CIRCULAR

Issuing National Technical Regulations on the Quality of Plant Protection Products

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Product and Commodities Quality dated November 21 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;of Industry and Rural Development;

Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain articles of the Law on Standards;This Circular takes effect from June 25, 2021.

Pursuant to Decree No. 78/2018/NĐ-CP dated May 16, 2018 of the Government amending and supplementing certain articles of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain articles of the Law on Standards and Technical Regulations; to implement some Articles of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain articles of the Law on Product and Commodities Quality; lawa;

At the request of the Director of the Department of Science, Technology and Environment and the Director of the Plant Protection Department;

The Minister of Agriculture and Rural Development issues the National Technical Regulations on the Quality of Plant Protection Products.

Article 1. Attached to this Circular is QCVN 01-188:2018/BNNPTNT National Technical Regulations on the Quality of Plant Protection Products.

Article 2. This Circular takes effect from April 2, 2019.

Article 3. The State management agency for the quality of imported plant protection products is the Plant Protection Department or an organization for conformity assessment authorized by the Plant Protection Department to carry out certain stages of inspection within the scope defined in the authorization decision.

Article 4. Transitional Provisions

1. Plant protection products that have been issued with a Certificate of Conformity or Notification of Acceptance of Declaration of Conformity before the effective date of this Circular shall be allowed to continue to be used until their validity period expires. For products certified under method 5, monitoring shall be conducted according to the provisions of QCVN 01-188:2018/BNNPTNT at the next monitoring period following the effective date of this Circular.

2. Organizations designated as conformity assessment bodies pursuant to Circular No. 21/2015/TT-BNNPTNT dated June 8, 2015 of the Minister of Agriculture and Rural Development on the management of plant protection products shall continue to perform conformity assessment under QCVN 01-188:2018/BNNPTNT until the end of their designation period.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

The Director of the Ministry's Office, Heads of the Science, Technology and Environment Department, the Plant Protection Department, and heads of other relevant agencies, organizations, and individuals are responsible for implementing this Circular. During its implementation, if there are any difficulties, they are requested to promptly report them to the Ministry of Agriculture and Rural Development (Plant Protection Department) for consideration and resolution.
