CIRCULAR
Regulations on Competition and Awards Work in the People's Public Security Force
Pursuant to the Law on Competition and Awards dated November 26, 2003; the Law Amending and Supplementing Certain Provisions of the Law on Competition and Awards dated November 16, 2013;
Pursuant to Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government detailing the implementation of certain provisions of the Law on Competition and Awards (Decree No. 91/2017/ND-CP);
Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
Considering the proposal of the Director of the Political and Ideological Work Department;
The Minister of Public Security promulgates this Circular regulating competition and awards work in the People's Public Security Force.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the organization of competitions, titles and standards for titles; principles, forms, subjects and standards for awards; Competition and Award Councils; decision-making authority, procedures, and files for proposing to grant titles and awards; competition and award funds, prize money, and award ceremonies in the People's Public Security Force.
Article 2. Cases not eligible for consideration for titles and awards
1. Titles and awards shall not be granted to collectives and individuals in the following cases:
a) During the period awaiting disciplinary action;
b) Having been disciplined but still within the disciplinary period;
c) Undergoing inspection or investigation for violations according to the decision of the competent authority or having complaints or denunciations that need to be verified and clarified. If the competent authority concludes there is no violation, they may be considered for titles and awards.
2. The time frame for reviewing complaints and the results of inspections and investigations to consider granting titles and awards shall be carried out as follows:
a) For titles: seven years for the title "National Model Worker"; three years for the title "Model Worker of the National Public Security Force"; one year for the title "Model Worker at the Base Level".
b) For immediate or special topic awards (or competitions): one year.
c) For awards based on achievements and merits: five years for the Prime Minister's Commendation, National Defense Merit Medal; ten years for Military Service Merit Medal; fifteen years for Ho Chi Minh Medal, Golden Star Medal.
d) For awards recognizing long-term contributions: review during the tenure of leadership positions.
The review period specified in this Clause starts from the date of the application for the title or award and goes back before that date.
Article 3. Innovations for Consideration in Granting Titles and Awards in the People's Public Security Force
1. Innovations for consideration in granting titles and awards in the People's Public Security Force are technical solutions, management solutions, work solutions, operational solutions, and applications of technological progress by officers, non-commissioned officers, conscripts, workers, and contractual employees in the People's Public Security Force, applied in practice, contributing to enhancing the effectiveness of national security protection and social order and safety maintenance or building the People's Public Security Force.
2. The Minister of Public Security considers and recognizes innovations with nationwide impact or within the People's Public Security Force. Heads of public security agencies at all levels recognize effective innovations within their jurisdiction.
Chapter II
ORGANIZATION OF COMPETITIONS AND STANDARDS FOR COMPETITION TITLES
AND STANDARDS FOR COMPETITION TITLES
- Prime Minister;4. Competition Movements in the People's Public Security Force
1. Competition movements in the People's Public Security Force include the "For National Security" competition movement and other competition movements.
2. The "For National Security" competition movement
a) The "For National Security" competition movement is organized annually by the Ministry of Public Security to strive for the best achievements in fulfilling the political tasks of the People's Public Security Force.
b) Competition movements in phases (or special topics) in the People's Public Security Force must be linked to the "For National Security" competition movement to effectively implement the "For National Security" competition movement.
3. The People's Public Security Force responds to and organizes the launch of competition movements initiated by the President and the Prime Minister, aiming to achieve the best results in protecting national security, maintaining social order and safety, and building the People's Public Security Force.
Article 5. Responsibilities for organizingthe competition movement within the People's Public Security Force
1. The Minister of Public Security shall organize the launch of the competition movement throughout the entire People's Police force.
2. Heads of units under the Ministry of Public Security, Provincial Police Chiefs, and Municipal Police Chiefs directly under the Central Government shall be responsible for implementing the competition movement launched by the Minister of Public Security.
3. The Political and Ideological Work Department shall be responsible for advising the Minister of Public Security to uniformly manage, direct, guide, inspect, and implement the competition movement throughout the entire People's Police force. The ideological work department of units under the Ministry of Public Security, and the Political and Ideological Work Department of Provincial and Municipal Police Departments directly under the Central Government shall be responsible for advising the heads of units under the Ministry of Public Security, Provincial Police Chiefs, and Municipal Police Chiefs directly under the Central Government to uniformly manage, direct, guide, inspect, and implement the competition movement within their respective police units and localities.
4. Communication agencies within the People's Police shall be responsible for publicizing the competition movements; commending, honoring, and promoting exemplary models and good deeds in the competition movements; combating and criticizing negative phenomena and violations of laws on competitions and rewards.

1. Developing plans to organize the competition movement
a) Plans to organize the competition movement must clearly define the objectives, targets, requirements, themes, scope, subjects, duration of the competition; the targets set must be higher than the normal level to encourage each collective and individual to strive and actively complete them;
b) The content of the competition must aim to fulfill the political tasks of police units and localities and be linked with other competition movements; ensuring practicality and suitability with the actual conditions of the unit and locality and the capacity of participation of officers and soldiers;
c) Measures to implement the competition movement must be specific and practical; focusing on propaganda, encouragement, and motivation to inspire officers and soldiers to take responsibility and participate voluntarily;
d) The plan to organize the competition movement must clearly state the main organizing unit, cooperating units, time for interim review, time for final summary, and reporting on the results of organizing the competition movement.
2. Organizing the launch ceremony of the competition movement:
a) The Minister of Public Security shall launch and direct the competition movement throughout the entire People's Police force;
b) Heads of units under the Ministry of Public Security, Provincial Police Chiefs, and Municipal Police Chiefs directly under the Central Government shall launch and direct the competition movement in their respective police units and localities;
c) The content and program of the launch ceremony of the competition movement include: raising the national flag; stating the purpose, introducing representatives; conveying the content of the competition movement plan; speeches supporting the competition from representative units; signing competition agreements between participating units (if applicable); speeches from the head of the unit; concluding the ceremony;
d) The organization of the launch ceremony can be held separately or combined with other conferences and activities of the People's Police force.
3. Monitoring, inspecting, urging implementation of the competition movement:
The competition movement must be continuously monitored, inspected, urged, and guided in its implementation. Emphasis should be placed on directing pilot projects to draw lessons, identify shortcomings and limitations, and find solutions to overcome them, thereby effectively implementing the competition movement.
4. Identifying, nurturing, publicizing, and expanding exemplary models:
Exemplary models are collectives and individuals who achieve outstanding results with exemplary and innovative characteristics in the competition movement. Identifying, nurturing, publicizing, and expanding exemplary models is an important method in the measures and forms of organizing competitions. In various competition movements, police units and localities should identify exemplary models, summarize their experiences, intensify publicity to commend and honor exemplary models, organize learning sessions to catch up and surpass these models.
5. Interim reviews and summaries of the competition movement
a) Interim reviews of the competition movement shall be organized regularly every three months, six months, or during each competition phase, ensuring strict, thorough, objective, and comprehensive reviews;
b) Annual summaries and evaluations of competition results must be conducted strictly, thoroughly, objectively, and comprehensively, clarifying achievements, effective models and methods, identifying shortcomings and limitations, and their causes; inspections, scoring, assessments, and honors for outstanding and excellent collectives and individuals in the competition movement must be conducted objectively and accurately;
c) When conducting interim reviews and summaries of the competition movement, police units and localities should select collectives and individuals with outstanding and exemplary achievements for rewards or recommend them for higher-level rewards.
Article 7. Granting of Merit Awards
1. Only merit awards specified in this Circular shall be granted to collectives and individuals who have participated in the competition and achieved results when summarizing the "For Homeland Security" competition annually.
2. The granting of merit awards shall be conducted openly and democratically, ensuring that the correct subjects, standards, and ratios are adhered to.
3. Merit awards shall not be granted in the following cases:
a) Collectives and individuals who did not register for the competition.
b) Units newly established up to the time of summarizing the "For Homeland Security" competition have not operated for at least ten months;
c) Individuals who have continuously worked for less than ten months in a year, except in special cases stipulated in Clause 1, Article 13 of this Circular.
4. When calculating the number of collectives and individuals eligible for merit awards according to the percentage ratio specified in this Circular, if the decimal part is a fraction, it shall be rounded off as follows:
a) If the first digit of the decimal part is five or more, then one shall be added to the whole number part. For example: 50% of 5 is 2.5, which will be rounded to 3;
b) If the first digit of the decimal part is less than five, the whole number part remains unchanged. For example: 40% of 3 is 1.2, which will be rounded to 1.
Article 8. Subjects Eligible for Merit Awards
1. For individuals: Officers, non-commissioned officers, soldiers of the People's Public Security, public security workers, and contractual laborers within the People's Public Security.
2. For groups:
a) Command, department, and equivalent units; police academies, public security academies; provincial public security forces, centrally governed cities (hereinafter referred to collectively as department-level units, provincial public security forces);
b) Departments, schools, prisons, temporary detention centers, compulsory education facilities, juvenile correctional facilities, and equivalent units; district public security forces, county public security forces, municipal public security forces under provinces; battalions, companies directly subordinate to departments; public security enterprises (hereinafter referred to collectively as grassroots units);
c) Police stations, town police stations; public security villages with regular public security personnel assigned to village public security positions; prison detachments, compulsory education facility sections, battalion, company units directly subordinate to grassroots units, branches, teams, and equivalent units (hereinafter referred to collectively as subordinate units).
3. Youth organizations, women's organizations, trade unions shall implement the granting of merit awards according to the regulations of their respective central organizations.
Article 9. Title of "Outstanding Soldier" or "Outstanding Worker"
1. The title of "Outstanding Worker" shall be granted to public security workers and contractual laborers within the People's Public Security, while the title of "Outstanding Soldier" shall be granted to officers, non-commissioned officers, and soldiers of the People's Public Security who meet the following criteria:
a) Successfully completing assigned tasks with high productivity and quality;
b) Adhering well to the policies of the Party, laws of the State, internal regulations of the People's Public Security; fostering unity, mutual assistance, and active participation in competitive movements.
c) Actively studying politics, culture, professional knowledge, and vocational skills;
d) Having a healthy lifestyle and moral conduct.
2. Individuals receiving the titles of "Outstanding Soldier" or "Outstanding Worker" must have the agreement of at least 80% of the members of the Competition and Commendation Council at the decision-making level.
3. The maximum number of individuals receiving the titles of "Outstanding Soldier" or "Outstanding Worker" shall not exceed 80% of the total number of individuals eligible to participate in the competition for merit awards at department-level units and provincial public security forces.
Article 10. Title "Outstanding Soldier at the Base Level"
Clause 1. The title "Outstanding Soldier at the Base Level" shall be awarded to individuals who stand out and excel, selected from those who have met the criteria for the titles "Advanced Soldier" or "Advanced Worker" and meet one of the following criteria:
Point a) Having an initiative recognized by the head of the unit at the Bureau level or higher, or by the provincial-level Public Security agency;
Point b) Being the head of a scientific research project at the base level or higher that has been accepted and effectively applied in the organization, institution, or unit, or being the main organizer of a proposal, project, or regulatory document that was completed ahead of schedule and effectively applied;
Point c) Receiving commendation from the head of the unit at the Bureau level or higher, or from the People's Committee at the district level or higher for outstanding achievements, specialized achievements, or achievements during campaign drives.
Clause 2. Individuals receiving the title "Outstanding Soldier at the Base Level" must have received endorsement from members of the Commendation Council issuing the decision with a trust vote of 80% or more.
Clause 3. The maximum number of individuals receiving the title "Outstanding Soldier at the Base Level" shall not exceed 15% of the total number of individuals who have received the titles "Advanced Soldier" or "Advanced Worker" at the Bureau level or provincial-level Public Security agency.
Article 11. Title "Outstanding Soldier throughout the National Police Force"
Clause 1. The title "Outstanding Soldier throughout the National Police Force" shall be awarded to individuals with outstanding achievements selected from those who have continuously achieved the title "Outstanding Soldier at the Base Level" three times consecutively and during this period meet one of the following criteria:
Point a) Having an initiative recognized by the Minister of Public Security;
Point b) Being the head of a scientific research project at the Ministry level or higher that has been accepted and effectively applied, or being the main organizer of a proposal, project at the Ministry level or higher, or a regulatory document under the Ministry of Public Security’s Program on Regulatory Document Construction that was completed ahead of schedule and effectively applied;
Point c) Receiving a Medal or a Commendation from the Prime Minister, or having three Commendations at the ministry, sector, provincial, or central mass organizations level, including two Commendations from the Ministry of Public Security (excluding commendations based on meritorious deeds and achievements);
Point d) Winning three awards at the ministry level or three gold medals at national police force-wide competitions, contests, or performances.
Clause 2. Individuals receiving the title "Outstanding Soldier throughout the National Police Force" must have received agreement from members of the Commendation Council issuing the decision with a consensus rate of 90% or more.
Clause 3. The maximum number of "Outstanding Soldiers throughout the National Police Force" to be considered for awarding shall not exceed 0.5% of the personnel strength of the Bureau-level units or provincial-level Public Security agencies (for units with fewer than 200 personnel, the number shall not exceed one).
Article 12. Title "National Outstanding Soldier"
Clause 1. The title "National Outstanding Soldier" shall be awarded to individuals who stand out and excel, selected from those who have continuously achieved the title "Outstanding Soldier throughout the National Police Force" twice consecutively and during this period meet one of the following criteria:
Point a) Having an initiative applied in practice with high effectiveness and nationwide impact, recognized by the Minister of Public Security;
Point b) Being the head of a scientific research project at the Ministry level or higher that has been accepted and effectively applied nationwide, or being the main organizer of a proposal, project at the Ministry level or higher, or a regulatory document under the Government’s, the Standing Committee of the National Assembly’s, or the National Assembly’s Program on Regulatory Document Construction that was completed ahead of schedule and effectively applied, with nationwide impact;
Point c) Showing bravery, creativity in combat and support services, and being awarded the Military Merit Medal, the Bravery Medal, the Combat Medal, the National Defense Medal, or the Labor Medal for outstanding achievements.
Clause 2. Individuals receiving the title "National Outstanding Soldier" must have received agreement from members of the Commendation Council at all levels with a consensus rate of 90% or more.
Clause 3. The title "National Outstanding Soldier" shall be proposed for consideration in the year immediately following the year in which the decision to award the title "Outstanding Soldier throughout the National Police Force" is made for the second time.
Article 13. Awarding commendation titles in certain special cases
1. Cases where the period of service does not reach 10 months in a year for awarding commendation titles:
a) Individuals on maternity leave as prescribed;
b) Individuals injured while performing duties and required to take time off for treatment and convalescence according to the conclusion of health authorities at district level or higher;
c) Individuals assigned to participate in short-term training or upgrading programs under one year, complying with the regulations of the training or upgrading institutions, shall have their study time counted towards their working period at the unit for commendation title assessment. Individuals assigned to participate in training or upgrading programs of one year or more, complying with the regulations of the training or upgrading institutions, achieving satisfactory academic results or better, may be considered for the awarding of the "Advanced Soldier" or "Advanced Worker" commendation titles.
2. Students of police academies and schools must follow the regulations of the Ministry of Education and Training for classifying academic performance; for students classified as Excellent, Good, Satisfactory, and Fairly Satisfactory, they must meet the following criteria:
a) Adhering well to the policies and guidelines of the Party, state laws, discipline, internal regulations, procedures, and work systems;
b) Having a healthy moral character and lifestyle, actively participating in commendation movements.
3. Students of police academies and schools who graduate and start working at new units shall be assessed for commendation titles based on their graduation results and working period at the new unit.
4. Contract workers may be awarded commendation titles if they have continuously worked in the People's Public Security for 10 months or more.
5. Conscripts in the People's Public Security may be awarded commendation titles annually if they have continuously worked for 10 months or more, regardless of the timing of the regular force's commendation assessment, ensuring the principle that the number of "Advanced Soldiers" should not exceed 80% of the total number of conscripts eligible for commendation title assessment; the number of "Model Soldiers at the grassroots level" should not exceed 15% of the total number of "Advanced Soldiers".
6. For individuals assigned to work temporarily or seconded to agencies or organizations outside the People's Public Security, the awarding of commendation titles must include evaluations from the units where they were assigned to work or seconded, except in cases requiring confidentiality.
Article 14. Commendation titles for leaders and commanders at all levels of the Public Security
When awarding commendation titles to individuals who are leaders and commanders at all levels of the Public Security, it must be based on the general standards stipulated in Articles 9 and 10 of this Circular and the results of the "For National Security" commendation movement of the unit directly managed by such individual, as follows:
1. For leaders of provincial-level public security units
a) Units receiving the "Flag of Merit from the Government": no more than 70% of the leaders of the unit can be awarded the "Model Soldier at the grassroots level" title;
b) Units receiving the "Flag of Merit from the Ministry of Public Security": no more than 50% of the leaders of the unit can be awarded the "Model Soldier at the grassroots level" title;
c) Units receiving the "Certificate of Merit from the Minister of Public Security": the leader responsible for the field of work with outstanding achievements can be awarded the "Model Soldier at the grassroots level" title, provided the individual meets the criteria;
d) Units without commendation titles and without awards: no "Model Soldier at the grassroots level" title can be awarded to the leaders of the unit.
2. For leaders of grassroots units
a) Units receiving the "Flag of Merit from the Government": no more than 70% of the leaders of the unit can be awarded the "Model Soldier at the grassroots level" title;
b) Units receiving the "Flag of Merit from the Ministry of Public Security": no more than 50% of the leaders of the unit can be awarded the "Model Soldier at the grassroots level" title;
c) Units receiving the "Victory Unit" or "Outstanding Labor Collective" titles: no more than 40% of the leaders of the unit can be awarded the "Model Soldier at the grassroots level" title;
d) Units receiving the "Advanced Unit" or "Advanced Labor Collective" titles: only the most outstanding leader can be considered for the "Model Soldier at the grassroots level" title;
đ) Units failing to achieve commendation titles: no "Model Soldier at the grassroots level" title can be awarded to the leaders of the unit.
3. For leaders of subordinate units
a) Units receiving the "Victory Unit" or "Outstanding Labor Collective" titles: no more than 50% of the leaders of the unit can be awarded the "Model Soldier at the grassroots level" title;
b) Units receiving the "Advanced Unit" or "Advanced Labor Collective" titles: select the most outstanding leader for consideration for the "Model Soldier at the grassroots level" title;
c) Units failing to achieve commendation titles: leaders of the unit cannot be awarded the "Model Soldier at the grassroots level" title.
4. The ratio of "Model Soldiers at the grassroots level" for leaders and commanders specified in Clauses 1, 2, and 3 of this Article must be within the overall ratio of the unit.
Article 15. Title "Advanced Unit" or "Advanced Labor Collective"
1. The title "Advanced Unit" or "Advanced Labor Collective" shall be awarded to grassroots units or subordinate units that meet the following criteria:
a) Successfully completing assigned tasks on schedule and with quality assurance;
b) There is a regular, practical, and effective competitive movement;
c) More than 50% of individuals within the unit meeting the criteria for the title "Outstanding Soldier" or "Outstanding Worker," with no individual receiving disciplinary action at or above the level of Warning (for units with large numbers and scale, this will be reviewed and decided by the Minister of Public Security);
d) Strictly adhering to the Party's policies, State laws, maintaining internal unity, integrity, and strength.
2. A collective receiving the title "Advanced Unit" or "Advanced Labor Collective" must have the agreement of at least 80% of members of the Commendation and Award Council at the decision-making level.
3. The number of grassroots units or subordinate units eligible for the award of the title "Advanced Unit" or "Advanced Labor Collective" shall not exceed 80% of the total number of grassroots units or subordinate units at the Bureau or Provincial Public Security level.
Article 16. Title "Victorious Unit" or "Excellent Labor Collective"
1. The title "Victorious Unit" or "Excellent Labor Collective" shall be awarded to grassroots units or subordinate units that meet the following criteria:
a) Demonstrating creativity, overcoming difficulties, and excelling in assigned tasks in work and combat;
b) Having a consistent, practical, and effective competition movement, with individuals recognized and rewarded;
c) All individuals in the unit completing their assigned tasks, with at least 70% meeting the criteria for the title "Outstanding Soldier" or "Outstanding Worker"; having individuals meeting the criteria for the title "Model Soldier at the Grassroots Level" and no individual receiving disciplinary action at or above the level of Warning (for units with large numbers and scale, this will be reviewed and decided by the Minister of Public Security);
d) Strictly adhering to the Party's policies, State laws, maintaining internal unity, integrity, and strength.
2. A collective receiving the title "Victorious Unit" or "Excellent Labor Collective" must have the agreement of at least 80% of members of the Commendation and Award Council at the decision-making level.
3. The number of grassroots units or subordinate units eligible for the award of the title "Victorious Unit" or "Excellent Labor Collective" is as follows:
a) For Bureau-level units or Provincial Public Security units awarded the Flag of Government Competition: the number of "Victorious Units" or "Excellent Labor Collectives" awarded shall not exceed 70% of the total number of "Advanced Units" or "Advanced Labor Collectives" at the Bureau or Provincial Public Security level.
b) For Bureau-level units or Provincial Public Security units awarded the Flag of the Ministry of Public Security: the number of "Victorious Units" or "Excellent Labor Collectives" awarded shall not exceed 60% of the total number of "Advanced Units" or "Advanced Labor Collectives" at the Bureau or Provincial Public Security level.
c) For Bureau-level units or Provincial Public Security units awarded a Certificate of Merit from the Minister of Public Security in annual summaries: the number of "Victorious Units" or "Excellent Labor Collectives" awarded shall not exceed 50% of the total number of "Advanced Units" or "Advanced Labor Collectives" at the Bureau or Provincial Public Security level.
d) For Bureau-level units or Provincial Public Security units not awarded commendations or honors in annual summaries: the number of "Victorious Units" or "Excellent Labor Collectives" awarded shall not exceed 40% of the total number of "Advanced Units" or "Advanced Labor Collectives" at the Bureau or Provincial Public Security level.
Article 17. The title "Flag of Excellence of the Ministry of Public Security"
1. For units at the Bureau level and provincial public security agencies
a) The title "Flag of Excellence of the Ministry of Public Security" shall be awarded to units at the Bureau level and provincial public security agencies that meet the following criteria:
- Exceeding all assigned targets and tasks with outstanding performance for the year;
- Demonstrating outstanding achievements recognized through activities within the cluster or group competition;
- Initiating practical and effective competitive movements; creating new factors, models, and exemplary cases for other units to emulate; having many groups and individuals commended and rewarded;
- Strictly implementing and effectively promoting competitive movements and campaigns; maintaining internal unity and solidarity, complying well with Party policies and State laws, leading in thrift, waste reduction, and anti-corruption efforts.
b) Each cluster of units at the Bureau level and provincial public security agencies may propose up to 50% of the units in the cluster to receive the "Flag of Excellence of the Ministry of Public Security".
2. For grassroots units
a) The title "Flag of Excellence of the Ministry of Public Security" shall be awarded to grassroots units that meet the following criteria:
- Being selected as outstanding among those grassroots units meeting the criteria for the titles "Victory Unit" and "Outstanding Labor Collective";
- Leading in productivity, quality, and effectiveness across all work and combat areas compared to other units in the competition group;
- Initiating practical and effective competitive movements; having many exemplary cases; many groups and individuals achieving commendable results and being rewarded;
- All individuals in the unit completing their assigned tasks, with at least 80% of them meeting the criteria for the titles "Exemplary Soldier" or "Exemplary Worker"; having individuals meeting the criteria for "Model Soldier of the Grassroots Unit" and no individual receiving disciplinary action.
b) Each competition group of grassroots units may be considered for one Flag, and groups with 15 or more grassroots units may be considered for two Flags. Public security units and localities should divide competition groups according to guidelines provided by the Ministry of Public Security, suitable to their functions, responsibilities, and organizational structure at each stage.
3. The collective receiving the title "Flag of Excellence of the Ministry of Public Security" must have the agreement of at least 80% of the members of the Competition and Reward Council at the decision-making level.
Article 18. The title "Flag of Excellence of the Government"
1. For units at the Bureau level and provincial public security agencies
a) The title "Flag of Excellence of the Government" may be proposed for units at the Bureau level and provincial public security agencies that meet the following criteria:
- Being selected as outstanding among those units meeting the criteria for the "Flag of Excellence of the Ministry of Public Security";
- Leading in productivity, quality, and effectiveness across all work and combat areas compared to other units in the cluster;
- Initiating practical and effective competitive movements; developing new factors, models, and exemplary cases for the entire People's Public Security force to emulate; having many groups and individuals achieving commendable results and being rewarded;
- Strictly implementing and effectively promoting competitive movements and campaigns; maintaining internal unity and solidarity, complying well with Party policies and State laws, leading in thrift, waste reduction, and anti-corruption efforts.
b) Each cluster of units at the Bureau level and provincial public security agencies may select the unit with the best achievements among those meeting the criteria for the "Flag of Excellence of the Ministry of Public Security" to propose for the "Flag of Excellence of the Government".
2. For grassroots units
a) The title "Flag of Excellence of the Government" may be proposed for grassroots units that meet the following criteria:
- Being selected as the best among those grassroots units meeting the criteria for the "Flag of Excellence of the Ministry of Public Security";
- Leading in productivity, quality, and effectiveness across all work and combat areas within the entire unit at the Bureau level and provincial public security agency;
- All individuals in the unit completing their assigned tasks, with at least 80% of them meeting the criteria for the titles "Exemplary Soldier" or "Exemplary Worker"; having individuals meeting the criteria for "Model Soldier of the Grassroots Unit" and no individual receiving disciplinary action;
- Initiating practical and effective competitive movements; developing new factors, models, and exemplary cases for the entire People's Public Security force to emulate.
b) Each unit at the Bureau level and provincial public security agency may select the best grassroots unit among those meeting the criteria for the "Flag of Excellence of the Ministry of Public Security" to propose for the "Flag of Excellence of the Government".
3. The collective receiving the "Flag of Excellence of the Government" must have received at least 80% approval from the members of the Competition and Reward Council of the Ministry of Public Security.
4. The Standing Committee of the Competition and Reward Council of the Ministry of Public Security is responsible for reviewing achievements, reporting to the Competition and Reward Council of the Ministry of Public Security to select and propose the awarding of the "Flag of Excellence of the Government" not exceeding 20% of the total number of units meeting the criteria for the "Flag of Excellence of the Ministry of Public Security"..
Chapter III
PRINCIPLES, FORMS, OBJECTS AND AWARD CRITERIA
AND REWARD STANDARDS
Article 19. Principles for Awards
1. Awards must be commensurate with the nature of each type of achievement, corresponding to the results achieved or the level of effort, contribution, and dedication of each collective or individual.
2. Achievements that are numerous, significant contributions, wide-ranging impact, or accomplishments made under difficult and complex conditions shall be awarded at a higher level.
3. Regarding specialized awards or awards given during campaigns
a) The level that initiates the campaign or primarily implements the specialized work shall award using the form within its authority;
b) In cases of outstanding achievements with broad influence on the entire force and with the leadership of the Ministry of Public Security's decision to award, the proposal to present the Minister of Public Security's Certificate of Merit shall be made;
c) Proposals for the Prime Minister's Certificate of Merit, the Third-Class National Defense Medal, or the Third-Class Labor Medal shall only be made when summarizing large-scale specialized tasks lasting from three to five years, and there must be guidelines from the Central Steering Committee for Competitions and Rewards;
d) Priority shall be given to rewarding small collectives (department-level, team-level) and officers and soldiers not holding leadership or command positions, directly engaged in combat, labor, or study. Proposals for the Minister of Public Security's Certificate of Merit shall not be made for units at the Bureau level or provincial-level public security forces.
4. Regarding unexpected awards
a) Collectives and individuals achieving a certain level of achievement shall be proposed for an award at that level; when proposing to jointly award the same level of award, the achievements of leaders and commanders must be higher than those of officers and soldiers; it is not necessary to have a lower form of award before being eligible for a higher one;
b) Within one case, the award for leaders and commanders must be less than that for officers and soldiers. National-level awards for leaders and commanders shall only be proposed when the unit they directly oversee is united internally, excelling in their mission (reaching the "Outstanding Unit" title or higher) before and at the time of the award proposal;
c) Cases and special investigations shall not be combined to calculate achievements for unexpected awards;
d) Only propose awards for collectives if more than 50% of subordinate units or more than 50% of the collective's personnel participate in achieving the achievement.
5. Regarding awards based on merit and achievements
a) Only use lower-level awards based on merit and achievements as grounds for proposing higher-level awards based on merit and achievements;
b) The time for submitting the next award application is calculated based on the time recorded in the previous award decision for achieving the achievement. For decisions without a recorded achievement time, the submission time for the next award is calculated from the issuance date of the previous award decision.
6. Regarding awards for dedication over a period
a) Each leader or commander may be considered for an award recognizing dedication once six months prior to retirement. If the required number of years has not been met six months before retirement, they must wait until retirement eligibility is met before proposing;
b) The retirement waiting period is included in the total service time and time in position;
c) For female leaders or commanders, the time in position for considering dedication awards is reduced by one-third compared to the general requirement.
Article 20. Forms and Recipients of Awards in the People's Police
1. Annual awards are given to individuals working in the People's Police force for ten years, fifteen years, twenty years, and twenty-five years or more.
2. Service awards are given to leaders and commanders at the department level or higher who have worked and contributed to the People's Police force according to the provisions of the law.
3. Merit awards are given to collectives and individuals in the People's Police force who have achieved results in the movement "For National Security" continuously for two years or more.
4. Special topic awards are given to collectives and individuals within and outside the People's Police force who have achieved results when summarizing and concluding a special topic of work.
5. Campaign awards are given to collectives and individuals within and outside the People's Police force who have achieved results when summarizing and concluding a campaign.
6. Outstanding achievement awards are given to collectives and individuals within and outside the People's Police force (including foreign organizations and individuals currently working in Vietnam or abroad) who have achieved outstanding and sudden results in national security protection, maintaining public order and social safety, and building the People's Police force.
7. Diplomatic awards are given by the State of Vietnam to foreign collectives and individuals who have achieved results in national security protection and maintaining public order and social safety, or awards given by foreign countries to collectives and individuals belonging to the Vietnam People's Police force.
Article 21. Standards for Medals, Orders, State Honorary Titles, and Certificates of Merit awarded by the Prime Minister to Collectives and Individuals in the People's Police
1. "Golden Star Order" is awarded or posthumously awarded to individuals, and awarded to collectives meeting the standards set forth in Article 34 of the Law on Encouragement and Reward in 2003, Clause 10 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward in 2013, and Article 14 of Decree No. 91/2017/ND-CP.
2. "Ho Chi Minh Order" is awarded or posthumously awarded to individuals and awarded to collectives meeting the standards set forth in Article 35 of the Law on Encouragement and Reward, Clause 11 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward in 2013, and Article 15 of Decree No. 91/2017/ND-CP.
3. "Independence Order" of first class, second class, and third class is awarded or posthumously awarded to individuals, and awarded to collectives meeting the standards set forth in Clauses 12, 13, and 14 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward in 2013, and Articles 16, 17, and 18 of Decree No. 91/2017/ND-CP.
4. "Military Service Order" of first class, second class, and third class is awarded or posthumously awarded to individuals, and awarded to collectives meeting the standards set forth in Clauses 15, 16, and 17 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward in 2013, and Articles 19, 20, and 21 of Decree No. 91/2017/ND-CP.
5. "Labor Order" of first class, second class, and third class is awarded or posthumously awarded to individuals, and awarded to collectives with outstanding achievements in labor, creativity, and construction of the country, meeting the standards set forth in Clauses 18, 19, and 20 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward in 2013, and Articles 22, 23, and 24 of Decree No. 91/2017/ND-CP.
6. "National Defense Order" of first class, second class, and third class is awarded or posthumously awarded to individuals, and awarded to collectives with achievements in training, building forces, and consolidating the whole people's defense and security, meeting the standards set forth in Clauses 21, 22, and 23 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward in 2013, and Articles 25, 26, and 27 of Decree No. 91/2017/ND-CP.
7. "Combat Achievement Order" of first class, second class, and third class is awarded or posthumously awarded to police officers, village police, and various strata of the people, and awarded to collectives with outstanding and sudden achievements in combat, serving combat, maintaining political security, public order, and social safety, meeting the standards set forth in Clause 24 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward in 2013, and Articles 28, 29, and 30 of Decree No. 91/2017/ND-CP.
8. "Bravery Order" is awarded or posthumously awarded to individuals who have shown bravery in work, combat, rescuing people and property of the state and the people, volunteering in dangerous epidemic areas to save lives, and showing bravery in anti-corruption efforts, meeting the standards set forth in Article 50 of the Law on Encouragement and Reward in 2003, and Article 32 of Decree No. 91/2017/ND-CP.
9. The title "Heroic Soldier of the People's Armed Forces," "Heroic Laborer" is awarded or posthumously awarded to individuals, and awarded to collectives with exceptionally outstanding achievements, meeting the standards set forth in Clauses 30 and 31 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward in 2013.
10. "Medal for National Security," "Medal for Distinguished Soldiers" is awarded or posthumously awarded to police officers, non-commissioned officers, and civilian workers who have continuously served and contributed to the People's Police force according to the provisions of Clauses 27 and 28 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward in 2013, Articles 34 and 35 of Decree No. 91/2017/ND-CP, and meeting the following criteria:
a) Strictly adhering to the Party's policies, guidelines, and laws of the State and local regulations where they reside or the regulations of their current workplace.
b) Not having been expelled from the Party (or having been expelled but readmitted), dismissed from service, stripped of the title of People's Police, or criminally prosecuted.
11. "Certificate of Merit from the Prime Minister" is awarded to collectives and individuals who serve as role models and strictly adhere to the Party's policies and State laws, meeting the standards set forth in Clauses 1 and 3 of Article 38 of Decree No. 91/2017/ND-CP.
Article 22. Certificate of Merit of the Minister of Public Security
1. The "Certificate of Merit of the Minister of Public Security" shall be awarded to individuals who set a good example, strictly adhere to the Party's guidelines, State policies and laws, regulations of the Ministry of Public Security, and meet one of the following criteria:
a) Achieve outstanding results recognized during mid-term or final reviews of campaigns or special tasks initiated by the Ministry of Public Security, with implementation across the entire People's Public Security force;
b) Achieve outstanding and exceptional results that have a significant impact on one or more areas of public security work;
c) For two consecutive years or more, consistently perform excellently to be honored with the title of "Model Grassroots Soldier", during which time two initiatives are recognized and effectively implemented within their grassroots level.
2. The "Certificate of Merit of the Minister of Public Security" shall be awarded to exemplary groups that strictly adhere to the Party's guidelines, State policies and laws, regulations of the Ministry of Public Security, maintain internal unity, and meet one of the following criteria:
a) Achieve outstanding results recognized during mid-term or final reviews of campaigns or special tasks initiated by the Ministry of Public Security, with implementation across the entire People's Public Security force;
b) Achieve outstanding and exceptional results that have a significant impact on one or more areas of public security work;
c) For two consecutive years or more, consistently perform excellently to be honored with a commendation title from "Victorious Unit" or "Outstanding Labor Collective" and above, organize effective competitive movements, care for the material and spiritual life of group members, practice thrift, and fully implement all systems and policies.
3. The "Certificate of Merit of the Minister of Public Security" shall be awarded to provincial-level Public Security bureaus and municipal-level Public Security departments at the end of annual competitive movements "For National Security" meeting the following criteria:
a) Strictly implement competitive movements, campaigns, and successfully complete assigned competitive targets and tasks for the year;
b) Achieve outstanding and prominent results in one or several aspects of work;
c) Maintain internal unity and consistency, strictly adhere to the Party's guidelines and State policies and laws, practice thrift, combat waste and corruption, and not have any officers violate laws or regulations of the Ministry of Public Security causing negative public opinion and damaging the reputation of the People's Public Security force.
4. The "Certificate of Merit of the Minister of Public Security" shall be awarded to community police units that have not yet organized regular police forces; Neighborhood Watch Committees; civilian collectives, village, ward, town cadres; and grassroots-level organizational, corporate staff collectives that achieve outstanding results in annual specialized comprehensive national security protection movements, meeting the following criteria:
a) Fully complete all competitive targets, programs, and plans for combating crime and ensuring security and order; have a strong core force for security and order duties (reaching the title of "Advanced Unit" or higher); be a model collective of the province or centrally-administered city or central agency, enterprise regarding the nationwide movement for comprehensive national security protection;
b) Effectively fulfill political tasks of villages, wards, agencies, enterprises; complete production and business plans, fulfill State obligations, and achieve high productivity, quality, economic efficiency, and work effectiveness;
c) Have clean and strong Party organizations and mass organizations, maintain internal unity; effectively implement grassroots democracy regulations; organize effective competitive movements, practice thrift, combat corruption and waste, smuggling, and social evils with practical effects.
Article 23. Certificate of Merit
1. The Certificate of Merit issued by the head of the unit at the Bureau level or the provincial-level Public Security to present to collectives or individuals within the People's Police who have achieved outstanding results during competition periods, special tasks, or completed a project item, part of work ahead of schedule, or achieved sudden achievements in work, combat, labor, or study with influence at the grassroots level, or to present to collectives or individuals with achievements in mid-term or final reviews of special tasks or sudden achievements in the nationwide movement for protecting national security.
3. Based on the legal provisions on rewards and the specific characteristics of the unit, the head of the unit at the Bureau level or the provincial-level Public Security shall establish criteria for presenting the Certificate of Merit.
Article 24. Commemorative Medal "For National Security Protection"
The Commemorative Medal "For National Security Protection" is presented to individuals not belonging to the People's Police Force who have made significant contributions to national security protection work, ensuring social order and safety, and building the People's Police Force, or to individuals who have worked in the People's Police Force for a period not sufficient to be awarded the "Brave Soldier Medal" Class III.
Chapter IV
COMPETITION, RECOGNITION AND AWARD COUNCIL
Article 25. Competition and Recognition Council of the Ministry of Public Security
1. The Competition and Recognition Council of the Ministry of Public Security is the advisory body to the Central Party Committee of the Public Security's Standing Committee and the Minister of Public Security regarding competition activities and recognition and awards within the People's Police. The Minister of Public Security decides to establish and promulgate the operational regulations of the Competition and Recognition Council of the Ministry of Public Security.
2. Composition of the Council:
a) The Chairman of the Council is the Minister of Public Security;
b) The Vice-Chairman of the Council is the Deputy Minister of Public Security in charge of the Political and Ideological Work Department;
c) Members of the Council include: Deputy Ministers of Public Security; Director of the Ministry's Office; Director of the Political and Ideological Work Department (Permanent Member); Head of the Competition and Recognition Section of the Political and Ideological Work Department (Secretary).
3. Tasks and powers of the Council:
a) Develop policies and measures to promote competition movements and recognition and award activities within the People's Police;
b) Supervise and monitor the implementation of policies and guidelines on competition and recognition and award activities within the People's Police;
c) Regularly evaluate the outcomes of competition movements and recognition and award activities within the People's Police;
d) Advise the Minister of Public Security to decide on the presentation of commendation titles and forms of recognition and awards within their authority, or propose to competent authorities to request the presentation of commendation titles and forms of recognition and awards.
4. Supporting bodies of the Council:
a) The Political and Ideological Work Department serves as the Permanent Body of the Competition and Recognition Council of the Ministry of Public Security, responsible for advising the Minister of Public Security to unify management, guidance, inspection, and organization of recognition and award activities throughout the People's Police Force;
b) The Competition and Recognition Section under the Political and Ideological Work Department serves as the specialized body assisting the Competition and Recognition Council of the Ministry of Public Security;
c) The bodies: the Central Party Committee of the Public Security's Inspection Commission, the Inspectorate, and the Cadre and Civil Servant Organization Department are responsible for reviewing and providing information on the resolution of complaints and petitions; inspection conclusions and information on disciplinary violations of collectives and individuals proposed for commendation titles and awards;
d) Units at the Bureau level are responsible for evaluating and assessing the performance of professional work of collectives and individuals to serve competition and recognition and award activities according to assigned functions and tasks or upon request of the Competition and Recognition Council of the Ministry of Public Security.
Article 26. The Competition and Reward Council at the Bureau Level
1. The Competition and Reward Council at the Bureau Level is the advisory body to the Party Committee Standing Committee and the Head of the Bureau regarding the competition and reward activities of the unit. The Head of the Bureau decides on the establishment and issuance of the operational regulations of the Competition and Reward Council at the Bureau Level.
2. Composition of the Council:
a) The Chairman of the Council is the head of the unit;
b) The Vice Chairman of the Council is the Deputy Secretary of the Party Committee of the unit;
c) Members of the Council include Deputy Heads of the Bureau, the Director of the General Affairs Department (or the Head of the Department at the Bureau level with functions related to competition and reward activities of the Bureau), and other members decided by the Chairman of the Council.
3. Tasks and powers of the Council:
a) Develop policies and measures for competition movements and reward work within the Bureau;
b) Urge, inspect, and supervise the implementation of policies and regulations concerning competition and reward work within the Bureau;
c) Regularly evaluate the results of competition movements and reward work within the Bureau;
d) Advise the Head of the Bureau to decide on awarding commendation titles and reward forms within their authority, or to submit to competent authorities for recommending commendation titles and reward forms.
4. The General Affairs Department (or the unit responsible for competition and reward work) serves as the permanent office of the Bureau-level Competition and Reward Council, responsible for advising the Head of the Bureau to unify management, direct, guide, inspect, and organize the implementation of reward work within the Bureau.
Article 27. The Competition and Reward Council at the Provincial Police Level
1. The Competition and Reward Council at the Provincial Police Level is the advisory body to the Party Committee Standing Committee and the Director of the Provincial Police regarding competition and reward activities in the province or centrally governed city. The Director of the Provincial Police decides on the establishment and issuance of the operational regulations of the Provincial Police Competition and Reward Council.
2. Composition of the Council:
- The Chairman of the Council is the Director of the Provincial Police;
- The Vice Chairman of the Council is the Deputy Director in charge of the Party Work and Political Affairs Department;
- Members of the Council include Deputy Directors, the Director of the Party Work and Political Affairs Department, and other members decided by the Chairman of the Council.
3. Tasks and powers of the Council:
a) Develop policies and measures for competition movements and reward work within the provincial police force;
b) Urge, inspect, and supervise the implementation of policies and regulations concerning competition and reward work within the provincial police force;
c) Regularly evaluate the results of competition movements and reward work within the provincial police force;
d) Advise the Director of the Provincial Police to decide on awarding commendation titles and reward forms within their authority, or to submit to competent authorities for recommending commendation titles and reward forms.
4. The Party Work and Political Affairs Department serves as the permanent office of the Council, responsible for advising the Director of the Provincial Police to unify management, direct, guide, inspect, and organize the implementation of reward work within the provincial police force.
Article 28. Competition Clusters
1. Based on geographical location, functions, tasks, nature of work, and scope of operation, the Minister of Public Security decides on the establishment of competition clusters under the Ministry of Public Security comprising units at the Bureau level, provincial police forces, academies, and public security schools.
2. Tasks of the competition cluster:
a) Establish operational regulations for the competition cluster;
b) Organize the launch and signing of competition pledges; set out targets, contents, and methods to implement competition movements within the competition cluster;
c) Inspect and evaluate the effectiveness and impact of competition movements, score, and classify units within the competition cluster according to criteria and competition scoring scales issued by the Competition and Reward Council of the Ministry of Public Security;
d) Summarize and conclude annual competition movements; propose directions and tasks for organizing competition movements within the competition cluster in subsequent years; share experiences, build new models, and exemplary cases to promote within the competition cluster;
đ) Organize selection and promotion of outstanding collectives within the competition cluster to recommend for consideration of awarding the "Flag of Government Competition" and "Flag of Public Security Ministry Competition", and other reward forms.
3. The Head of the Bureau-level unit or the Director of the Provincial Police decides on the establishment and issuance of operational regulations for grassroots competition clusters.
Chapter V
AUTHORITY, SUBMISSION, AND PROCEDURAL DOCUMENTS
CONSIDERATION FOR AWARDING COMPETITION TITLES AND REWARD FORMS
Article 29. Authority to Decide on Awarding Merit Titles and Forms of Reward
1. The authority to decide on awarding national merit titles and forms of reward, as well as national honor titles, shall be implemented in accordance with the provisions set forth in Articles 77 and 78 of the Law on Encouragement and Reward in 2003, and Clauses 45 and 46 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward in 2013.
2. The authority to decide on awarding merit titles and forms of reward within the People's Public Security Force shall be carried out as follows:
a) The Minister of Public Security decides to award the title "Flag of Excellence of the Ministry of Public Security", "Victory Unit", "Outstanding Labor Collective", "Excellence Medalist of the Entire Public Security Force", "Certificate of Merit from the Minister of Public Security", and the Commemorative Medal "National Security Protection".
b) The heads of provincial-level public security departments and the directors of provincial-level public security agencies decide to award the titles "Advanced Unit", "Advanced Labor Collective", "Local Excellence Medalist", "Advanced Soldier", "Advanced Worker", and certificates of merit for collectives and individuals within their units and for other collectives and individuals who have achieved results in their areas of responsibility.
c) The Deputy Minister of Public Security in charge of the Party Work and Political Affairs Department decides to award the titles "Local Excellence Medalist" and "Advanced Soldier" to leaders of provincial-level public security departments and provincial-level public security agencies.
Article 30. Procedure for Rewards
1. The procedure for rewards shall be carried out according to the principle that the level which manages organization, cadres, and salary funds is responsible for rewarding or submitting proposals for rewards to higher levels for objects under its management scope.
2. When local public security units propose to award merit titles and forms of reward within the authority to decide at the ministerial level or above, they must establish files and submit them to the Minister of Public Security through the following procedures:
a) For files proposing to award merit titles and forms of reward to collectives and individuals within the People's Public Security Force, they shall be submitted to the Minister of Public Security (through the Party Work and Political Affairs Department) for examination and decision.
b) For files proposing to reward the mass movement "All People Protecting National Security", they shall be sent to the Mass Movement Building Department for consolidation and submission to the Minister of Public Security (through the Party Work and Political Affairs Department) for examination and decision.
3. Foreign rewards
a) Local public security units proposing foreign rewards or receiving foreign rewards must report to request approval for rewards from the leadership of the Ministry of Public Security.
b) The Party Work and Political Affairs Department takes the lead, coordinating with the Foreign Relations Department to review achievements and implement foreign reward procedures as prescribed after obtaining approval from the leadership of the Ministry to grant rewards.
c) In cases where foreign rewards are proposed according to the instructions of the leadership of the Ministry of Public Security, the Foreign Relations Department takes the lead, establishing files to propose rewards.
4. The procedure for rewarding collectives and individuals specializing in party and mass organization work shall be carried out according to the principle that the level directly managing organization, cadres, and salary funds is responsible for examining and rewarding or submitting proposals for rewards to higher levels.
5. Collectives and individuals belonging to the People's Public Security Force when proposing forms of reward from the Ministry of Public Security and proposing rewards from central ministries and agencies must report through the Party Work and Political Affairs Department to receive guidance, inspection, and supervision.
6. The Party Work and Political Affairs Department takes the lead, coordinating with relevant functional units to guide the examination and awarding of titles such as People's Artist, People's Teacher, People's Doctor, Distinguished Artist, Distinguished Teacher, and Distinguished Doctor in accordance with the regulations of the Government and the characteristics of the People's Public Security Force, ensuring the principle that the grassroots specialized council examines and proposes, the Office of the Ministry of Public Security's Encouragement and Reward Council reviews and reports to the specialized council at the ministry level for examination and approval, and then submits to the national council for decision.
Article 31. Documents and procedures for commendation proposals
1. Collectives and individuals proposed for commendation shall prepare achievement reports according to the model report issued together with Decree No. 91/2017/NĐ-CP.
2. The achievement report of collectives must be confirmed by the direct superior management agency and the level proposing commendation. The achievement report of individuals must be confirmed by their direct management level and the level proposing commendation.
3. For units having the obligation to pay state budget, when preparing documents to propose awarding titles of excellence and national-level commendation forms to the unit or its leadership, there must be a document from the financial agency confirming the following contents:
a) The actual amount of tax and other revenues paid compared to the registered amount in the year;
b) The percentage of state budget revenue paid compared to the previous year;
c) Having paid all taxes and other revenues as prescribed by law on time and in full.
4. In cases of posthumous awards, the political agency at the level proposing to the Minister shall coordinate with the unit directly managing the individual to prepare achievement reports and other documents and procedures for commendation as stipulated.
5. The documents for proposing to award titles of excellence and commendation forms must be original copies, confirmed by the level proposing to the Minister of Public Security, with the following quantities:
a) Documents for proposing to award "Public Security Ministry Flag", "Outstanding People's Police Force Worker", "Minister of Public Security Commendation" include two sets;
b) Documents for proposing to award "Government Flag", "National Outstanding Worker", "Prime Minister Commendation" include three sets;
c) Documents for proposing to award Medals and Orders include four sets;
d) Documents for proposing to confer the title of "People's Armed Forces Hero", "Labor Hero" include five sets.
Article 32. Documents and procedures for proposing to award the titles of "Advanced Soldier", "Commendable Soldier at the grassroots level" for leaders at various levels
The documents for proposing to award the titles of "Advanced Soldier", "Commendable Soldier at the grassroots level" for leaders of provincial-level public security agencies and provincial public security departments include:
1. A proposal letter accompanied by a list of individuals proposed for the titles of "Advanced Soldier", "Commendable Soldier at the grassroots level" of provincial-level public security agencies and provincial public security departments;
2. Minutes of the meeting to assess the achievements of the Commendation Council of provincial-level public security agencies and provincial public security departments;
3. Achievement report of the individual proposed for the titles of "Advanced Soldier", "Commendable Soldier at the grassroots level".
Article 33. Documents and procedures for proposing to award the title of "Outstanding People's Police Force Worker"
The documents for proposing to award the title of "Outstanding People's Police Force Worker" include:
1. A proposal letter accompanied by a list of individuals proposed for the title of "Outstanding People's Police Force Worker" of provincial-level public security agencies and provincial public security departments;
2. Minutes of the meeting to assess the achievements of the Commendation Council of provincial-level public security agencies and provincial public security departments;
3. Summary of achievements of the individuals with confirmation by the head of the provincial-level public security agencies and provincial public security departments;
4. Achievement report of the individual proposed for the title of "Outstanding People's Police Force Worker" with confirmation by the head of the provincial-level public security agencies and provincial public security departments;
5. Copy of the decision to award the title of "Commendable Soldier at the grassroots level" within the three years proposed or research results at the ministry level or other forms of commendation already received during the commendation period (Commendation Certificate, Medal, Gold Medal, Award, and equivalent commendation forms).
Article 34. Documents and Procedures for Proposing to Award the Title "National Model Combatant"
The documents for proposing to award the title "National Model Combatant" include:
1. A report accompanied by a list of individuals proposed for the award of the title "National Model Combatant" from units at the Bureau level and provincial police.
2. Minutes of the meeting to assess the proposal by the Commendation and Reward Council of units at the Bureau level and provincial police.
3. A summary of achievements of the individual with confirmation by the head of the unit at the Bureau level and provincial police.
4. A report on the achievements of the individual proposed for the award of the title "National Model Combatant" with confirmation by the head of the unit at the Bureau level and provincial police.
5. A copy of the decision to award the title "Model Combatant of the People's Public Security Force" twice consecutively and the results of scientific research projects approved at the Ministry level or higher, or special commendations received during the period under consideration (Military Merit Medal, Bravery Medal, Military Service Medal, National Defense Medal, Labor Medal).
Article 35. Documents and Procedures for Proposing to Award the Flag of Excellence of the Ministry of Public Security
1. The documents for proposing to award the Flag of Excellence of the Ministry of Public Security to units at the Bureau level and provincial police include:
a) A report proposing to award the Flag of Excellence of the Ministry of Public Security;
b) Minutes of the meeting to assess the proposal by the Commendation and Reward Council of units at the Bureau level and provincial police;
c) A report on the achievements of the unit proposed for commendation;
d) A summary of the achievements of the unit proposed for commendation.
2. The documents for proposing to award the Flag of Excellence of the Ministry of Public Security to grassroots units include:
a) A report accompanied by a list of grassroots units proposed for the award of the Flag of Excellence of the Ministry of Public Security from units at the Bureau level and provincial police;
b) Minutes of the meeting of the Commendation and Reward Council of units at the Bureau level and provincial police;
c) A report on the achievements of the unit proposed for commendation with confirmation by the head of the unit at the Bureau level and provincial police;
d) A summary of the achievements of the unit proposed for commendation.
Article 36. Documents and Procedures for Proposing to Award the Flag of Excellence of the Government
The documents for proposing to award the Flag of Excellence of the Government include:
1. A report proposing to award the Flag of Excellence of the Government.
2. Minutes of the meeting to assess the proposal by the Commendation and Reward Council of units at the Bureau level and provincial police.
3. A report on the achievements of the collective proposed for the award of the Flag of Excellence of the Government with confirmation by the head of the unit at the Bureau level and provincial police.
4. A summary of the achievements of the collective proposed for the award of the Flag of Excellence of the Government.
Article 37. Documents and Procedures for Proposing to Award the Certificate of Merit of the Minister of Public Security
1. The documents for proposing to award the Certificate of Merit of the Minister of Public Security to units at the Bureau level and provincial police in the annual summary of the "For Homeland Security" campaign include:
a) A report from units at the Bureau level and provincial police;
b) Minutes of the meeting of the Commendation and Reward Council of units at the Bureau level and provincial police;
c) A report on the achievements of the collective proposed for commendation.
2. The documents for proposing to award the Certificate of Merit of the Minister of Public Security for outstanding achievements, special contributions, thematic activities, and campaigns within the People's Public Security Force include:
a) A report accompanied by a list of collectives and individuals proposed for commendation from units at the Bureau level and provincial police;
b) Minutes of the meeting to assess the proposal by the Commendation and Reward Council of units at the Bureau level and provincial police;
c) A report on the achievements of the collectives and individuals proposed for commendation with confirmation by the head of the unit at the Bureau level and provincial police.
3. The documents for proposing to award the Certificate of Merit of the Minister of Public Security for achievements in the "All-People National Security Guard" movement include:
a) A report accompanied by a list of collectives and individuals proposed for commendation from units at the Bureau level and provincial police;
b) Minutes of the meeting of the Commendation and Reward Council of units at the Bureau level and provincial police;
c) A report on the achievements of the collectives and individuals proposed for commendation with confirmation by the head of the unit at the Bureau level and provincial police.
Article 38. Documents and Procedures for Proposing to Award "Certificate of Merit from the Prime Minister"
The documents for proposing to award "Certificate of Merit from the Prime Minister" include:
1. A report accompanied by a list of collectives and individuals proposed for commendation from units at the Bureau level and provincial police.
2. Minutes of the meeting of the Competition and Commendation Council of units at the Bureau level and provincial police.
3. Reports on achievements of collectives and individuals proposed for commendation, confirmed by the head of units at the Bureau level and provincial police.
4. Summary of achievements of collectives and individuals proposed for commendation.
Article 39. Documents and Procedures for Proposing to Award Medals
The documents for proposing to award medals include:
1. A report accompanied by a list of collectives and individuals proposed for commendation from units at the Bureau level and provincial police.
2. Minutes of the meeting of the Competition and Commendation Council of units at the Bureau level and provincial police.
3. Reports on achievements of collectives and individuals proposed for commendation, confirmed by the head of units at the Bureau level and provincial police.
4. Summary of achievements of collectives and individuals proposed for commendation.
Article 40. Documents and Procedures for Proposing to Award Titles of "Heroic Forces Soldier" and "Labor Hero"
The documents for proposing to award titles of "Heroic Forces Soldier" and "Labor Hero" include:
1. A report from units at the Bureau level and provincial police.
2. A proposal document from the Party Committee at the same level.
3. Minutes of the meeting to review proposals of the Competition and Commendation Council of units at the Bureau level and provincial police.
4. Reports on achievements of collectives and individuals proposed for commendation, confirmed by the head of units at the Bureau level and provincial police.
5. Summary of achievements of collectives and individuals proposed for commendation.
Article 41. Documents and Procedures for Proposing to Award Anniversary Medals
1. The documents for proposing to award anniversary medals include:
a) A report from units at the Bureau level and provincial police;
b) A brief list of individuals proposed for commendation.
2. Annually, local police units prepare documents to propose awarding anniversary medals once before August 30.
Article 42. Commendation with Simplified Procedures
1. Commendation with simplified procedures is implemented in cases where all of the following conditions are met:
a) Commendation serving political requirements, timely encouraging and motivating cadres, soldiers, and the people's movement to protect national security;
b) Collectives and individuals achieving outstanding and sudden accomplishments in combat, work, labor, and study;
c) Notable feats and achievements.
2. Documents for proposing rewards through simplified procedures include:
a) A report accompanied by a list of collectives and individuals proposed for commendation from the level reporting to the Minister (clearly indicating that it is proposed according to simplified procedures);
b) A summary of achievements of collectives and individuals proposed for commendation prepared by the directly managing agency or unit, clearly stating the achievements and merits proposed for commendation according to simplified procedures.
Article 43. Documents and Procedures for Commendation by Ministries for Achievements with State Secrets Content
1. Commendation for secret collaborators, socialized detectives, and intelligence agents under covert intelligence methods:
a) Units at the Bureau level and provincial police directly report to the leader of the Ministry of Public Security responsible for the professional field regarding the achievements of individuals and bear responsibility for the accuracy of the commendation proposal;
b) After receiving approval from the leadership of the Ministry of Public Security to commend, units at the Bureau level and provincial police submit a report to the Minister of Public Security (the report only states the number of individuals proposed for commendation, without submitting achievement reports and name lists);
c) The Permanent Office of the Competition and Commendation Council of the Ministry of Public Security is responsible for presenting the leadership of the Ministry of Public Security to sign the commendation decision and send the certificate of merit or commemorative medal along with commendation items to local police units to complete the commendation process.
2. Commendation for special cases and top-secret cases:
For this commendation proposal, collectives and individuals proposed for commendation do not need to write achievement reports, the commendation documents include:
a) A report from units at the Bureau level and provincial police;
b) A brief summary of achievements prepared by the directly managing unit of the collective and individual who achieved the accomplishment, confirmed by the head of units at the Bureau level and provincial police.
Chapter VI
COMPETITION AND COMMENDATION FUNDS,
PRIZE MONEY AND ORGANIZATION OF AWARDS
Article 44. Fund for Competition, Awards, and Prize Money
1. The establishment, management, and utilization of the fund for competition and awards shall be carried out in accordance with the provisions of Articles 64, 65, 66, and 67 of Decree No. 91/2017/NĐ-CP.
2. Collectives and individuals who are awarded will also receive prize money at the level specified in Article 69 of Decree No. 91/2017/NĐ-CP.
3. Overseas Vietnamese, foreign individuals, and collectives who are awarded will receive commemorative gifts corresponding to their awards (without accompanying prize money).
Article 45. Other Benefits
Individuals who are awarded Orders, State Honorary Titles; the title "National Model Worker," "Model Worker of the National Public Security Force," in addition to being awarded according to regulations, shall also enjoy other benefits as follows:
1. Cases where promotion to rank or salary grade advancement before the regular term falls within the authority of the Minister of Public Security include:
a) Those honored with the title "People's Armed Forces Hero" or "Labor Hero" may be proposed for promotion to one higher rank or salary grade advancement beyond the regular term;
b) Those awarded the "Military Merit Order" may be proposed for promotion to rank or salary grade advancement two years ahead of the regular term;
c) Those awarded the "Bravery Medal," "Combat Merit Medal," "National Defense Medal," "Labor Medal," or honored with the title "National Model Worker," "Model Worker of the National Public Security Force" may be proposed for promotion to rank or salary grade advancement one year ahead of the regular term.
2. In cases where multiple honors or awards are received during the regular term, only the highest priority level provided shall be implemented. If the award year coincides with the regular term for promotion to rank or salary grade advancement, it will be considered for the subsequent term. For those who have reached the maximum limit for promotion to rank or salary grade advancement, they will be given priority for rest and recuperation.
3. In addition to the above benefits, individuals who are awarded may be prioritized for dispatch to study, training, work, and further education both domestically and abroad, consistent with their current profession and expertise.
Article 46. Organization of Award Presentation
1. The organization of presenting the "Flag of Excellence from the Government," "National Model Worker," Orders, Medals, and "Certificate of Merit from the Prime Minister" shall be carried out in accordance with the Government's regulations on organizing memorial days; the ceremony for presenting and receiving awards and commendations shall follow the regulations of the Minister of Public Security regarding Police Ceremonies.
2. For the forms of award "People's Armed Forces Hero," "Labor Hero," "Golden Star Order," and "Ho Chi Minh Order," the unit with the collective or individual being awarded shall take the lead and coordinate with the Political and Mass Work Department to report to the Minister of Public Security before organizing the presentation and reception ceremony.
3. The Minister of Public Security shall directly present the awards or delegate to Deputy Ministers, Heads of agencies, and units to present the titles and forms of commendation within the Minister's authority.
4. The Head of the Public Security Unit or locality shall present the titles and forms of commendation within their authority.
5. The presentation and reception of titles and forms of commendation should be combined with the organization of summary meetings, memorial days, and traditional days; separate ceremonies for presenting and receiving titles and forms of commendation should not be organized (except for exceptional awards and awards for combat achievements).
6. Only one announcement, presentation, and reception shall be made for each title or form of commendation.
7. Present the titles and forms of commendation in descending order of importance. In cases of the same form of commendation, present to the collective first, then to the individual, and present before posthumous presentation.
8. The organization of presenting titles and forms of commendation must be solemn, practical, avoiding ostentation, formalism, and waste.
Chapter VII
IMPLEMENTING PROVISIONS
Article 47. Effective Date
This Circular takes effect from July 12, 2019, replacing Circular No. 40/2014/TT-BCA dated September 23, 2014, issued by the Minister of Public Security detailing and guiding the implementation of competition and commendation activities in the National Public Security Force, Village Public Security, and People's Security Guard Movement, and Circular No. 17/2015/TT-BCA dated May 4, 2015, issued by the Minister of Public Security amending and supplementing some articles of Circular No. 40/2014/TT-BCA.
Article 48. Implementation organization
1. The Political and Mass Work Department is responsible for inspecting, urging, and guiding the implementation of this Circular.
2. The Planning and Finance Department is responsible for guiding the implementation of the system for establishing, managing, and utilizing the fund for competition and commendation, and the level of expenditure for prize money in the National Public Security Force and the "All-People Participating in Protecting National Security" movement.
3. Heads of Departments at the Bureau level and Provincial Public Security shall issue specific guidelines based on this Circular regarding the criteria, files, procedures for proposing to grant titles and forms of commendation within their authority.
During the implementation process, if there are difficulties or obstacles, local Public Security units shall reflect them to the Ministry of Public Security (through the Political and Mass Work Department) for timely guidance./.
