Based on the Inspection Law dated November 15, 2010;
Pursuant to the Law on State Budget dated December 16, 2002;
Pursuant to Decree No. 07/2012/NĐ-CP dated February 9, 2012 of the Government on agencies assigned to perform specialized inspection functions and the activities of specialized inspections;
At the proposal of the Minister of Finance;
The Prime Minister issues this Decision to provide for the allowance system for specialized inspection civil servants,
Article 1. Scope of Regulation
This Decision provides for the allowance system for persons assigned to perform specialized inspection tasks who are civil servants within the establishment of agencies assigned to perform specialized inspection functions (hereinafter referred to as specialized inspection civil servants).
Article 2. Applicability
1. Agencies assigned to perform specialized inspection functions in accordance with the provisions of the law.
2. Specialized inspection civil servants.
2. Industrial emission testing must ensure timeliness, accuracy, objectivity, compliance with procedures, and adherence to legal provisions.
The allowance for specialized inspection civil servants shall be calculated based on the actual number of days performing inspection tasks as stipulated in the inspection decision or the decision assigning civil servants to conduct independent inspections issued by the competent authority.
Article 4. Level of Allowance
The allowance for specialized inspection civil servants is VND 80,000 per day.
Article 5. Source of Funds
The funds to implement the provisions of this Decision shall be guaranteed from the state budget according to the current budget decentralization and other lawful sources of support (if any), allocated by the competent authority in the annual state budget expenditure plan of the agency or unit in accordance with the laws on the state budget.
Article 6. Management, utilization, and settlement of funds
The preparation, implementation, accounting, and settlement of state budget funds for the allowance system for specialized inspection civil servants as provided in this Decision shall be carried out in accordance with the laws on the state budget. Some specific provisions are as follows:
1. After completing the specialized inspection, based on the inspection decision, inspection logbook, attendance sheet, the inspection team or individual specialized inspection civil servants conducting independent inspections shall prepare a detailed list of the actual number of days performing inspection tasks, confirmed by the head of the inspection team or the authority issuing the inspection decision for independent inspections, to be submitted to the finance department as the basis for payment from the non-self-financing budget allocation in the annual plan;
2. The allowance for specialized inspection civil servants performing specialized inspection tasks as provided in this Decision shall be paid by the agency or unit issuing the inspection decision;
3. For inter-agency inspection teams, the leading agency of the inter-agency inspection team shall pay the allowance to the specialized inspection civil servants participating in the team.
Article 7. Implementation Provisions
1. This Decision takes effect from April 1, 2014.
2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees directly under the Central Government, Heads of agencies assigned to perform specialized inspection functions, and Heads of related agencies are responsible for implementing this Decision./.
