Amending, supplementing, and replacing certain provisions of Circular No. 02/2010/TT-BTTTT dated January 11, 2010

Pursuant to the Law on Publishing dated December 3, 2004 and the Law Amending and Supplementing Certain Provisions of the Law on Publishing dated June 3, 2008;

Pursuant to Decree No. 111/2005/NĐ-CP dated August 26, 2005 of the Government detailing and guiding the implementation of certain provisions of the Law on Publishing which has been amended and supplemented by Decree No. 11/2009/NĐ-CP dated February 10, 2009 and Decree No. 110/2010/NĐ-CP dated November 9, 2010 of the Government;

BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;

At the proposal of the Director of the Publishing Department,

c) Enterprises may be granted permission for no more than one block out of the total three dual-frequency blocks (FDD) B

Article 1. Amending and supplementing Article 11 of Circular No. 02/2010/TT-BTTTT dated January 11, 2010

Article 11 shall be amended and supplemented as follows:

"Article 11. Documents for requesting import permit for non-commercial publications
1. The documents for requesting import permit for non-commercial publications shall be prepared in one set and sent via postal service, express delivery service, or delivered directly to the authority issuing the permit as stipulated in Clause 2 and Clause 3 of this Article, including:
a) Application form for import permit for non-commercial publications and three (3) copies of the list of imported publications (in accordance with Model No. 16 and Model No. 17 attached hereto);
b) Certified copy or copy accompanied by original for comparison of identity card or passport of the person handling the procedures, except when sending documents via postal service or express delivery service;
c) Certified copy or copy accompanied by original for comparison of consignment note, invoice, receipt of goods (if any) for imported publications currently held by customs, postal service, or express delivery service enterprises;
d) Certified copy or copy accompanied by original for comparison of operating license in Vietnam for foreign agencies, organizations, or international organizations named in the application for permit;
đ) In case of importing publications for specialized research purposes, an additional application for import permit from the Minister, head of a ministerial-level agency, or head of a central agency or provincial agency responsible for the relevant field must be provided.
2. Central agencies, organizations; foreign agencies, organizations; international organizations with headquarters in Hanoi shall submit the documents for requesting import permit for non-commercial publications to the Publishing Department or the Department of Information and Communications of Hanoi City.3. Local agencies, organizations; branches, representative offices, subordinate units of central agencies located in localities; foreign agencies, organizations, international organizations with headquarters or operations in localities; Vietnamese individuals, foreign individuals coming to or residing in localities shall submit the documents for requesting import permit for non-commercial publications to the Department of Information and Communications of the locality."

Article 2. Abolishing, replacing, and supplementing the forms prescribed in Article 17 of Circular No. 02/2010/TT-BTTTT dated January 11, 2010

1. Abolish the following forms numbered 01, 03, 07, 10, 11, 13, 14, 15, 16, 17, 18, 19, and 20 issued together with Circular No. 02/2010/TT-BTTTT dated January 11, 2010.

2. Issue the following forms together with this Circular to replace the abolished forms under Paragraph 1 of this Article;

a) Form No. 01: Application for establishment permit of a publishing house replacing Form No. 01;

b) Form No. 03: Registration of publication plan replacing Form No. 03;

c) Form No. 07: Application for printing permit for foreign countries replacing Form No. 07;

d) Form No. 10: Application for business operation permit for importing publications replacing Form No. 10;

đ) Form No. 11: List of personnel reviewing imported publication content replacing Form No. 11;

e) Form No. 13: Registration of publication import catalog for business replacing Form No. 13;

g) Form No. 14: Catalog of publications imported for business replacing Form No. 14;

h) Form No. 15: Confirmation of registration of publication import catalog for business replacing Form No. 15;

i) Form No. 16: Application for import permit for non-commercial publications replacing Form No. 16;

k) Form No. 17: Catalog of non-commercial publications imported replacing Form No. 17;

l) Form No. 18: Import permit for non-commercial publications (issued by the Publishing Department) replacing Form No. 18;

m) Form No. 19: Import permit for non-commercial publications (issued by the Department of Information and Communications) replacing Form No. 19;

n) Form No. 20: Application for organizing exhibition, trade fair of publications replacing Form No. 20.

3. Supplement the following two forms:

a) Form No. 23: Project for establishing a publishing house;

b) Form No. 24: Curriculum vitae (for persons proposed to be appointed as leaders of publishing houses).

Article 3. Effectiveness

This Circular takes effect from August 1, 2011.

During the implementation process, if there are any difficulties, please reflect them in writing to the Ministry of Information and Communications for consideration and resolution.
