CIRCULAR
Guidelines on the transfer and adjustment of salary grades for vocational education professionals
pursuant to Decree No. 29/2012/ND-CP dated April 12, 2012 of the Government on recruitment, utilization, and management of civil servants;

Decree No. Pursuant to Decree No. 161/2018/ND-CP dated November 29, 2018 of the Government amending and supplementing certain provisions on recruitment of public officials and civil servants, promotion of civil servant ranks, upgrading of civil servant positions, and implementation of employment contracts for certain types of work in administrative agencies and public institutions; Pursuant to Decision No. 17/2017/QD-TTg dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
Decree No. After receiving the opinion of the Ministry of Home Affairs at Circular No. 1463/BNV-CCVC dated April 4, 2019 regarding the unified issuance of this Circular guiding the transfer and adjustment of salary grades for vocational education professionals; The Minister of Labor, Invalids and Social Affairs hereby issues this Circular guiding the transfer and adjustment of salary grades for vocational education professionals.
Decree No. Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on wage systems for civil servants, public officials, and members of the armed forces;
Decree No. 14/2017/NĐ-CP Article 1. This Circular guides the transfer and adjustment of salary grades for civil servants assigned to vocational education professional positions as prescribed in Circular No. 10/2018/TT-BNV dated September 13, 2018 of the Minister of Home Affairs on the job code of vocational education professionals (hereinafter referred to as Circular No. 10/2018/TT-BNV) and Circular No. 03/2018/TT-BLDTBX dated June 15, 2018 of the Minister of Labor, Invalids and Social Affairs on the criteria for vocational education professional positions (hereinafter referred to as Circular No. 03/2018/TT-BLDTBX).
Article 2. This Circular applies to lecturers teaching at college level, teachers teaching at secondary and basic levels in public colleges, secondary schools, vocational training centers, and vocational training and continuing education centers (hereinafter referred to as public vocational education institutions).
At the proposal of the Director General of the General Department of Vocational Education;
Teachers currently engaged in cultural subject teaching in public vocational education institutions shall have their salary adjustments implemented according to regulations issued by the Ministry of Education and Training and the Ministry of Home Affairs.
Article 1. Scope of Regulation and Applicability
Article 3. Principles for implementing the transfer and adjustment of salary grades for vocational education professionals
Clause 1. The appointment and salary assignment to the position of vocational education lecturer or teacher must be based on the job responsibilities, duties, tasks, capabilities, and professional qualifications currently held by the civil servant.
Clause 2. When transferring from the current professional position to a corresponding vocational education lecturer or teacher position, it is not allowed to combine with salary grade advancement or professional position promotion.
Article 4. Transfer and adjustment of salary grades for vocational education lecturers and teachers
Clause 1. Civil servants appointed to vocational education lecturer and teacher positions as prescribed in Circular No. 10/2018/TT-BNV and Circular No. 03/2018/TT-BLDTBX shall apply the corresponding salary scale issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, public employees, and armed forces personnel, specifically as follows:
Point a. For vocational education lecturers
Vocational education senior lecturer (Grade I), code: V.09.02.01, shall apply the salary coefficient of Category A3 Group 1 (A3.1) from coefficient 6.20 to coefficient 8.00;
Vocational education main lecturer (Grade II), code: V.09.02.02, shall apply the salary coefficient of Category A2 Group 1 (A2.1) from coefficient 4.40 to coefficient 6.78;
Vocational education theoretical lecturer (Grade III), code: V.09.02.03, shall apply the salary coefficient of Category A1 from coefficient 2.34 to coefficient 4.98;
Vocational education practical lecturer (Grade III), code: V.09.02.04, shall apply the salary coefficient of Category A0 from coefficient 2.10 to coefficient 4.89.
Point b. For vocational education teachers
Vocational education teacher Grade I, code: V.09.02.05, shall apply the salary coefficient of Category A3 Group 2 (A3.2) from coefficient 5.75 to coefficient 7.55;
Vocational education teacher Grade II, code: V.09.02.06, shall apply the salary coefficient of Category A2 Group 1 (A2.1) from coefficient 4.40 to coefficient 6.78;
Vocational education theoretical teacher Grade III, code: V.09.02.07, shall apply the salary coefficient of Category A1 from coefficient 2.34 to coefficient 4.98;
Vocational education practical teacher Grade III, code: V.09.02.08, shall apply the salary coefficient of Category A0 from coefficient 2.10 to coefficient 4.89;
Vocational education teacher Grade IV, code: V.09.02.09, shall apply the salary coefficient of Category B from coefficient 1.86 to coefficient 4.06.
Theoretical vocational education teacher of Class III, code number: V.09.02.07, shall apply the salary coefficient of Category A1 staff from salary coefficient 2.34 to salary coefficient 4.98;
Practical vocational education teacher of Class III, code number: V.09.02.08, shall apply the salary coefficient of Category A0 staff from salary coefficient 2.10 to salary coefficient 4.89;
Vocational education teacher of Class IV, code number: V.09.02.09, shall apply the salary coefficient of Category B staff from salary coefficient 1.86 to salary coefficient 4.06.
2. The salary grading for civil servants currently engaged in teaching at public vocational education institutions, who are currently graded under the ranks of civil servants and civil servants in the education and training sector as stipulated in Decision No. 202/TCCP-VC dated June 8, 1994, issued by the Minister, Head of the Organizational-Civil Service Department of the Government (now the Minister of Home Affairs) on the issuance of professional standards for ranks of civil servants in the education and training sector (hereinafter referred to as Decision No. 202/TCCP-VC); Circular Joint No. 81/2005/TTLT-BNV-BTC dated August 10, 2005, issued by the Minister of Home Affairs and the Minister of Finance guiding the implementation of the transition from old salary grades to new salary grades for certain ranks of civil servants and civil servants newly added or changed in classification within the Water Resources, Education and Training, Culture and Information, Health, and Market Management sectors (hereinafter referred to as Circular Joint No. 81/2005/TTLT-BNV-BTC) and Circular Joint No. 36/2014/TTLT-BGDĐT-BNV dated November 28, 2014, issued by the Minister of Education and Training and the Minister of Home Affairs on the code and professional standards for teaching positions in public higher education institutions (hereinafter referred to as Circular Joint No. 36/2014/TTLT-BGDĐT-BNV) to the profession titles of vocational education teachers and vocational education instructors as stipulated in Circular No. 10/2018/TT-BNV and Circular No. 03/2018/TT-BLDTBXH shall be carried out according to the guidance provided in Clause 2 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Minister of Home Affairs on salary grading when upgrading, changing ranks, or changing classification of civil servants and civil servants, specifically as follows:
Vocational education theoretical lecturer (Grade III), code: V.09.02.03, shall apply the salary coefficient of Category A1 from coefficient 2.34 to coefficient 4.98;
Salary grading for senior vocational education instructor (Class I), code: V.09.02.01 for civil servants currently graded as senior instructor, code 15.109 (Decision No. 202/TCCP-VC) or senior instructor (Class I), code V.07.01.01 (Circular Joint No. 36/2014/TTLT-BGDĐT-BNV);
Salary grading for principal vocational education instructor (Class II), code: V.09.02.02 for civil servants currently graded as principal instructor, code 15.110 or high school teacher, code 15.112 (Decision No. 202/TCCP-VC) or principal instructor (Class II), code V.07.01.02 (Circular Joint No. 36/2014/TTLT-BGDĐT-BNV);
Salary grading for theoretical vocational education instructor (Class III), code: V.09.02.03 for civil servants currently graded as instructor, code 15.111, or high school teacher, code 15.113 (Decision No. 202/TCCP-VC) or instructor (Class III), code V.07.01.03 (Circular Joint No. 36/2014/TTLT-BGDĐT-BNV);
Salary grading for practical vocational education instructor (Class III), code: V.09.02.04 for civil servants currently graded as high school teacher (not yet qualified), code 15c.207 (Circular Joint No. 81/2005/TTLT-BNV-BTC);
Vocational education theoretical teacher Grade III, code: V.09.02.07, shall apply the salary coefficient of Category A1 from coefficient 2.34 to coefficient 4.98;
Salary grading for vocational education teacher (Class II), code: V.09.02.06 for civil servants currently graded as high school teacher, code 15.112 (Decision No. 202/TCCP-VC);
Salary grading for theoretical vocational education teacher (Class III), code: V.09.02.07 for civil servants currently graded as high school teacher, code 15.113 (Decision No. 202/TCCP-VC);

Article 4. Organization of Implementation
1. The head of a public vocational education institution directly managing and using civil servants shall be responsible for reviewing job positions within the unit, compiling a list of civil servants eligible to transfer to the professional positions of vocational education specialists within their management scope, submitting it to the competent authority for consideration and decision-making or deciding according to the delegated authority;
2. Ministries, ministerial-level agencies, government-affiliated agencies, provincial People's Committees, and centrally-administered city People's Committees shall be responsible for:
a) Directing subordinate units under their management to implement the appointment and salary grading of vocational education instructor and vocational education teacher positions in public vocational education institutions as stipulated in this Circular;
b) Deciding or delegating authority for transferring salary grades in public vocational education institutions under their management from current professional positions to corresponding vocational education specialist positions as stipulated in this Circular;
c) Resolving issues within their jurisdiction during the process of transferring salary grades to vocational education specialist positions as stipulated in this Circular;
Article 5. Effective Date
This Circular takes effect from September 26, 2019;
Article 6. Responsibility for Implementation
1. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees, and centrally-administered city People's Committees shall be responsible for implementing this Circular;
2. In case of any difficulties during implementation, please report to the Ministry of Labor, Invalids, and Social Affairs for review and resolution./.
