and units themselves).

1.3. Proof of origin of the vehicle.

1.3.1. For imported complete vehicles according to commercial contracts or aid vehicles: A copy of the Export and Import Declaration Form confirmed by the Customs Authority.

1.3.2. For individually imported vehicles (non-commercial): Export and Import Permit for non-commercial goods as prescribed by the Ministry of Finance.

1.3.3. For domestically produced or assembled vehicles: Quality Inspection Certificate at the time of factory release as prescribed by the Ministry of Transport.

1.3.4. For modified vehicles:

- Vehicle registration certificate (for already registered vehicles) or proof of origin as specified in Points 1.3.1, 1.3.2, or 1.3.3 above (for unregistered vehicles).

- Safety and Environmental Protection Certificate for modified vehicles as prescribed by the Ministry of Public Security.

2. Regulations on Revoking Registration Certificates and License Plates for Specialized Motorcycles

2.1. Situations requiring the revocation of registration certificates and license plates:

- Vehicles that are old, damaged, or destroyed during operations or combat and are no longer usable.

- Vehicles decided to be liquidated by authorized authorities.

- Vehicles that have exceeded their service life.

2.2. Procedures for Revoking Registration Certificates and License Plates:

The management and usage units submit a letter requesting revocation along with the registration certificate and license plate. After receiving the complete revocation application as prescribed, the authority responsible for issuing and revoking registration certificates will issue a revocation certificate to the management and usage units.

3. Management of Vehicle Records

Records of issuing and revoking registration certificates and license plates are managed according to the record system of the Ministry of Public Security; vehicle information data is uniformly managed on computer systems; monthly, the registration authority is responsible for reporting vehicle registration and management data to the Highway Police Department for management.

4. Regulations on License Plates and Registration Forms for Specialized Motorcycles

License plates and registration forms for specialized motorcycles used by the People's Public Security Forces for security purposes are uniformly managed and issued nationwide by the Ministry of Public Security.

4.1. Regarding Registration Forms:

When registering specialized motorcycles used by the People's Public Security Forces, the registration forms number 02, 03, 07, 08, and 13 issued together with Circular No. 06/2009/TT-BCA-C11 dated March 11, 2009 of the Ministry of Public Security shall be used.

4.2. Regarding License Plates:

Vehicles registered at the Highway Police Department or provincial and central city police departments bear license plates with symbols of the Highway Police Department or the respective province/city.

4.2.1. License plates for specialized motorcycles are made of materials, types, sizes, and number arrangements as prescribed in Clause 2.4 and Clause 2.5, Point 2, Part IV of Circular No. 06/2009/TT-BCA-C11 dated March 11, 2009 of the Ministry of Public Security.

4.2.2. License plates for specialized motorcycles have a blue background, white letters and numbers, and a special symbol "CD".

III. IMPLEMENTATION

1. This Circular takes effect from July 1, 2009, and replaces relevant provisions related to the registration and issuance of license plates for specialized motorcycles of the People's Public Security Forces in Chapter I "Regulations on Registration and Issuance of License Plates for Specialized Motorcycles and Periodic Safety and Environmental Protection Inspections of Motor Vehicles" issued together with Decision No. 18/2002/QĐ-BCA(C11) dated January 7, 2002 of the Minister of Public Security.

2. Directors of General Departments, Heads of Units directly under the Minister of Public Security, and Directors of Provincial and Central City Public Security Departments instruct subordinate units responsible for managing and using specialized motorcycles to implement regulations on issuing and revoking registration certificates and license plates for specialized motorcycles of the People's Public Security Forces.

3. Directors of the Highway Police Department and Directors of Provincial and Central City Public Security Departments guide, inspect, and urge strict compliance with this Circular and other relevant laws regarding the issuance and revocation of registration certificates and license plates for specialized motorcycles of the People's Public Security Forces.

4. The Criminal Police General Department directs, guides, and inspects the implementation of this Circular./.
