Guidelines for Competition and Reward Work in the Education Sector

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward;
Pursuant to Circular No. 02/2011/TT-BNV dated January 24, 2011 of the Ministry of Home Affairs guiding the implementation of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward;
The Minister of Education and Training hereby issues guidelines for competition and reward work in the education sector as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Circular guides competition and reward work in the education sector including: organizing the launch of competition movements; forms and criteria for competition titles; forms and criteria for rewards; authority to decide and present competition titles and reward forms; procedures and files for requesting recognition of competition titles and reward forms; Competition and Reward Councils, Scientific and Innovative Councils at all levels; competition and reward funds.
2. This Circular does not specify standards, procedures, and files for considering and presenting the Commendation Medal "For the Education Cause" and the titles of "People's Teacher" and "Outstanding Teacher."
3. Competition and reward work in the education sector shall be carried out in accordance with the provisions of the Law on Competition and Reward; Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward; Circular No. 02/2011/TT-BNV dated January 24, 2011 of the Ministry of Home Affairs guiding the implementation of Decree No. 42/2010/NĐ-CP; this Circular and related regulations. 1. Competitors include: a) Departments, Inspectorates, Offices, and Representative Offices of the Ministry in Ho Chi Minh City;
Article 2. Applicability
b) Educational institutions directly managed by the Ministry of Education and Training;
Enterprises and public service units under the Ministry of Education and Training;
Early childhood, primary, secondary, continuing education, vocational education, and higher education institutions not directly managed by the Ministry of Education and Training;
c) d) Departments of Education and Training, District Education and Training Offices;
d) e) Small collectives within the entities specified in points a, b, c, d, and e of this clause, including departments, offices, and subjects that have their own mass organizations in universities and colleges;;
f) Civil servants, public officials, and employees working or undergoing probation; those with indefinite-term contracts and contracts of one year or more within the collectives specified in points a, b, c, d, e, and f of this clause (collectively referred to as civil servants, public officials, and employees).
2. Recipients of rewards include: a) The entities and individuals specified in Clause 1 of this Article (collectively referred to as entities and individuals in the education sector);
b) Collectives and individuals not employed in the education sector who have outstanding achievements and contributions to the development of the national education and training cause.
3. Regulations on competition assessment for some special cases
Female employees on maternity leave according to state regulations; individuals who bravely save people or property; individuals injured in combat or serving in combat and requiring treatment or convalescence as concluded by health authorities, their leave time will still be counted towards consideration for the title of "Advanced Worker";
b) Individuals sent for short-term study or training under one year, if achieving good results or better and complying with the rules of the training institution, can combine their time working at their unit to assess competition titles. For those sent for study or training for one year or more with satisfactory academic performance, they will be ranked equivalent to the title of "Advanced Worker" for the purpose of awarding other competition titles and rewards;
c) For individuals transferred to new positions, the new unit is responsible for assessing competition titles, and if they worked at the previous unit for six months or more, the new unit should seek feedback from the previous unit;
a) d) No competition assessment for newly hired individuals under ten months; those absent from work for forty days or more; and those disciplined with reprimand or worse.
Principles of competition are implemented in accordance with Clause 1 of Article 6 of the Law on Competition and Reward; Article 3 of Decree No. 42/2010/NĐ-CP of the Government, specifically as follows:
a) Voluntary, conscientious, transparent; ensuring a spirit of unity and cooperation for mutual development;
b) The granting of competition titles must be based on the results of the competition movement;

c) No competition assessment for individuals or collectives that have not registered for competition or have registered incorrectly or beyond the deadline.

a) Accurate, transparent, democratic, fair, and timely based on a correct evaluation of the work performance of collectives and individuals; reward forms must be commensurate with the achieved results, not necessarily rewarding lower-level forms before higher ones; achievements made under difficult conditions and with wide-ranging impact may be considered for higher-level rewards; a reward form can be awarded multiple times to the same recipient;
b) Combining spiritual encouragement with material incentives;

Heads of agencies and units specified in points a, b, c, d, đ Clause 1 Article 2 of this Circular shall proactively coordinate with peer-level mass organizations to direct and organize the launch and maintain regular competition movements within their jurisdiction; actively identify and select collectives and individuals with outstanding achievements for commendation or recommend to competent authorities for commendation.
4. Information, press, and publishing agencies under the Ministry of Education and Training, Departments of Education and Training, and educational institutions have the responsibility to regularly publicize competition and commendation work; disseminate and set examples of advanced models and good people and deeds in competition movements; combat and criticize violations of laws on competition and commendation within the education sector.
Article 5. Rights and responsibilities of individuals and collectives receiving commendation
1. Individuals who are awarded titles of excellence and forms of commendation shall be granted certificates of merit, medals, certificates of recognition, and monetary or material rewards as prescribed; they shall enjoy preferential treatment regimes as stipulated by the Ministry of Home Affairs.
2. Article 6. Competition Groups and Clusters (Regions)
1. Annually at the beginning of the school year, based on guidelines from the Central Steering Committee for Competition and Commendation and directives on key tasks, the Minister of Education and Training shall issue documents to establish competition groups and clusters (regions), organizational forms, and methods of evaluation and assessment of competition activities. 2. 5. Functions and Tasks of Competition Groups and Clusters (Regions)
a) Organize the launch and signing of competition agreements to implement competition movements initiated by the Ministry, propose specific targets, contents, and measures to build strong, widespread, correct-oriented, and effective competition movements within the group and cluster (region);
b) Summarize and conclude competition movements, propose directions and tasks for organizing competition movements, exchange learning experiences to build exemplary models within the competition group and cluster (region);
c) Evaluate and rank units within the competition group and cluster (region) according to regulations; select and honor units with outstanding achievements in the first, second, and third places and report to the Steering Committee for Competition and Commendation in the sector for submission to the Minister for approval to award the "Flag of Excellence of the Ministry" and Certificates of Merit from the Minister; outstanding models in the first, second, third order and report to the Competition and Reward Council of the sector for the Minister's review and awarding of the "Ministry's Flag" and the Minister's Certificate of Merit;
d) Perform other tasks assigned by the Minister.
Chapter II
ORGANIZATION OF LAUNCHING COMPETITION MOVEMENTS FORMS AND STANDARDS OF COMPETITION TITLES
Article 7. Forms and contents of organizing competitive movements
1. The forms and contents of organizing competitive movements shall be implemented in accordance with the provisions of Article 6 and Article 7 of Decree No. 42/2010/NĐ-CP and Point 1, Section 1 of Circular No. 02/2011/TT-BNV.
2. Initiating competitive movements
a) Annually, the Minister initiates regular competitive movements, periodic competitive movements, or thematic competitive movements throughout the Education sector;
b) Heads of units under the Ministry, Directors of provincial education and training departments cooperate with educational trade unions at all levels based on the content of the competitive movement initiated by the Minister and specific conditions and characteristics of educational institutions to build and implement plans for regular competitive movements, periodic competitive movements, or thematic competitive movements aimed at individuals and collectives within their management scope;
c) The form of initiating competitive movements must be practical, diverse, and attractive to many participants; emphasis should be placed on propaganda about the content and significance of the competitive movement, promoting a sense of responsibility and self-awareness among officials, civil servants, employees, and workers. In cases where individuals or collectives exceed the set targets of the competitive movement plan, they shall be promptly recognized and rewarded.
Article 8. Registering commendation titles and signing competitive pledges
1. Agencies and units specified in Points a, b, and c Clause 1 Article 2 of this Circular organize for individuals and collectives to register for competition and submit their competition registration forms to the Ministry of Education and Training before January 31 each year for units evaluated annually, and before October 30 each year for units evaluated according to the academic year.

d) National Model Soldier.
2. Commendation titles for collectives include:
a) Advanced Labor Collective;
b) Excellent Labor Collective;
c) Flag of Excellence of the Ministry of Education and Training;
d) State Flag.
Article 10. Title of "Outstanding Worker"
1. General Standards
a) Completing assigned tasks well, achieving high productivity and quality;
b) Adhering well to internal regulations and policies of the agency or unit and the Party's guidelines and state laws; overcoming difficulties with a spirit to complete tasks; fostering unity, mutual assistance among colleagues; actively participating in competitive movements;
c) Actively studying to improve professional and vocational skills;
d) Having good morals and a healthy lifestyle.
2. Specific criteria for different categories
a) For teachers teaching in preschool education institutions, general education institutions, regular education institutions, vocational education institutions: Actively participating in competitive movements; having a sense of learning to improve professional and vocational skills; strictly implementing regulations on lesson preparation, student assessment, class promotion, and record management; effectively managing students, paying attention to educating individual students, helping students from difficult circumstances; being rated as good or higher according to the professional standards or as good or higher according to the principal standards, director standards of regular education centers;
b) For lecturers teaching in higher education institutions: Actively participating in competitive movements; fulfilling the quantity and content of knowledge of the course according to current regulations, teaching according to the schedule of the department or school; lectures ensuring accuracy and updating new scientific information and achievements, cultivating professional qualities for students; guiding students to complete term papers, major projects, graduation theses, and final projects on time;
c) For civil servants, employees, and workers in agencies and units: Completing assigned tasks well; having a spirit of mutual assistance among colleagues; actively studying politics, culture, professional and vocational skills; having a sense of improving working methods, administrative reform, and increasing labor productivity.
3. The title of "Outstanding Worker" is awarded annually.
Article 11. The title "Model Worker at the Grassroots Level"
1. General Standards
a) Achieve the title "Advanced Laborer";
b) Have an innovation in technical improvement or a work solution, or apply a new process to reform administrative procedures, increase labor productivity, enhance the effectiveness of work for the agency or unit recognized by the competent authority's Scientific and Technological Innovation Review Board, or be the main author of a scientific research topic from the grassroots level that has been evaluated and accepted.
2. Specific criteria regarding innovations and improvements for different subjects
a) For kindergarten, primary, and secondary school teachers: Have an innovation or improvement to enhance teaching quality or student education, evaluated and ranked by the Science and Technological Innovation Board of the county's education sector or won an award in county-level best teacher competitions;
b) For teachers at educational institutions under the comprehensive management of the Department of Education and Training: Have an innovation or improvement to enhance teaching quality or student education, evaluated and ranked by the Science and Technological Innovation Board of the provincial education sector or won an award in provincial-level best teacher competitions;
c) For teachers at vocational education institutions: Have a technological innovation recognized by the School's Science and Technological Innovation Board and applied in practice or won an award in school-level best teacher competitions; applied in practice or won awards in teacher excellence competitions at school level or higher;
d) For lecturers teaching at higher education institutions: Have a technological improvement innovation or apply new technology in teaching to innovate content and methods, enhancing training effectiveness, or have a scientific research topic rated fairly or better by the School's Science and Technological Innovation Board and applied in training and production processes, yielding practical benefits, or won an award in school-level best lecturer competitions;
e) For civil servants, public officials, and workers in agencies and units: Have an innovation to improve work effectiveness rated fairly or better by the Agency's Science and Technological Innovation Board, or be the main author of regulatory legal documents ensuring quality and timely completion;
f) For managerial cadres at the head or deputy level: Meet the criteria set out in point d, Clause 2, Article 11 of this Circular, and the unit managed by such cadre must achieve the title "Advanced Labor Collective";
3. The title "Model Worker at the Grassroots Level" is awarded annually.
Article 12. The title "Model Worker at the Ministry Level"
1. The title "Model Worker at the Ministry Level" is awarded to individuals who meet the following criteria:
a) Have outstanding achievements, standing out among those who have continuously achieved the title "Model Worker at the Grassroots Level" three times consecutively up to the time of nomination;
b) Have an innovation or experience, or a work solution with significant positive impact on the activities of the sector recognized by the Ministry's Science and Technological Innovation Board, or be the main author of a Ministry-level scientific research topic evaluated and accepted by the Ministry's Science and Technological Innovation Board, or be the main author of regulatory legal documents with directive characteristics throughout the sector or win first, second, or third place in national best teacher competitions.
2. The title "Model Worker at the Ministry Level" is awarded annually.
Article 13. The title "National Model Worker"
1. The title "National Model Worker" shall be awarded to individuals who meet the following criteria:
a) Individuals who are outstanding among those who have consecutively received the title "Ministry-Level Model Worker" twice;
b) Having innovative ideas for improving technology or work solutions or scientific research topics that bring high efficiency and influence nationwide, recognized by the Ministry-Level Science and Technology Council, or leading national-level scientific research projects that have been evaluated and accepted, or drafting normative legal documents with high effectiveness throughout the industry.
2. The title "National Model Worker" shall be awarded annually.
Article 14. The title "Advanced Labor Collective"
1. The title "Advanced Labor Collective" shall be awarded to collectives meeting the following criteria:
a) Successfully completing assigned tasks and plans;
b) Having a regular, practical, and effective competition movement;
c) More than 50% of individuals within the collective have received the title "Model Worker" and there is no individual disciplined with a warning or higher;
d) Internal unity and strict adherence to the policies and laws of the Party and State.
2. The title "Advanced Labor Collective" shall be awarded annually.
Article 15. The title "Outstanding Labor Collective"
1. The title "Outstanding Labor Collective" shall be awarded from among advanced labor collectives meeting the following criteria:
a) Innovative, overcoming difficulties to excellently complete tasks, effectively performing assigned tasks;
b) There is a regular, practical, and effective competitive movement;
c) All individuals within the collective have completed their assigned tasks, including at least 70% of individuals receiving the title "Model Worker"; d) There is an individual who has received the title "Organizational Model Worker" and there is no individual disciplined with a warning or higher;
đ) Internal unity, exemplary compliance with Party policies and State laws;

Article 16. The Flag of Excellence of the Ministry of Education and Training
The Flag of Excellence of the Ministry of Education and Training shall be awarded annually based on the academic year or working year to outstanding labor collectives meeting the following criteria:
1. a) Exceeding set targets and completing assigned tasks excellently in the year; being a prominent and outstanding collective in the industry; b) Having new factors or models for other collectives to emulate;
c) Internal unity, actively innovating management, practicing thrift, combating waste, corruption, and other social evils.
2. Recognition of outstanding collectives to be awarded the "Flag of Excellence of the Ministry of Education and Training" shall be determined through evaluation, assessment, comparison, and recommendation within competition groups and regions organized by the Ministry of Education and Training.
a) For education and training departments, universities, academies, and colleges: Based on the results of annual competitive evaluations in various fields of work, the Ministry of Education and Training will specify the number and organize award ceremonies at the end-of-year summary meetings;
b) For early childhood education institutions, general education institutions, vocational education institutions, and continuing education institutions, and education and training departments: Based on the results of annual competitive evaluations in competition regions, the Ministry of Education and Training will award flags to leading units in each region;
c) Based on the actual situation each year, the specialized unit responsible for competitive activities and commendations will propose specific numbers of flags to be awarded to units in each competition group and region to the Minister of Education and Training for approval.
b) For preschool education institutions, general education institutions, vocational education institutions, continuing education institutions, and education and training departments: Based on the results of the annual competition assessment in clusters (regions), the Ministry of Education and Training stipulates the presentation of flags to leading units in each cluster (region);
c) Based on the actual situation annually, the specialized unit responsible for competition and reward work studies and proposes to the Minister of Education and Training to specify the number of flags to be awarded to units within each group, cluster (region).
Article 17. Merit Flag of the Government
1. The Merit Flag of the Government is awarded annually, according to the academic year or according to the working year for outstanding collectives among those meeting the following standards:
a) Achieving outstanding results, exceeding assigned targets and tasks in the year; being an exemplary outstanding collective nationwide;
b) Having new factors and models that serve as examples for the whole country to learn from;
c) Internal unity, leading in management innovation, thrift, waste prevention, anti-corruption, and other social evils;
2. Collectives eligible for the "Merit Flag of the Government" are selected from those eligible for the Merit Flag of the Ministry of Education and Training.
The number of recommendations for the Prime Minister to consider and award the "Merit Flag of the Government" shall be carried out in accordance with point d, Clause 2, Section I of Circular 02/2011/TT-BNV issued by the Ministry of Home Affairs.
Chapter III
FORMS AND CRITERIA FOR REWARDS
Article 18. Forms of Reward
The forms of reward are implemented in accordance with point 1, Section II of Circular 02/2011/TT-BNV issued by the Ministry of Home Affairs.
Article 19. Forms and Standards of National-Level Rewards
1. Forms of national-level rewards include: Orders, Medals of Friendship, State Honorary Titles, Ho Chi Minh Prize, State Prize, Certificates of Merit from the Prime Minister.
2. The standards for national-level rewards are implemented in accordance with Chapter III of the Law on Encouragement and Reward; Chapter III of Decree No. 42/2010/NĐ-CP dated April 15, 2010, providing detailed regulations and guidance on implementing certain provisions of the Law on Encouragement and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward.
Article 20. Forms and Standards of Rewards by the Ministry of Education and Training
1. Certificate of Merit from the Minister of Education and Training.
The criteria for the Certificate of Merit from the Ministry of Education and Training are implemented in accordance with Article 49 of Decree No. 42/2010/NĐ-CP dated April 15, 2010, issued by the Government.
2. Commemorative Medal "For the Cause of Education" is implemented in accordance with Decision No. 26/2005/QĐ-BGD&ĐT and 27/2005/QĐ-BGD&ĐT dated August 29, 2005, issued by the Minister of Education and Training regarding the issuance of the Commemorative Medal "For the Cause of Education" and the Regulations on Awarding.
3. Collectives and individuals outside the education sector who have made significant contributions to the development of education and training may be considered for awards upon recommendation by their managing units.
4. Large programs, projects, special topics, and competitions: Units responsible for developing plans and registering with the specialized unit for encouragement and reward under the Ministry of Education and Training in accordance with annual regulations.
Article 21. Certificate of Merit from the Head of the Agency or Unit
The Certificate of Merit from the Head of the Agency or Unit is a regular form of reward for collectives and individuals during the annual work summary or for specific topics and immediate recognition.
1. Criteria for regular rewards for collectives:
The Certificate of Merit from the Head of the Agency or Unit is given to collectives meeting the following criteria:
a) Completing tasks well;
b) Internal unity; effectively implementing grassroots democracy; organizing good competition campaigns;
c) Caring for the material and spiritual life of the collective; practicing thrift;
d) Fully implementing all policies and benefits for all members of the collective.
2. Criteria for regular rewards for individuals:
The Certificate of Merit from the Head of the Agency or Unit is given to individuals meeting the following criteria:
a) Completing tasks and civic duties well;
b) Having good moral qualities; being united and exemplary in adhering to Party guidelines and state laws;
c) Continuously studying to improve professional knowledge and skills.
3. The Head of the Agency or Unit considers rewarding collectives and individuals with outstanding achievements after concluding a campaign or competition initiated by the agency or unit, or recognized as exemplary people or deeds within the scope of the agency's or unit's activities, or achieving outstanding results. Regulations on assessing merit titles and forms of reward
Article 22. 1. Collectives and individuals who have registered for competition, achieved results and met the criteria for merit titles and forms of reward are eligible for merit titles and rewards. The assessment of merit titles and rewards at the end of the academic year or working year is conducted in the following sequence: assess merit titles first, then forms of reward; assess individuals first, then collectives; assess merit titles and forms of reward in ascending order (from Labor Pioneers, Model Soldiers at the grassroots level, Model Soldiers at the ministry, sector, provincial, municipal levels, to National Model Soldiers for individuals; Advanced Labor Collectives, Outstanding Labor Collectives, Merit Flags at the ministry, sector, provincial, municipal levels, Merit Flag of the Government for collectives; forms of reward include Certificates of Merit, Certificates of Merit at the ministry, sector, provincial, municipal levels, Certificates of Merit from the Prime Minister, Orders, Medals).
2. During the assessment of merit titles and forms of reward, the Encouragement and Reward Councils at all levels implement according to the regulations of their respective councils, recognizing merit titles and forms of reward or reviewing for recognition of merit titles and forms of reward for collectives and individuals with more than two-thirds of the total votes in favor (National Model Soldier title and State Honorary Title are implemented in accordance with Article 25 of this Circular).
AUTHORITY TO DECIDE, AWARD, PROCEDURES AND FILES
Chapter IV
RECOMMENDATION
1. Authority to decide on awarding merit titles and forms of national-level rewards: Orders, Medals of Friendship, "Ho Chi Minh Prize", "State Prize", State Honorary Titles, "Merit Flag of the Government", National Model Soldier title, and "Certificate of Merit from the Prime Minister" are implemented in accordance with Articles 77 and 78 of the Law on Encouragement and Reward. COMPETITION TITLES AND REWARD FORMS
Article 23. Authority to Decide on Bestowal of Merit Titles and Forms of Reward
2. The Minister of Education and Training decides:.
a) To present Certificates of Merit to collectives and individuals as specified in Clause 2, Article 2 of this Circular;
b) To present the "Merit Flag of the Ministry of Education and Training" to units as specified in points a, b, c, d, đ, e of Clause 1, Article 2 of this Circular;
b) Present the "Flag of Competition of the Ministry of Education and Training" to units specified in points a, b, c, d, đ, e of Clause 1, Article 2 of this Circular;
c) Recognize the title "Advanced Worker", "Model Worker at the Grassroots Level", "Advanced Labor Collective", "Outstanding Labor Collective", and "Ministry-Level Model Worker" for collectives and individuals specified in point a, Clause 1, Article 2 of this Circular;
d) Recognize the title "Outstanding Labor Collective" and "Ministry-Level Model Worker" for collectives and individuals specified in points b and c, Clause 1, Article 2 of this Circular;
e) Recognize the title "Ministry-Level Model Worker", propose to the Prime Minister to award the title "National Model Worker" and other forms of State-level commendation for collectives and individuals under Hanoi National University and Ho Chi Minh City National University;
3. The heads of units specified in points b and c, Clause 1, Article 2 of this Circular decide to present certificates of merit, recognize the titles "Advanced Worker" and "Model Worker at the Grassroots Level" for individuals and collectives within their management authority;
4. The Minister of Education and Training delegates to the Directors of Hanoi National University, Ho Chi Minh City National University, Thai Nguyen University, Hue University, Da Nang University, and the General Director of Vietnam Educational Publishing House:
a) Examine and recognize the title "Outstanding Labor Collective" for collectives specified in point e, Clause 1, Article 2 of this Circular under their management;
b) Report on the process of presenting awards to the unit responsible for commendation and reward under the Ministry of Education and Training before July 31 each year for Hanoi National University, Ho Chi Minh City National University, Thai Nguyen University, Hue University, Da Nang University; before March 1 each year for Vietnam Educational Publishing House; the report includes: Minutes of review and decision recognizing the title "Outstanding Labor Collective"; specialized in competition and reward affairs under the Ministry of Education and Training as stipulated annually. 5. Collectives and individuals specified in points d and e, Clause 1, Article 2 of this Circular shall implement according to Articles 79 and 80 of the Law on Commendation and Reward; Article 24. Organization of awarding commendation titles and reward forms;
Ceremony for presenting State-level rewards
shall be carried out in accordance with the Government's regulations on State ceremony procedures for organizing rallies, commemorative ceremonies, and presenting and receiving State honors, Orders, Medals, "Flag of Competition of the Government", Certificates of Merit from the Prime Minister;

Titles of Heroic Laborer, "Ho Chi Minh Award", "State Award", commendation titles and reward forms at the State level: "Flag of Competition of the Government", Certificate of Merit from the Prime Minister, National Model Worker, after receiving notification of the Decision on commendation from the Standing Committee of the Competition and Reward Council of the sector, the head of the unit shall develop a plan to organize the reception and submit it to the Minister. After receiving instructions from the Minister, the specialized unit for competition and reward work will coordinate with other units to organize the presentation;
4. The heads of agencies and units present commendation titles and reward forms within their authority;
5. The organization of presenting commendation titles and reward forms should be solemn, practical, avoiding ostentatious formalism and waste. Such presentations can be combined with the summary of unit or sector work or integrated into other unit activities to save time and costs.

Article 27. Procedures for proposing consideration for the title "Flag of Competition of the Ministry of Education and Training", and the Minister's Certificate of Merit of the Minister of Education and Training
1. Objects specified in points a, b, c of Clause 1, Article 2 of this Circular: After receiving the file, the specialized unit responsible for competition and reward work reviews the file, submits it to the Competition and Reward Council of the Ministry for comments before submitting to the Minister for decision.
2. For objects specified in points d, đ of Clause 1, Article 2 and point b of Clause 2, Article 2 of this Circular: The head of the directly related unit prepares a proposal (with a list and performance report) requesting the Ministry of Education and Training to reward, sent to the specialized unit responsible for competition and reward work for review, submitted to the Competition and Reward Council of the Ministry for examination and submitted to the Minister for decision.
Article 28. Report on Achievements for Award Recommendation
1. The report on achievements for award recommendation must closely adhere to the criteria for recommendation, ensuring that the content and form of the report are appropriate for each type of award. 2. If a collective or individual is recommended for an award based on certain criteria, the report on achievements should be prepared according to those criteria. The application dossier for awards must correspond to the form of the award. The report must contain sufficient grounds to compare with the standards stipulated in the Law on Competition and Commendation, Decree No. 42/2010/NĐ-CP, Circular No. 02/2011/TT-BNV, and this Circular.
3. Specific provisions regarding the report on achievements are as follows:
a) For Orders, Medals, Heroic Labor Titles, Prime Minister's Flag of Excellence, and Prime Minister's Certificates of Merit, National Model Workers: Not exceeding 12 pages A4;
b) For Model Workers at the Grassroots Level, Ministry-Level Model Workers, Outstanding Labor Collectives, Ministry of Education and Training's Flag of Excellence, and Minister's Certificates of Merit: Not exceeding 4 pages A4.
Article 29. Endorsement for Awards
1. The Ministry of Education and Training shall implement endorsements for awards based on the recommendations of the Central Steering Committee for Competition and Commendation.
2. Upon receiving the official letter recommending awards from the Central Steering Committee for Competition and Commendation, the specialized unit responsible for competition and commendation work shall seek opinions from relevant units, draft the endorsement document, submit it for review and decision by the Deputy Minister in charge.
Line of Examination for Commendation and Awards
Article 30.. 1. The level that initiates the competition drives selects outstanding individuals and collectives to recognize competition titles and awards or recommends higher levels to recognize competition titles and make award decisions. Examination process

4. Heads of units falling within the scope defined in point d, e, Clause 1, Article 2 of this Circular are responsible for awarding according to their authority and submitting to the Chairman of the People's Committee of provinces and centrally-administered cities, ministries, central agencies in accordance with the Law on Competition and Commendation, Decree No. 42/2010/NĐ-CP dated April 15, 2005 of the Government, and other regulations issued by provincial People's Committees, ministries, and central agencies.
Recommendation for the award of the Minister of Education and Training's Certificate of Merit, Ministry of Education and Training's Flag of Excellence, and Commemorative Medal "For the Cause of Education".
5. The Director of the International Cooperation Department is responsible for implementing procedures as prescribed and coordinating with the specialized unit for competition and commendation work to examine and submit to the Minister for decision on awards for organizations and individuals from foreign countries who have made outstanding contributions to the education sector. 6. Trade Unions at all levels and full-time trade union cadres funded by the trade union budget at all levels under the trade union system shall implement the granting of competition titles and award forms in accordance with the guidelines of the Vietnam Education Union.
5. The Director of the International Cooperation Department is responsible for implementing procedures as prescribed and coordinating with the specialized unit responsible for competition and reward work to examine and submit to the Minister for decision regarding commendations for foreign organizations and individuals who have made outstanding contributions to the education sector.
6. Trade Union levels and full-time trade union officers funded from the trade union budget at all levels within the trade union system implement the granting of commendation titles and reward forms according to the guidelines of the Vietnam Teachers' Trade Union.
Article 31. Application for Awards
1. The application for awards shall be implemented in accordance with the provisions from Article 53 to Article 65 of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing certain provisions of the Law on Competition and Rewards and the Law Amending Certain Provisions of the Law on Competition and Rewards, and Appendix attached to Circular No. 02/2011/TT-BNV dated January 24, 2011 of the Ministry of Home Affairs guiding the implementation of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government.
2. Application for recognition of titles and national-level rewards
a) The application for recognition of titles and national-level rewards shall be implemented in accordance with the provisions of Articles 53, 54, 55, 56, 57, 58, 59, and 60 of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government;
b) The number of applications sent to the Ministry of Education and Training shall exceed one set compared to the number specified in Circular No. 02/2011/TT-BNV;
3. Application for recognition of titles and reward forms by the Minister
a) Petition, meeting minutes of the Council, list of collectives and individuals proposed;
b) Report on achievements proposing rewards for collectives and individuals;
c) Photocopies (no notarization required) of documents recognizing innovations, experiences, solutions, research topics: At the grassroots level for individuals proposed for the title "Grassroots Model Worker"; at the Ministry level for individuals proposed for recognition of the titles "Ministry Model Worker" and "National Model Worker"; The number of applications sent to the Ministry of Education and Training is one set.
4. Simplified application procedures for outstanding achievements
a) Petition proposing commendation from the head of the unit;

recognizing "Outstanding Labor Collective", "Ministry Model Worker", and awarding the Certificate of Merit of the Minister of Education and Training shall be submitted to the specialized unit responsible for competition and reward work before August 15 each year for units evaluated based on the academic year, before January 30 each year for units evaluated based on the working year;b) Applications for awarding Orders, Certificates of Merit of the Prime Minister, "Flag of Excellence" of the Government, and conferring the title of "National Model Worker" shall be submitted to the Ministry before September 30 each year, for units evaluated based on the working year, no later than March 30 each year;
c) Applications for awarding titles and reward forms for the subjects specified in point a and c of Clause 1 of Article 2 of this Circular shall be submitted to the competition and reward unit under the Ministry of Education and Training before December 31 each year. Education and Training Article 32. Receipt, Review, and Management of Records of Applications
1. Educational institutions and units shall submit complete applications within the prescribed time limit. The time for reviewing applications by the specialized unit responsible for competition and reward work is as follows:
a) For rewards issued by the Ministry of Education and Training, the review period is 15 working days from the date of receipt of all required documents;
b) For regular national-level commendations, the review period is 20 working days from the date of receipt of all required documents.
c) Providing technical assistance to provinces and centrally administered cities under their jurisdiction in developing local technical standards on clean water quality.Management of competition and reward records
a) Record management at the Ministry of Education and Training: The competition and reward unit under the Ministry of Education and Training is responsible for managing applications for titles and reward forms within the authority of the Minister and national-level titles and reward forms;
b) Record management at units: Units are responsible for organizing the management of all records related to competition and reward work within their units;
4. c) Encouragement of agencies and units to apply information technology in the management of competition and reward records at various levels.
5. Archiving of competition and reward records specialized in competition and reward affairs under the Ministry of Education and Training as stipulated annually. Specialized units responsible for competition and reward work are responsible for compiling statistics and records on competition and reward work, and submitting them for archiving in accordance with current regulations. c) Managing files at units: Units are responsible for organizing the management of all files related to competition and reward work of the unit;

Specialized units responsible for competition and reward work are responsible for compiling and establishing files on competition and reward work, submitting them for archiving according to current regulations. COMPETITION AND REWARD COUNCIL, SCIENCE COUNCILS AT ALL LEVELS
Chapter V
a) Chairman: Head of the unit;
Article 33. The Competition and Reward Council of the Education Sector
1. The Competition and Reward Council of the Education Sector shall be established by the Minister of Education and Training to perform advisory functions and assist the Minister in matters related to competition and reward activities within the Education Sector.
2. The Competition and Reward Council of the Education Sector shall have the following specific tasks and powers:
a) Assist the Minister of Education and Training in organizing, launching, guiding, and directing the implementation of competitions and movements initiated by the Party, State, and Sector to develop strongly, widely, correctly, and effectively; promote exemplary models and good deeds throughout the sector;
b) Select collectives and individuals with outstanding achievements in the competition movement of the Education Sector for the Minister to decide on recognizing and awarding commendations and rewards within the Minister's authority, or to submit to competent authorities for consideration and decision on rewards;
c) Examine and propose advice to the Minister to resolve complaints, denunciations, and suggestions regarding competition and reward activities within the Education Sector; examine and propose the Minister to decide on revoking or requesting competent authorities to revoke reward decisions in cases where violations of competition and reward regulations are discovered.
3. The Council consists of the following members:
a) Chairman of the Council: The Minister of Education and Training;
b) Vice Chairmen of the Council: Deputy Ministers responsible for competition and reward work as the Permanent Vice Chairman; the Chairman of the Vietnam Education Union;
c) Council member兼任秘书的委员:负责部教育和培训部表彰奖励工作的单位负责人; specialized in competition and reward affairs under the Ministry of Education and Training as stipulated annually. d) Council members: Deputy Ministers; Heads of Departments, Bureaus, Offices, and Inspectors General; Directors of the Ministry's representative offices in Ho Chi Minh City.
4. The organization and operation of the Competition and Reward Council of the Education Sector shall be carried out according to specific provisions of the Minister of Education and Training. Article 34. The Competition and Reward Council at the Base Level and the Foundation Level
1. The Competition and Reward Councils of the Hanoi National University, Ho Chi Minh City National University, Thai Nguyen University, Hue University, Da Nang University, and the Vietnam Education Publishing House (referred to as the Council at the base level)
a) The Competition and Reward Council at the base level shall be established by the Directors of the aforementioned units;
b) The Competition and Reward Council at the base level shall have the function of advising the unit leaders in organizing, guiding, and directing competition movements within their units; awarding commendation titles and reward forms to collectives and individuals under their management, and submitting to the Competition and Reward Council of the Education Sector for review and submission to the Minister for decision on awarding commendation titles and reward forms within the Minister's authority; submitting to the State for rewarding and recognizing national commendation titles. c) The composition of the Council includes
- Chairman of the Council: Unit leader;
- Vice Chairman of the Council: Deputy leader responsible for competition and reward work; the Chairman of the unit's trade union;
- Council member兼任秘书的委员:负责该单位表彰奖励工作的单位负责人或被指派负责表彰奖励工作的干部;
- Council members: Deputy leaders of the unit, representatives of member unit leadership, representatives of the Party Committee, representatives of the Communist Youth Union Ho Chi Minh, and key cadres of the unit selected and decided by the unit leader.
2. The Competition and Reward Council at the grassroots level is the Council of the objects specified in points a, b, c, d, đ of Clause 1 of Article 2 of this Circular
a) The Competition and Reward Council at the grassroots level shall be established by the heads of agencies and units;
b) The Competition and Reward Council at the grassroots level shall perform advisory functions and assist agency and unit leaders in matters related to competition and reward activities within their fields of operation.
c) The Competition and Reward Council at the grassroots level has the following specific tasks and powers:
- Assist agency and unit leaders in organizing, guiding, and directing competition movements within their agencies and units to develop strongly, correctly, and effectively; identify and organize the promotion of exemplary models through competition movements;
- For units specified in point d, đ of Clause 1 of Article 2: Select collectives and individuals with outstanding achievements in the competition movement of their units for submission to the People's Committees of provinces (cities), Ministries, central agencies, and sectors for awarding commendation titles and rewards within their authority;
- For units specified in points a, b, c of Clause 1 of Article 2: Select collectives and individuals with outstanding achievements for submission to the Competition and Reward Council of the Education Sector for awarding commendation titles and rewards within the authority of the Ministry of Education and Training;
- Examine and submit to agency and unit leaders for resolution of complaints, denunciations, and suggestions regarding competition and reward; examine and submit to agency and unit leaders for decision on revoking or requesting competent authorities to revoke reward decisions in cases where violations of competition and reward regulations are discovered. 3. The establishment of the Competition and Reward Council at the grassroots level must be based on the organizational structure and number of officials and civil servants in agencies and units. The number of members of the Competition and Reward Council at the grassroots level shall be seven or more members with the following composition:
a) Chairman: Unit leader;
b) Vice Chairman: Deputy leader responsible for competition and reward work, the Chairman of the unit's trade union;
c) Council member兼任秘书的委员:被指派负责单位表彰奖励工作的干部;
d) Council members: Deputy leaders of the unit, representatives of the Party Committee, representatives of the Communist Youth Union Ho Chi Minh, and key cadres of the unit selected and decided by the unit leader.

c) Secretary Member: Officer assigned to handle competition and reward work of the unit;
d) Members: Deputy Heads of the unit, representatives of the Party Committee, the Ho Chi Minh Communist Youth Union, and key officers of the unit appointed by the Head of the unit.
d) Members: Deputy heads of the unit, representatives of the Party committee, representatives of the Ho Chi Minh Communist Youth Union, and key officials of the unit selected and decided by the head of the unit.
Article 35. Scientific and Innovative Council
1. Authority to establish the Council
a) The Minister of Education and Training decides to establish the Scientific and Innovative Council of the Ministry of Education and Training.
b) The heads of entities specified in points b and c, Clause 1, Article 2 of this Circular decide to establish the Scientific and Innovative Council at the grassroots level.
2. Duties of the Council
At all levels, the Scientific and Innovative Council has the responsibility to examine, appraise, and recognize technical improvements, work solutions, research topics, or the application of new technology. The Council operates according to regulations issued by the entity establishing the Council, in compliance with laws on science and technology. establish the Council in accordance with the provisions of laws on science and technology.
3. The Council consists of the following members:
a) Members who have professional management expertise, technical skills, and the ability to evaluate and appraise innovations or solutions in management and implementation tasks of the agency or unit;
b) In cases where necessary, the Council may invite some experts, scientists, or managers to participate but they are only allowed to express opinions and do not have voting rights at Council meetings.
4. The evaluation results of the Scientific and Innovative Councils at all levels serve as the basis for the Commendation and Reward Council at the same level to consider and propose commendations for individuals; the time for examining, appraising, and recognizing technical improvements, work solutions, research topics, or the application of new technology shall be as follows:
a) For pre-school, primary, secondary, and vocational education institutions, it must be completed before May 31 each year; for higher education institutions, it must be completed before July 15 each year;
b) For units evaluated based on their annual performance, it must be completed before November 30 each year.
Chapter VI
FUND FOR COMPETITION AND REWARD
Article 36. Sources and Levels of Deduction for the Commendation and Reward Fund
1. The Commendation and Reward Fund is formed from:
a) State budget funds;
b) Contributions from individuals and organizations within and outside the country for the purpose of commendation and reward;
c) Other lawful sources (if any).
2. Levels of deduction:
a) Annually, the Ministry of Education and Training implements the establishment of the Commendation and Reward Fund from the state budget, with a maximum amount equal to 20% of the total salary for position, rank, grade, or rank of the number of officials, civil servants, and employees within the establishment and approved wages for the entire year;
b) For educational institutions: Implement according to Clauses 5 and 6, Article 3 of Circular No. 71/2011/TT-BTC dated May 24, 2011, of the Ministry of Finance guiding the establishment, management, and use of the Commendation and Reward Fund under Decree No. 42/2010/NĐ-CP dated April 15, 2010, of the Government detailing certain provisions of the Law on Commendation and Reward.
Article 37. Use of the Commendation and Reward Fund
The Commendation and Reward Fund of the Ministry of Education and Training is used for the following purposes:
1. Printing certificates, awards, medals; making commemorative plaques, flags of excellence, award frames, and medal boxes; writing certificates, awards, and medals;
2. Spending money or giving commemorative gifts to collectives and individuals;
3. Allocating 20% of the total Commendation and Reward Fund for organizing and directing incentive movements;
4. The provision of monetary rewards or equivalent value items stipulated in Articles 70, 71, 72, 73, 74, 75, and 76 of Decree No. 42/2010/NĐ-CP shall be applied according to Clause 2, Article 68 of Decree No. 42/2010/NĐ-CP.
Article 38. Management of the Competition and Reward Fund
The Competition and Reward Fund of the Education sector shall be managed by the Office of the Ministry of Education and Training; the source, ratio, and rate of deduction shall be based on the budget plan; the settlement shall be based on actual expenditures in accordance with the provisions of the law.
Chapter VII
IMPLEMENTING PROVISIONS
Article 39. Implementation Organization
1. Heads of units under the Ministry, Directors of provincial education and training departments, Leaders of competition and reward groups/clusters (regions) shall be responsible for organizing and implementing this Circular.
Competition and Award Council of the Education Sector specialized in competition and reward affairs under the Ministry of Education and Training as stipulated annually. of competition and reward under the Ministry of Education and Training shall urge, monitor, and inspect the implementation of this Circular throughout the sector, regularly reporting the results of the implementation of the Circular guiding to the Chairman of the Competition and Reward Council of the Ministry of Education and Training.
3. Educational inspectors shall cooperate with units performing competition and reward work at the same level: Within their functions, tasks, and authorities assigned, they shall conduct inspections on competition and reward work in the education sector, advising the Minister to promptly resolve violations, complaints, and denunciations regarding competition and reward in accordance with the law.
Article 40. Effective Date
This Circular takes effect from May 18, 2012, and replaces Circular No. 21/2008/TT-BGDĐT dated April 22, 2008, issued by the Minister of Education and Training guiding competition and reward work in the education sector.
Article 41. Responsibility for Implementation
The Head of the Office of the Ministry, Heads of units under the Ministry of Education and Training, Chairmen of Provincial People's Committees directly under the Central Government; Heads of management agencies of educational institutions; agencies, units, and individuals related to this matter are responsible for enforcing this Circular./.
