CIRCULAR
Regulations on updating information about investment projects applying information technology funded by state budget to the National Database on Information Technology Application Projects.
Pursuant to the Law on Information Technology dated June 29, 2006;
Pursuant to Decree No. 64/2007/NĐ-CP dated April 10, 2007 of the Government on the Application of Information Technology in the Activities of State Agencies;
Based on Decree No. 102/2009/NĐ-CP dated November 6, 2009 of the Government on management of investment in application of information technology using state budget funds;
BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;
At the proposal of the Director of the Department of Information Technology Application,
c) Enterprises may be granted permission for no more than one block out of the total three dual-frequency blocks (FDD) B
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the updating of information about investment projects applying information technology funded by state budget into the National Database on Information Technology Application Projects as prescribed in Article 54 of Decree No. 102/2009/NĐ-CP dated November 6, 2009 of the Government on management of investment in application of information technology using state budget funds.
Article 2. Applicability
This Circular applies to the following entities:
1. Agencies, organizations, units that are the investors of information technology application projects as prescribed in Decree No. 102/2009/NĐ-CP, hereinafter referred to as Reporting Units.
2. Specialized units for information technology under Ministries, ministerial-level agencies, government agencies, Provincial Departments of Information and Communications of centrally governed cities are responsible for collecting information from project investors within their respective ministries, sectors, and localities, hereinafter referred to as Central Units.
It is encouraged for organizations and businesses investing in information technology applications not falling under the subjects mentioned in Clause 1 of this Article to compile project investment application information according to the guidelines set out in this Circular and submit it to the Ministry of Information and Communications for updating into the National Database on Information Technology Application Projects.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. “Software application project” refers to a project for developing new, expanding, or upgrading software applications and databases.
2. “Technical infrastructure project” refers to a project for installing new, expanding, or upgrading technical infrastructure to ensure and serve the operation of software applications and databases.
3. “Hybrid project” refers to a project including technical infrastructure, software application, and database investments.
4. “National Database on Information Technology Application Projects” refers to a collection of information and data on products of investment projects applying information technology, hereinafter referred to as the Database.
Chapter II
SPECIFIC PROVISIONS
Article 4. Content of Information to be Updated
1. The content of information on investment projects applying information technology to be updated into the Database shall be reported in the form of reports including:
a). Stage 1 Report: The Reporting Unit shall report the results of the approved investment project according to the guidelines in Appendix I, Appendix III, and Appendix V.
b). Stage 2 Report: The Reporting Unit shall report the results of the investment project upon acceptance and handover, including all information on the project's products according to the guidelines from Appendix I to Appendix X, including:
- General Information Report (Appendix I);
- Tender Plan and Contract Report (Appendix II);
- Technical Requirements List Report (Appendix III);
- Investment Content Report (Appendix IV);
- Technical Solution Report (Appendix V);
- Human Resources Report (Appendix VI);
- Technical Documentation File Report (Appendix VII);
- Investment Cost Report (Appendix VIII);
- Investment Effectiveness Evaluation Report (Appendix IX);
- Implementation Experience Report (Appendix X).
For Appendices I, III, and V which already have Stage 1 Reports, the Reporting Unit only needs to update the changed indicators.
2. The content of information to be updated must be truthful, accurate, complete, and reflect the actual situation of the project.
Article 5. Time for Updating
1. For the Report Phase 1:
a) The reporting unit shall submit the project investment application information report to the Lead Unit no later than one month from the date the project investment is approved.
b) After collecting the project investment application information reports within their respective ministries, sectors, or localities, the Lead Unit shall update them into the Database. The updating period starts from November 30 and must be completed no later than December 31 of the same year.
2. For the Report Phase 2:
a) The reporting unit shall submit the project investment application information report to the Lead Unit no later than three months from the date of overall acceptance and handover of the project.
b) The Lead Unit shall collect the project investment application information reports within their respective ministries, sectors, or localities and update them into the Database annually no later than December 31.
Article 6. Method of Updating
1. The reporting unit shall submit the project investment application information report to the Lead Unit in the form of a document according to the model prescribed in Appendix XI.
2. The Lead Unit shall update the project investment application information reports into the Database through one of the following methods:
a) Paper document: prepare a letter according to the model at Appendix XII, accompanied by the collection of project investment application information reports and send it to the Ministry of Information and Communications;
b) Email: prepare a list of project investments applying information technology, accompanied by the collection of project investment information reports and send it to the email address: [email protected];
c) Use an account already issued by the Database system to directly update using electronic forms for Phase 1 Reports and Phase 2 Reports provided on the Database system's website.
3. It is encouraged that agencies, organizations, and units compiling Phase 2 Reports of project investments applying information technology funded by state budget funds that have ended before this Circular takes effect to update into the Database according to the provisions of this Circular.
Chapter III
IMPLEMENTATION
Article 7. Responsibilities of Relevant Units
1. The specialized units for information technology of Ministries, ministerial-level agencies, government agencies, Provincial Departments of Information and Communications under central cities have the responsibility:
a) To compile a list of ongoing project investments applying information technology within their respective ministries, sectors, or localities according to the model at Appendix XIII of this Circular, and submit it to the Ministry of Information and Communications annually no later than December 31.
b) To review, urge, and guide the project investors to compile project investment application information reports.
c) To update project investment application information reports into the Database within the time limit stipulated in this Circular.
2. Project investors applying information technology have the responsibility:
a) To compile project investment application information reports of their own units and update them into the Database through the Lead Unit within the time limit stipulated in this Circular.
b) To provide other related information about project investments applying information technology upon request of management agencies.
3. The Department of Information Technology Application has the responsibility:
a) To organize the construction and management of the national database on information technology application projects.
b) To provide electronic forms on the Database system's website.
c) To receive project investment application information reports from the Lead Units; organize the management and storage of information on information technology application projects; provide information to serve management and investment activities in the field of information technology application.
Article 8. Effective Date
1. This Circular takes effect from July 5, 2010.
2. During implementation, if there are arising issues or difficulties, relevant individuals and units need to promptly reflect them to the Ministry of Information and Communications for consideration, supplementation, and amendment./.
