Regulations on emblem, flag, traditional flag, uniform,sample of Fisheries Inspector card and color of Fisheries Inspector vessels and boats

BASED ON THE DECREE NO. 199/2013/NĐ-CP OF NOVEMBER 26, 2013 OF THE GOVERNMENT PROVIDING FOR THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT;

Pursuant to Decree No. 102/2012/NĐ-CP dated November 29, 2012 of the Government on the organization and operation of Fisheries Inspection;

Animal Feed - Maximum Allowable Levels of Safety Indicators in Animal Feed and Raw Materials for Aquafeed Production.

The Minister of Agriculture and Rural Development issues this Circular to regulate the emblem, flag, traditional flag, uniform, sample of Fisheries Inspector card and color of Fisheries Inspector vessels and boats.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the emblem, flag, traditional flag, uniform, sample of Fisheries Inspector card and color of Fisheries Inspector vessels and boats belonging to the Fisheries Inspection force.

Article 2. Applicability

This Circular applies to the Fisheries Inspection force; organizations and individuals related to Fisheries Inspection activities.

Chapter II
EMBLEM, FLAG, TRADITIONAL FLAG, SAMPLE OF FISHERIES INSPECTOR CARD

Article 3. Emblem of Fisheries Inspector

1. The Fisheries Inspector emblem is circular, blue in color, with the phrase "VIETNAM FISHERIES INSPECTOR" in uppercase letters at the top, inside which is the emblem of the yellow star on red flag, below is the anchor image and the image of a ship cutting waves; the wave is stylized into a school of fish.

2. The sample of the Fisheries Inspector emblem is specified in Section 1, Appendix I attached herewith.

Article 4. Flag and traditional flag

1. The Fisheries Inspector flag is made of blue fabric in an equilateral triangle shape, with the base length being two-thirds of the height, the two sides have a yellow border; in the middle of the flag is the Fisheries Inspector emblem, the outer edge of the emblem is white (the diameter of the emblem is two-thirds of the base length). The size of the flag is as follows:

a) The flag mounted on automobiles and boats has a base length of 28 cm;

b) The flag mounted on Fisheries Inspector vessels less than 50 meters in length has a base length less than 64 cm;

c) The flag mounted on Fisheries Inspector vessels 50 meters or longer has a base length of 80 cm;

d) The sample of the Fisheries Inspector flag is provided for in Section 2, Appendix I attached herewith.

2. The traditional flag of Fisheries Inspector is made of blue fabric in a rectangular shape, with a golden fringe along the left side; in the middle of the flag is the Fisheries Inspector emblem (the diameter of the emblem is half the width of the flag), the outer edge of the emblem is white, above the Fisheries Inspector emblem is the phrase "PROTECTING FISHERY RESOURCES" in uppercase letters and white color placed symmetrically.

The traditional flag of the Fisheries Inspection General Department has dimensions: Width 120 cm, Length 180 cm; below the Fisheries Inspector emblem is the phrase "FISHERIES INSPECTION GENERAL DEPARTMENT" in uppercase letters and white color placed symmetrically.

The traditional flag of the Fisheries Inspection Regional Office has dimensions: Width 100 cm, Length 150 cm; below the Fisheries Inspector emblem is the phrase "REGIONAL FISHERIES INSPECTION OFFICE ..." in uppercase letters and white color placed symmetrically.

The text on the flag is 1/10 (one-tenth) of the width of the flag in height.

The sample of the traditional flag is provided for in Section 3, Appendix I attached herewith.

Article 5. Sample of Fisheries Inspector Card

The Fisheries Inspector card is made of paper with a width of 6 cm and a length of 9 cm; it consists of two sides:

a) Front side with a red background, in the center is the National Emblem, above is the National Emblem of Vietnam "SOCIALIST REPUBLIC OF VIETNAM" in bold uppercase yellow letters, below is the phrase "FISHERIES INSPECTOR CARD" in bold uppercase yellow letters;

b) Back side with pink floral print, containing information about the person receiving the card, the date of issuance, and the issuing authority;

c) The sample of the Fisheries Inspector card is provided for in Section 4, Appendix I attached herewith.

Chapter III
FISHERIES INSPECTOR UNIFORM AND EQUIPMENT REGULATIONS, ISSUE PROCEDURES

Article 6. Uniforms of Fisheries Inspectors

The uniforms of Fisheries Inspectors include:

1. Winter and summer clothing:

a) Winter pants and shirts;

b) Summer pants and shirts;

c) Ceremonial attire (winter and summer);

d) Long-sleeved shirts;

đ) Transitional season shirts;

e) Winter warm shirts;

g) Women's skirts;

h) Underwear (short and long-sleeved).

2. Hats of Fisheries Inspectors:

a) Pi-shaped hats;

b) Soft hats;

c) Impact-resistant hats;

d) Ceremonial hats.

3. Other accessories:

a) Inspector badges;

b) Rank insignia;

c) Name plates;

d) Shoulder patches;

đ) Embroideries;

e) Rain suits;

g) Necktie;

g) Neckties;

h) Belts;

i) Leather shoes;

l) Socks;

k) Backstrap sandals;

m) Briefcases;

n) Workbooks;

o) Personal blankets;

p) Personal mosquito nets;

q) Face towels;

t) Personal mats;

s) Personal pillows;

r) Suitcases;

v) Protective work clothing.

Article 7. Materials and Specifications of Fisheries Inspectors' Clothing

1. Materials and Colors

The materials and colors for the inspectors' clothing are specified as follows:

a) Winter pants and shirts, women's skirts, long-sleeved under-shirts are dark gray;

b) Summer shirts, transitional season shirts are light gray;

c) Long-sleeved shirts, personal mosquito nets, short-sleeved under-shirts are white;

d) Winter and summer ceremonial pants and shirts are beige.

2. Specifications for Men's Clothing

a) Winter pants and shirts: Coat style with four pockets, shoulders have four buttons for insignia, left sleeve has embroidered inspector emblem;

b) Long-sleeved shirts: Stand-up collar, cuffs with button tabs, left chest pocket without flap;

c) Summer shirts: Short-sleeved stand-up collar, two chest pockets, shoulders have four buttons for insignia, left sleeve has embroidered inspector emblem;

đ) Transitional season shirts: Similar to men's summer shirts but long-sleeved;

e) Winter warm shirts: Long-sleeved coat style with buttoned cuffs, shoulders have four buttons for insignia, left sleeve has embroidered inspector emblem;

g) Winter ceremonial shirts: Long-sleeved outer coat style with two rows of buttons, shoulders have buttons for epaulets, left sleeve has embroidered inspector emblem;

h) Winter ceremonial pants: As specified in point e, Clause 2 of this Article;

i) Summer ceremonial shirts: Short-sleeved outer coat style with one row of buttons, shoulders have buttons for epaulets, left sleeve has embroidered inspector emblem;

k) Summer ceremonial pants: As specified in point e, Clause 2 of this Article.

3. Specifications for Women's Clothing

a) Winter shirts: Similar to men's winter shirts but with waist darts, no chest pockets;

b) Long-sleeved shirts: Stand-up collar, body with waist darts;

c) Summer shirts: Short-sleeved stand-up collar, body with waist darts, shoulders have buttons for insignia, left sleeve has embroidered inspector emblem;

đ) Transitional season shirts: Similar to women's summer shirts but long-sleeved;

e) Winter warm shirts: Long-sleeved coat style with shoulders having four buttons for insignia, left sleeve has embroidered inspector emblem;

g) Women's skirts: Waistband style, front with two hidden darts, back with zipper;

h) Winter ceremonial shirts: Long-sleeved outer coat style with two rows of buttons, shoulders have buttons for epaulets, left sleeve has embroidered inspector emblem;

i) Winter ceremonial pants: As specified in point e, Clause 3 of this Article;

k) Summer ceremonial shirts: Short-sleeved outer coat style with one row of buttons, shoulders have buttons for epaulets, left sleeve has embroidered inspector emblem;

l) Summer ceremonial pants: As specified in point g, Clause 3 of this Article.

4. Design models of shirts, skirts for women are prescribed in Section 1, Appendix II issued together with this Circular.

5. Specifications of shirts, skirts for women are prescribed in Section 2, Appendix II issued together with this Circular.

Article 8. Name plates, shoulder insignia, and sleeve badges

1. The name plate of Fisheries Surveillance is made of metal covered with transparent plastic, measuring 08 cm in length and 02 cm in width, surrounded by a gold border 02 mm wide; on the left side, there is the emblem of Fisheries Surveillance printed in white on a white background; on the right side, the name of the wearer is printed in uppercase white letters on a blue background.

2. The shoulder insignia is shaped like a seagull made of yellow metal, with a circular shape at the front, and the emblem of Fisheries Surveillance in the center of the circle.

3. The sleeve badge attached to the cuff is shield-shaped, with a total height of 09 cm (the height of the pointed part being 1,6 cm), tapering to a point at the bottom with a maximum width of 07 cm, surrounded by a gold border, and inside is the emblem of Fisheries Surveillance with a diameter of 05 cm.

4. The model of name plates, shoulder insignia, and sleeve badges of Fisheries Surveillance is specified in Section 3, Appendix II issued together with this Circular.

Article 9. Rank Insignia of Fisheries Surveillance

The rank insignia of Fisheries Surveillance has a dark slate blue background and is designed in the form of an isosceles trapezoid with dimensions of 13 cm for the length of the trapezoid sides; the largest side measures 05 cm; the smallest side measures 04 cm, with a pointed end measuring 1,6 cm in height (the pointed part); it has a gold border with a large border width of 05 mm and a small border width of 03 mm (the largest side does not have a border); the rank insignia is attached with a gold star; a gold National Emblem button with a diameter of 1,6 cm is fixed. The ranks are distinguished by stars (large stars with a diameter of 24 mm; small stars with a diameter of 21 mm) and gold stripes, with rank stripes measuring 05 mm wide, spaced 05 mm apart as follows:

1. Rank insignia for leadership positions

a) Director: Large border, 02 (two) large stars, no stripes, with 02 (two) pine branches at the base edge;

b) Deputy Director: Large border, 01 (one) large star, no stripes, with 02 (two) pine branches at the base edge;

c) Head of Department under the Bureau, Chief of Fisheries Surveillance Branch in Region: Small border, 4 (four) small stars and 2 (two) vertical stripes;

d) Deputy Head of Department under the Bureau, Deputy Chief of Fisheries Surveillance Branch in Region: Small border, 3 (three) small stars and 2 (two) vertical stripes;

đ) Head of Department under Branch in Region, Chief of Fisheries Surveillance Team, Station Chief: Small border, 2 (two) small stars and 2 (two) vertical stripes;

e) Deputy Head of Department under Branch in Region, Deputy Chief of Fisheries Surveillance Team, Deputy Station Chief: Small border, 1 (one) small star and 2 (two) vertical stripes.

2. Rank insignia for Fisheries Surveillance Officers

a) Senior Fisheries Surveillance Officer: Small border, 4 (four) small stars and 2 (two) vertical stripes;

b) Fisheries Surveillance Officer: Small border, 3 (three) small stars and 2 (two) vertical stripes;

c) Intermediate Fisheries Surveillance Officer: Small border, 1 (one) small star and 2 (two) vertical stripes.

3. Rank insignia for Fisheries Surveillance Vessel Crew Members

a) Senior Fisheries Surveillance Crew Member, Vessel Captain: Small border, 4 (four) small stars and 1 (one) vertical stripe;

b) Fisheries Surveillance Crew Member, Vessel Deputy Captain, Chief Engineer: Small border, 3 (three) small stars and 1 (one) vertical stripe;

c) Intermediate Fisheries Surveillance Crew Member, Assistant Engineer, Chief Steward: Small border, 2 (two) small stars and 1 (one) vertical stripe;

d) Seaman, Mechanic: Small border, 1 (one) small star and 1 (one) vertical stripe;

đ) Staff Member: Small border, 1 (one) vertical stripe.

4. Model of Fisheries Surveillance Rank Insignia as specified in Section 4, Appendix II issued together with this Circular.

Article 10. Fisheries Surveillance Badge

1. The Fisheries Surveillance badge is made of metal with two embossed pine branches plated in gold surrounding the round emblem of Fisheries Surveillance with a diameter of 36 mm, attached to a peaked cap, and with a diameter of 28 mm, attached to a soft cap.

2. The model of the Fisheries Surveillance badge is specified in Section 5, Appendix II issued together with this Circular.

Article 11. Specifications for Fishery Surveillance Helmets

1. Pi-shaped helmet: Dark gray in color, designed with a peaked style; it has a curved brim, forehead, crown, and top made from the same type of fabric; the crown is embroidered with the capitalized letters "VIETNAM FISHERIES SURVEILLANCE" in yellow, with a height of 12 mm; the bill is made of hard plastic, covered with shiny black leather, with a golden pine branch attached to the front (for leaders of the Bureau, a smaller pine branch is additionally attached inside); the chin strap is braided with light yellow threads and fixed with two gold metal buttons shaped like stars on both sides of the crown.

2. Formal hat: Beige in color, specifications similar to the pi-shaped helmet.

3. Women's soft cap: Dark gray in color, made from seamless fabric that folds up around the ears and back of the neck. The chin strap is braided with yellow threads, with buttons at both ends. Both sides of the cap have two mesh vents, and in the middle of the forehead there is a mesh vent for attaching the Fishery Surveillance emblem.

4. Men's soft cap: Dark gray in color, made from fabric, with a flat three-sided forehead, a smooth top, and two air vents on the sides of the cap, creating a stylish look; the back of the cap has a size-adjustable plastic buckle for convenience during use.

5. Impact-resistant helmet: Gray in color, this is a full-head protective helmet covering the head, back of the neck, and ears, with a windscreen in front. The helmet frame is made of plastic, with shock-absorbing foam lining inside, foam ear flaps, and straps to secure the helmet; both sides of the helmet have the capitalized letters "KNVN" in blue.

6. Design samples for Fishery Surveillance helmets as specified in Section 6, Appendix II issued together with this Circular.

Article 12. Specifications for Other Equipment

1. Necktie: Pre-tied bow tie style; dark gray in color (matching winter pants and shirts); the widest part of the necktie measures 10 cm for men and 8 cm for women. The length of the necktie for men is 43, 45, or 47 cm, and for women is 39, 41, or 43 cm.

2. Belt: Brown leather belt; the metal buckle is white, with a width of 36 mm and a length of 52 mm; between the buckle, there are capitalized letters "KNVN" in red.

3. Raincoat set, socks: Light gray in color.

4. Leather shoes: Leather shoe style, black in color, oil-resistant sole.

5. Handkerchief: Light blue in color.

6. Briefcase: Black in color.

7. Luggage: Brown or black in color.

8. Backless sandals, personal blanket, personal pillow: Dark gray in color.

9. Work notebook: Cover in blue.

10. Design samples for other equipment as specified in Section 7, Appendix II issued together with this Circular.

Article 13. Standards and Service Life of Equipment, Issuance

1. Regular uniforms as specified in Section 1, Appendix III issued together with this Circular.

2. Additional uniforms: In addition to regular uniforms, personnel regularly working on vessels are entitled to additional uniforms as specified in Section 2, Appendix III issued together with this Circular.

3. Based on specific conditions, the Director of the Fishery Surveillance Bureau decides on the provision of uniforms for Fishery Surveillance personnel.

Chapter IV
FISHERY SURVEILLANCE BOATS AND CRAFTS

Article 14. Fishery Surveillance Boats

1. Paint Color

a) The hull above the designed waterline and the superstructure above the deck: White paint;

b) Deck and roof of the cabin: Green paint.

2. Fishery Surveillance boats have capitalized letters "VIETNAM FISHERIES SURVEILLANCE" painted in dark blue along the side of the boat, with a maximum length equal to one-third of the total length of the boat; the height is appropriate to the size of the boat; capitalized English letters "VIETNAM FISHERIES RESOURCES SURVEILLANCE" in dark blue, with a height equal to two-thirds of the Vietnamese letters, placed centrally below the Vietnamese letters.

3. Fishery Surveillance emblem: Placed on the front and above both sides of the cabin body at a height easily visible. The size of the Fishery Surveillance emblem is designed to fit the size of the cabin.

4. Markings: Fishery Surveillance boats have two parallel stripes of equal width, yellow and red, painted from the upper edge of the deck down to the designed waterline at the bow, with the yellow stripe preceding the red stripe; the distance from the bow to the marking stripes is one-sixth of the length of the boat.

Yellow and red stripes, numbers on both sides symmetrically through the center of the boat (left side numbers according to the forward direction).

5. Numbering

a) Painted in dark blue at positions: Both sides (at the bow position), aft (at the center position), and above the side, with a height appropriate to the size of the boat;

b) The numbering consists of two parts: KN-number (the number includes three digits).

6. Flag: The Fishery Surveillance flag is hoisted at the bow of the boat.

7. Paint color and identification marks of Fishery Surveillance boats as specified in Section 1, Appendix IV issued together with this Circular.

Article 15. Fishing Surveillance Boats

1. Work boats equipped with fishing surveillance vessels

a) Paint color: Painted according to the vessel's color;

b) The boat has the uppercase letters "KIỂM NGƯ VIỆT NAM" painted in dark blue along the side of the vessel's hull, with a maximum length equal to one third of the total length of the vessel; the height is appropriate to the size of the vessel;

c) Markings: The boat has two yellow and red stripes similar to those on the vessel;

d) Numbering: The number of the boat is taken from the number of the vessel;

đ) Flags: The fishing surveillance flag is hoisted at the bow of the vessel;

e) For work boats with rubber hulls, follow the manufacturer's regulations;

g) The paint color and markings for work boats equipped with fishing surveillance vessels are regulated in Section 2, Appendix IV issued together with this Circular.

2. Independent work boats

a) Paint color: The sides of the boat above the designed waterline and the superstructure above the deck are painted white; the deck and the roof of the cabin are painted green;

b) The fishing surveillance boat has the uppercase letters "KIỂM NGƯ VIỆT NAM" painted in dark blue along the side of the boat's hull, with a maximum length equal to one third of the total length of the boat; the height is appropriate to the size of the boat; the uppercase letters "VIETNAM FISHERIES RESOURCES SURVEILLANCE" in English are painted in dark blue, with a height equal to two thirds of the Vietnamese letters and placed centrally below the Vietnamese letters;

c) The fishing surveillance emblem is placed on both sides of the cabin body at a height easily visible. The size of the fishing surveillance emblem is designed to fit the size of the cabin;

d) Markings: The fishing surveillance boat has two yellow and red stripes of equal width, sized appropriately to the boat (yellow first, red second from the bow), painted from the upper edge of the deck down to the designed waterline at the bow and parallel to the boat's bow; the distance from the bow to the marking stripe is one sixth of the boat's length;

đ) Numbering: Painted in dark blue on both sides at the bow position, with a height appropriate to the size of the boat. The numbering consists of two parts: KN - number (the number includes four digits);

e) The fishing surveillance flag is hoisted at the bow of the boat;

g) The paint color and markings for independent work boats are regulated in Section 3, Appendix IV issued together with this Circular.

Chapter V
IMPLEMENTING PROVISIONS

Article 16. Implementation Organization

1. The Fisheries General Department uniformly manages the insignia, flags, traditional flags, uniforms, inspection card models, numbering, and paint colors of fishing surveillance vessels and boats.

2. The Inspection Service builds Regulations on managing and using the insignia, flags, traditional flags, and uniforms of fishing surveillance.

3. The Director of the Fisheries General Department, the Head of the Ministry's Office, the Director of the Finance Department, and the heads of related units are responsible for implementing this Circular.

4. Any difficulties encountered during implementation should be reported to the Ministry of Agriculture and Rural Development for consideration and resolution.

Article 17. Effective Date

This Circular takes effect from May 23, 2014./.
