CIRCULAR
Regulations on statistical forms and reporting procedures for drug prevention and control

On the basis of the Law on Prevention and Control of Narcotics 2000 and the Law Amending and Supplementing Certain Provisions of the Law on Prevention and Control of Narcotics 2008;
Pursuant to the Statistics Law 2003;
Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
On the basis of Decision No. 127/2009/QĐ-TTg dated October 26, 2009 of the Prime Minister promulgating the Reporting and Statistical System for Prevention and Control of Narcotics;
The Minister of Public Security hereby stipulates the statistical forms and the reporting system for prevention and control of narcotics as follows:
Article 1. Statistical Forms for Prevention and Control of Narcotics
Attached to this Circular are the following statistical forms for prevention and control of narcotics:
1. Form BMS 1 and Form BMS 1A for collecting relevant data on prevention and control of narcotics; Form BMS 1B for collecting information on drug addicts for Police Stations at Communes, Wards, and Towns (collectively referred to as Police Stations at Commune Level).
2. Form BMS 2 for collecting relevant data on prevention and control of narcotics for Police Departments at Districts, Urban Districts, Provincial Cities, and Central City Provinces (collectively referred to as Police Departments at District Level).
3. Form BMS 2A for collecting information on persons committing crimes related to narcotics for Police Departments at District Level, Provincial Criminal Investigation Departments on Narcotic Crimes, and the National Criminal Investigation Department on Narcotic Crimes.
4. Form BMS 3 for collecting relevant data on prevention and control of narcotics for Police Departments at Provinces and Central City Provinces (collectively referred to as Police Departments at Province Level).
5. Form BMS 4 for collecting relevant data on prevention and control of narcotic-related crimes for the National Criminal Investigation Department on Narcotic Crimes.
6. Form BMS 4A for collecting relevant data on prevention and control of narcotics for the Institute of Forensic Science - Ministry of Public Security.
7. Form BMS 5 for collecting relevant data on prevention and control of narcotics for the General Bureau of Enforcement of Criminal Sentences and Judicial Assistance.
8. Form BMS 6 for collecting relevant data on prevention and control of narcotics for the Ministry of Public Security.
9. Forms BMS 7, BMS 7A, BMS 7B, and BMS 7C for the Ministry of Public Security to collect comprehensive data on prevention and control of narcotics from relevant ministries, departments, People's Committees of provinces and central city provinces, and organizations and individuals concerned to report to the Government.
Article 2. Reporting System for Statistics on Prevention and Control of Narcotics
1. Police Stations at Commune Level shall submit monthly reports according to Form BMS 1A, semi-annual and annual reports according to Form BMS 1 to Police Departments at District Level. Form BMS 1B shall be kept at the unit.
2. Police Departments at District Level shall submit semi-annual and annual reports according to Form BMS 2 to Police Departments at Province Level. Form BMS 2A shall be kept at the unit.
3. Police Departments at Province Level shall submit semi-annual and annual reports according to Form BMS 3 to the Ministry of Public Security (through the Office of the Standing Committee on Crime Prevention and Narcotics Control). The Provincial Criminal Investigation Department on Narcotic Crimes shall compile according to Form BMS 2A to keep at the unit.
4. The National Criminal Investigation Department on Narcotic Crimes shall submit semi-annual and annual reports according to Form BMS 4 to the Office of the Standing Committee on Crime Prevention and Narcotics Control. Form BMS 2A shall be kept at the unit.
5. The Institute of Forensic Science shall submit semi-annual and annual reports according to Form BMS 4A to the Office of the Standing Committee on Crime Prevention and Narcotics Control.
6. The General Bureau of Enforcement of Criminal Sentences and Judicial Assistance shall submit semi-annual and annual reports according to Form BMS 5 to the Office of the Standing Committee on Crime Prevention and Narcotics Control.
7. The Office of the Standing Committee on Crime Prevention and Narcotics Control shall compile semi-annual and annual statistics on prevention and control of narcotics for the Ministry of Public Security according to Form BMS 6.
8. The Office of the Standing Committee on Crime Prevention and Narcotics Control shall compile semi-annual and annual statistics on prevention and control of narcotics from relevant ministries, departments, People's Committees of provinces and central city provinces, and organizations and individuals concerned for the Ministry of Public Security to report to the Government according to Forms BMS 7, BMS 7A, BMS 7B, and BMS 7C.
9. The deadlines for submitting reports shall be carried out in accordance with the Reporting and Statistical System for Prevention and Control of Narcotics issued together with Decision No. 127/2009/QĐ-TTg dated October 26, 2009 of thePrime Minister. The initial figures in the report are the figures at the end of the previous reporting period; the final figures in the report are the figures at the end of the current reporting period.
Article 3. Effectiveness
This Circular takes effect from May 10, 2011.
Article 4. Responsibilities for Implementation
1. Directors of General Bureaus, Heads of units under the Ministry, and Directors of Public Security Departments of provinces and central city provinces are responsible for implementing this Circular.
2. Director of the General Bureau of Crime Prevention and Suppression is responsible for guiding, inspecting, and urging the implementation of this Circular. In case of any difficulties arising during implementation, local police units shall report to the Ministry of Public Security (through the General Bureau of Crime Prevention and Suppression) for timely guidance.
