BASED ON THE LAW ON TRAFFIC ON ROADS 2008;

Pursuant to DecreeNo. Decision No. 77/2009/NĐ-CP dated September 15, 2009 on functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director General of the Police Traffic Safety Administration THE HEAD OF THE MINISTRY’S OFFICE, THE HEAD OF THE MINISTRY’S INSPECTION DEPARTMENT, THE HEADS OF THE DEPARTMENTS, THE DIRECTOR OF THE VIETNAM CIVIL AVIATION ADMINISTRATION, THE CHIEF EXECUTIVE OFFICER OF THE VIETNAM AIRPORTS CORPORATION - CPTP, AND THE HEADS OF THE AUTHORITIES, ORGANIZATIONS, AND INDIVIDUALS CONCERNED ARE RESPONSIBLE FOR IMPLEMENTING THIS CIRCULAR./. under the Ministry of Public Security;

The Ministry of Public Security issues this Circular amending and supplementing Clause 3 of Article 20 of Circular No.No. 36/2010/TT-BCA dated October 12, 2010 quuoting on vehicle rintention vehicles,

Article 1. Amending and supplementing Clause 3 of Article 20 of Circular No. 36/2010/TT-BCA dated October 12, 2010 on vehicle registration

Amending and supplementing Clause 3 of Article 20 of Circular No. 36/2010/TT-BCA dated October 12, 2010 on vehicle registration as follows:

"3. Handling vehicle registration for cases where vehicles have been registered and transferred through multiple owners

From April 15, 2013 to December 31, 2014, handling vehicle registration for cases where vehicles have been registered and transferred through multiple owners shall be carried out as follows:

3.1. Documents for transferring vehicle registration

3.1.1. Transferring vehicle registration within the same province

- In the case where the person currently using the vehicle has transfer documents from the owner named in the vehicle registration certificate and the final seller's transfer document, the documents include:

+ Application for vehicle registration transfer and movement (in accordance with the form issued together with this Circular) with a commitment from the person currently using the vehicle to bear responsibility before the law for the vehicle being processed for registration, accompanied by confirmation of the current residence address of the person currently using the vehicle by the police station (hereinafter referred to as the local police station) where the person currently using the vehicle resides.

+ Proof of payment of stamp duty on the vehicle according to regulations.

+ Transfer documents from the owner named in the vehicle registration certificate and the final seller's transfer document.

+ Vehicle registration certificate and license plate (if the vehicle registration certificate or license plate is lost, the reason must be clearly stated in the application for vehicle registration transfer).

- In the case where the person currently using the vehicle does not have transfer documents for the vehicle, the documents include:

+ Application for vehicle registration transfer and movement (in accordance with the form issued together with this Circular) with a commitment from the person currently using the vehicle to bear responsibility before the law for the vehicle being processed for registration, accompanied by confirmation of the current residence address of the person currently using the vehicle by the local police station where the person currently using the vehicle resides.

+ Proof of payment of stamp duty on the vehicle according to regulations.

+ Vehicle registration certificate and license plate (if the vehicle registration certificate or license plate is lost, the reason must be clearly stated in the application for vehicle registration transfer).

3.1.2. Transferring vehicle registration and moving the vehicle from one province to another

The process of transferring vehicle registration (place of departure) shall be carried out as follows: 

- In the case where the person currently using the vehicle has transfer documents from the owner named in the vehicle registration certificate and the final seller's transfer document, the documents include:

+ Application for vehicle registration transfer and movement (in accordance with the form issued together with this Circular) with a commitment from the person currently using the vehicle to bear responsibility before the law for the vehicle being processed for registration, accompanied by confirmation of the current residence address of the person currently using the vehicle by the local police station where the person currently using the vehicle resides.

+ Transfer documents from the owner named in the vehicle registration certificate and the final seller's transfer document.

+ Vehicle registration certificate and license plate (if the vehicle registration certificate or license plate is lost, the reason must be clearly stated in the application for vehicle registration transfer).

- In the case where the person currently using the vehicle does not have transfer documents for the vehicle, the documents include:

+ Application for vehicle registration transfer and movement (in accordance with the form issued together with this Circular) with a commitment from the person currently using the vehicle to bear responsibility before the law for the vehicle being processed for registration, accompanied by confirmation of the current residence address of the person currently using the vehicle by the local police station where the person currently using the vehicle resides.

+ Vehicle registration certificate and license plate (if the vehicle registration certificate or license plate is lost, the reason must be clearly stated in the application for vehicle registration transfer).

The vehicle registration documents (place of arrival) include: 

- Application for vehicle registration transfer and movement (in accordance with the form issued together with this Circular) with a commitment from the person currently using the vehicle to bear responsibility before the law for the vehicle being processed for registration, accompanied by confirmation of the current residence address of the person currently using the vehicle by the local police station where the person currently using the vehicle resides.

- Proof of payment of stamp duty according to regulations.

- Transfer and movement form, accompanied by the original vehicle documents.

3.2. Responsibilities of the vehicle registration authority

3.2.1. In the case of processing vehicle registration transfer within the same province

- For the case where the person currently using the vehicle has transfer documents from the owner named in the vehicle registration certificate and the final seller's transfer document:

+ The vehicle registration authority receives the vehicle registration transfer documents, checks that all required procedures are complete, and writes a notice for the user of the vehicle.

+ Within two working days from the date of receiving complete and valid documents, the vehicle registration authority must issue license plates and vehicle registration certificates to the person currently using the vehicle.

- For the case where the person currently using the vehicle does not have transfer documents for the vehicle:

+ The vehicle registration authority receives the vehicle registration transfer documents, checks that all required procedures are complete, collects the vehicle registration certificate and license plate; writes a notice for the user of the vehicle. The notice is signed by the leader of the vehicle registration authority, stamped, and has a validity period of 30 days for the user to continue using the vehicle while waiting for the vehicle registration authority to provide results.

+ The vehicle registration authority sends a notification to the owner named in the vehicle registration certificate and publicly posts it at the office of the vehicle registration authority, searches the stolen vehicle database and registration data.

+ After 30 days from the date of sending the notification and public posting, the vehicle registration authority issues license plates and vehicle registration certificates to the person currently using the vehicle.

3.2.2. In the case of processing vehicle registration transfer and movement from one province to another

- The vehicle registration authority where the vehicle registration transfer and movement procedures are processed receives the documents, checks that all required procedures are complete, retains the documents, and processes them as follows: 

+ If the vehicle registration transfer and movement documents contain transfer documents from the owner named in the vehicle registration certificate and the final seller's transfer document, then the transfer and movement procedures are processed according to regulations. Within two working days from the date of receiving complete and valid documents, the vehicle registration authority must complete the vehicle registration transfer and movement procedures for the user of the vehicle.

+ If the vehicle registration transfer and movement documents do not contain the required transfer documents, a notice is written and the vehicle registration transfer and movement procedures for the user of the vehicle are processed. The notice is signed by the leader of the vehicle registration authority, stamped, and has a validity period of 30 days for the user to continue using the vehicle while waiting for the vehicle registration authority to process the vehicle registration transfer and movement procedures. The vehicle registration authority sends a notification to the owner named in the vehicle registration certificate and publicly posts it at the office of the vehicle registration authority, searches the stolen vehicle database and registration data. After 30 days from the date of sending the notification and public posting, the vehicle registration authority processes the vehicle registration transfer and movement procedures according to regulations.

- The vehicle registration authority where the person currently using the vehicle is registered receives the documents, checks that all required procedures are complete, inspects the actual vehicle to ensure it matches the vehicle registration transfer and movement documents, and issues license plates and vehicle registration certificates to the person currently using the vehicle. Within two working days from the date of receiving complete and valid documents, the vehicle registration authority must complete the issuance of license plates and vehicle registration certificates for the person currently using the vehicle.

3. 3. Responsibilities of the person currently using the vehicle

The person using the vehicle who declares the application for transferring ownership and moving the vehicle shall commit to bear legal responsibility for the vehicle when registering it (in accordance with the model issued together with this Circular) and go to the police station at their place of permanent residence registration to obtain confirmation of their place of permanent residence registration; pay the stamp duty at the tax authority; submit the vehicle registration application to the vehicle registration authority (if transferring ownership and moving from one province to another, they must submit the application to the vehicle registration authority specified in the vehicle registration certificate; after withdrawing the original file, they shall submit the vehicle registration application to the vehicle registration authority at their place of permanent residence registration).

3.4 Responsibilities of the Police Station at the Commune Level

- Receiving the declaration for transferring ownership and moving the vehicle with the commitment to bear legal responsibility for the vehicle during the registration process from the person using the vehicle.

- Checking and verifying the place of permanent residence registration of the person using the vehicle. After checking and verifying, if correct, confirm the place of permanent residence registration of the person using the vehicle. The processing time shall not exceed three working days.

Article 2. Effective Date

This Circular takes effect from April 15, 2013.

Article 3. Responsibility for Implementation

The Director of the General Administration of Public Order and Social Security under the Ministry of Public Security shall be responsible for directing, inspecting, and guiding the police units and localities to implement this Circular.

The Directors of the General Administrations, heads of units directly under the Ministry of Public Security, Provincial Police Chiefs, Chief of the Fire Prevention and Fighting Department shall be responsible for implementing this Circular.

During the implementation of this Circular, if any difficulties arise, the police units and localities shall report to the Ministry of Public Security (through the General Administration of Public Order and Social Security) for timely guidance.
