and powers of veterinary councils at all levels

BASED ON THE LAW ON VETERINARY MEDICINE OF JUNE 19, 2015;

Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Director of the Animal Health Department,

The Minister of Agriculture and Rural Development issues this Circular to stipulate the organization, functions, tasks, and powers of veterinary councils at all levels.

Article 1. Scope of Regulation

This Circular stipulates the organization, functions, tasks, and powers of veterinary councils at all levels, including the Central Veterinary Council and the Provincial Veterinary Councils.

Article 2. Applicability

This Circular applies to agencies, organizations, and individuals related to the organization and operation of the Central Veterinary Council and Provincial Veterinary Councils.

Article 3. Establishment of veterinary councils at all levels

1. The Central Veterinary Council shall be established by decision of the Minister of Agriculture and Rural Development.

2. The Provincial Veterinary Council shall be established by decision of the Director of the Department of Agriculture and Rural Development.

3. The term of office for the Central and Provincial Veterinary Councils is five years.

4. Members of the Veterinary Councils shall receive remuneration according to the provisions of the law when performing advisory tasks.

Article 4. Functions of veterinary councils at all levels

1. The Central Veterinary Council has the function of advising the Minister of Agriculture and Rural Development on veterinary activities within the scope of management of the Ministry.

2. The Provincial Veterinary Council has the function of advising the Director of the Department of Agriculture and Rural Development on veterinary activities within the scope of management of the Department of Agriculture and Rural Development.

Article 5. Composition of veterinary councils at all levels

1. The composition of the Central Veterinary Council includes:

a) Chairman of the Council: Director of the Animal Health Service;

b) Deputy Chairmen of the Council: President of the Vietnam Veterinary Association and Director of the National Veterinary Research Institute;

c) Council members must have appropriate professional qualifications and experience relevant to the advisory content, representing leaders of the following agencies and organizations: specialized animal health management agencies, livestock breeding, aquaculture; associations, unions, universities, research institutes, experts, scientists in the field of animal health, livestock breeding, aquaculture;

d) Secretary of the Council: Leaders of specialized departments under the Animal Health Service;

đ) The permanent body of the Council is the Animal Health Service.

2. The composition of the Provincial Veterinary Council includes:

a) Chairman of the Council: Head of the provincial agency with specialized animal health management functions;

b) Deputy Chairmen of the Council: Representatives of leaders of associations or unions, universities or research institutes in the field of animal health, livestock breeding, aquaculture;

c) Council members must have appropriate professional qualifications and experience relevant to the advisory content, representing leaders of the following agencies and organizations: specialized animal health management agencies, aquaculture management agencies, associations, unions, universities, research institutes, experts, scientists in the field of animal health, aquaculture;

d) Secretary of the Council: Leaders of specialized departments of the provincial agency with specialized animal health management functions;

đ) The permanent body of the Council is the provincial agency with specialized animal health management functions.

Article 6. Tasks and powers of veterinary councils at all levels

1. The Central Veterinary Council has the following tasks and powers:

a) Advising on the improvement of legal regulations on animal health; evaluating the enforcement of laws on animal health;

b) Advising and proposing solutions to prevent and control animal diseases when they spread rapidly over a wide area or new animal diseases appear in Vietnam;

c) Advising on the construction of disease-free zones for animals nationwide;

d) Advising on the use of animal health drugs for newly emerging animal diseases in Vietnam;

đ) Advising on the management of animal health practice activities; socializing animal health service practice activities nationwide;

e) Advising on the application of new science and technology in the field of animal health nationwide;

g) Performing other tasks assigned by the Minister of Agriculture and Rural Development.

2. The Provincial Veterinary Council has the following tasks and powers:

a) Advising on policies, programs, projects, plans in animal health activities at the local level; evaluating the enforcement of laws on animal health at the local level;

b) Advising and proposing solutions to prevent and control animal diseases when they spread rapidly over a wide area at the local level;

c) Advising on the construction of disease-free zones for animals at the local level;

d) Advising on the use of animal health drugs for newly emerging animal diseases at the local level;

đ) Advising on the management of animal health practice activities; socializing animal health service practice activities at the local level;

e) Advising on the application of new science and technology in the field of animal health at the local level;

g) Performing other tasks assigned by the Director of the Department of Agriculture and Rural Development.

Article 7. Budget for the operation of veterinary councils at all levels

1. The agency responsible for the permanent operation of veterinary councils at all levels shall be responsible for preparing the budget estimate for the council's operations to submit to the competent authority for approval.

2. Support sources and other legitimate funding sources shall be utilized in accordance with the provisions of the law.

Article 8. Working Regime

1. Veterinary councils at all levels operate under a collective working regime.

2. Members of veterinary councils at all levels work on a part-time basis.

3. The Chairman and Vice Chairmen of the Council may use the seal of their place of employment.

4. The Chairman shall establish the working regime and specific tasks for members.

5. The central veterinary council shall be responsible for periodically reporting to the Minister of Agriculture and Rural Development every six months or submitting ad hoc reports when required regarding the results of advisory activities on veterinary matters; reporting to relevant agencies when required.

6. Provincial veterinary councils shall be responsible for periodically reporting to the Director of the Department of Agriculture and Rural Development and the central veterinary council every six months or submitting ad hoc reports when required regarding the results of advisory activities on veterinary matters; reporting to relevant agencies when required.

Article 9. Responsibilities of the Chairman of the Veterinary Council and Members

1. The Chairman of the Veterinary Council shall have the following responsibilities:

a) Deciding on the program and plan of work of the Veterinary Council, the content requiring advice;

b) Deciding on the invitation of members and chairing meetings of the Veterinary Council;

c) Assigning responsibilities to members of the Veterinary Council;

d) Being generally responsible for the activities of the Veterinary Council and its members during the process of performing advisory tasks.

2. Members of the Veterinary Council shall have the following responsibilities:

a) Implementing tasks according to the assignment of the Chairman of the Veterinary Council;

b) Arranging participation in the activities of the Veterinary Council;

c) Presenting opinions on the contents proposed for advice.

3. The permanent agency of the Veterinary Council shall be responsible for preparing documents, material resources, and equipment for meetings of the Veterinary Council and using its organizational structure and seal to perform tasks according to the assignment of the Chairman of the Council.

Article 10. Effective Date

1. This Circular takes effect from July 19, 2016.

2. In case difficulties or obstacles arise during implementation, they should be promptly reported to the Ministry of Agriculture and Rural Development for coordination and resolution./.
