Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;

Pursuant to the Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Provincial People's Committees set specific pricesaWhen in agreement with the Minister of Foreign Affairs and the Minister of Public Security, the Circular stipulating the list of state secrets of the Confidential level for the foreign affairs sector shall be issued as follows:

Article 1. The list of state secrets of the Confidential level for the foreign affairs sector includes information and documents within the following scope:

1. Reports, programs, regular plans; case reports, special topic reports related to the world and regional political, security, economic situation, diplomatic work, industry construction, and other works of the Ministry of Foreign Affairs that have not been or will not be published.

2. Petitions to resolve tasks and instructions on handling and resolving issues recorded on petitions by the leadership of the Ministry of Foreign Affairs concerning matters included in the list of state secrets of the Confidential level as prescribed in this Article.

3. Plans for sending high-level delegations or delegations with special characteristics that have not been or will not be published.

4. Political proposals and reports on the results of welcoming high-level delegations from foreign countries or international organizations, delegations with special characteristics visiting Vietnam; political proposals and reports on the results of high-level delegations led by the Party and State or delegations with special characteristics from our side visiting abroad or attending international conferences that have not been or will not be published.

5. Contents of external exchanges and contacts of foreign affairs officials with representatives of foreign diplomatic missions and international organizations regarding sensitive and important issues that have not been or will not be published.

6. Negotiation strategies, documents related to negotiation preparation, and negotiation contents of international treaties between Vietnam and other countries, international organizations that have not been published (excluding documents classified as Top Secret or Absolute Secret).

7. Research materials and results of scientific research projects on issues included in the list of state secrets of the Confidential level as prescribed in this Article or those of significant importance directly related to the formulation of foreign policy by the Party and State.

8. Research materials and results of scientific research projects on determining and managing territorial boundaries that have not been or will not be published. Plans for organizing research, investigation, and surveying in disputed border areas.

9. Cooperation and coordination agreements between the Ministry of Foreign Affairs and other Ministries, agencies that have not been or will not be published.

10. Proposals regarding the establishment or withdrawal of Vietnam's representative offices abroad or the establishment, suspension of diplomatic relations between Vietnam and other countries; joining or withdrawing from international organizations that have not been published.

11. Personnel files and documents about key officials of the foreign affairs sector currently holding positions or expected to be recommended for positions at the Department level or higher; documents about recruitment, training, appointment, planning, personnel arrangement, dispatching officials for terms of service or disciplinary actions that have not been published; conclusions of competent authorities regarding the verification and review of personnel recruited to work at the Ministry of Foreign Affairs, diplomats dispatched for terms of service and long-term study abroad.

12. Inspection and audit documents; inspection and audit conclusions that have not been published; results of handling complaints and denunciations regarding issues included in the list of state secrets.

13. Documents on design and technical specifications of the foreign affairs sector's computer systems; internal network managed databases; encryption keys, passwords, and conventions for ensuring information security and safety in the application of information technology in the foreign affairs sector.

14. Reports and petitions related to the resolution of state property abroad.

15. Design files and operational mechanisms of the Ministry of Foreign Affairs headquarters.

16. Objects carrying state secrets (USBs, CPUs, hard drives, notebooks...) containing information or texts included in the list of state secrets of the Confidential level.

17. Reports and other documents using information and documents included in the list of state secrets of the Confidential level from other agencies and organizations.

Article 2. Effective Date

This Circular takes effect from May 3, 2014, and replaces Circular No. 42/2009/TT-BCA dated July 3, 2009, of the Ministry of Public Security stipulating the list of state secrets of the Confidential level for the foreign affairs sector.

Article 3. Responsibility for Implementation

1. The Ministry of Foreign Affairs and the Ministry of Public Security are responsible for guiding and supervising the implementation of this Circular.

2. Ministries, ministerial-level agencies, government-affiliated agencies; provincial people's committees under central cities are responsible for implementing this Circular./.
