CIRCULAR
Amending, supplementing, and abolishing certain articles of Circular No. 09/2017/TT-BCT dated July 13, 2017, issued by the Minister of Industry and Trade on technical safety inspection activities for labor under the management authority of the Ministry of Industry and Trade, and some inspection procedures issued together with Circular No. 10/2017/TT-BCT dated July 26, 2017, issued by the Minister of Industry and Trade on technical safety inspection procedures for machinery, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Industry and Trade.
Pursuant to the Labor Safety Law dated June 25, 2015;
Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 44/2016/NĐ-CP dated May 15, 2016, issued by the Government detailing certain provisions of the Labor Safety Law regarding technical safety inspection activities, occupational safety training, and labor environment monitoring;
Pursuant to Decree No. 140/2018/NĐ-CP dated October 8, 2018, issued by the Government amending and supplementing several decrees related to investment conditions and administrative procedures under the management of the Ministry of Labor, Invalids, and Social Affairs;

The Minister of Industry and Trade issues this Circular to amend, supplement, and abolish certain articles of Circular No. 09/2017/TT-BCT dated July 13, 2017, issued by the Minister of Industry and Trade on technical safety inspection activities for labor under the management authority of the Ministry of Industry and Trade, and some inspection procedures issued together with Circular No. 10/2017/TT-BCT dated July 26, 2017, issued by the Minister of Industry and Trade on technical safety inspection procedures for machinery, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Industry and Trade.
Article 1. Amending, supplementing, and abolishing certain articles of Circular No. 09/2017/TT-BCT dated July 13, 2017, issued by the Minister of Industry and Trade on technical safety inspection activities for labor under the management authority of the Ministry of Industry and Trade
1. Clause 5, Clause 7, Article 3 shall be amended as follows:
"5. The objects subject to Group E inspection (Group E) are hydraulic single support columns, mobile frame structures, and self-propelled support frames (hydraulic support columns, single hydraulic supports, hydraulic frame supports, and hydraulic support frames) used in underground mining operations."
"7. The objects subject to Group H inspection (Group H) are explosion-proof electrical devices used in environments with fire and explosion risks."
"c) For Group E
- Pressure testing system for valves, hydraulic support columns, and pressure pipes;
- Pressure maintenance device for hydraulic support column testing;
- Device for testing beams and roof of frame or hydraulic frame supports;
- Quality welding inspection device;
- Various types of pressure gauges;
No requirement for beam and roof of frame or hydraulic frame support testing device, quality welding inspection device for organizations conducting only hydraulic support column inspections."
3. Clause 4, Article 9 shall be amended as follows:
"4. The equipment, tools serving inspection, and inspectors mentioned in Articles 4 and 7 of this Circular may only be used as conditions for issuing a Certificate of Eligibility for an Inspection Organization."
4. Clause 6, Article 17 shall be supplemented as follows:
"6. Send a written notification to the Department of Technical Safety and Industrial Environment no later than ten days from the date of change in inspectors or persons responsible for inspection activities used as conditions for issuing a Certificate of Eligibility for an Inspection Organization."
a) Abolish the following equipment at point đ, Clause 2, Article 4:
b) Abolish point b, Clause 1, Article 12.
"- Explosion pressure testing device and flame propagation testing device;
- Safe spark testing device;
- Thermal shock testing device."
Article 2. Amend, supplement, and abolish certain provisions in the technical safety inspection procedure for labor issued together with Circular No. 10/2017/TT-BCT dated July 26, 2017, of the Minister of Industry and Trade on the technical safety inspection procedure for machinery, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Industry and Trade.
1. QTKĐ 09-2017/BCT - Technical Safety Inspection Procedure for Single Hydraulic Support Columns, Mobile Frame Supports, and Self-Propelled Support Frames Constructed from Single Hydraulic Support Columns Used in Underground Mine Support Operations shall be amended, supplemented, and abolished as follows:
a) Section 3 shall be supplemented as follows:
"- QCVN 03:2017/BCT, National Technical Regulation on Safety for Single Hydraulic Supports Used in Underground Coal Mines."
b) Point a of Section 5.1 shall be amended as follows:
"a) Initial inspection before putting into use."
c) Point a of Section 5.3 shall be amended as follows:
"a) Single hydraulic support columns, single hydraulic props, hydraulic support frames, and hydraulic frame supports currently in use in underground mines must undergo inspection once every year. In cases where single hydraulic support columns, single hydraulic props, hydraulic support frames, and hydraulic frame supports supporting the mine cannot be taken out for inspection, they must be removed for inspection after the support work is completed."
d) Section 6 shall be amended as follows:
"6. Implementation Organization
The inspection of single hydraulic support columns, single hydraulic props, hydraulic support frames, and hydraulic frame supports shall be carried out by inspectors who have been certified.
6.1. For the user entity
- Conduct inspections within the prescribed time limit.
- Provide relevant technical files and documents related to the inspected equipment.
- Prepare all necessary conditions for technical safety inspections such as load capacity, service personnel, operators, electricity, sanitation, maintenance, repair of equipment, and necessary safety measures such as warning signs, signals, and guards.
- Appoint representatives to witness and coordinate during the inspection process.
6.2. For the Inspection Organization
- Conduct inspections based on the user entity's request. If it is not possible to conduct the inspection, a written response explaining the reasons must be provided to the user entity.
- Inspections must comply with relevant technical safety standards and occupational health regulations.
- Based on specific equipment, carry out appropriate inspections according to the steps specified in this procedure to ensure accurate conclusions about the equipment's condition.
- When additional testing equipment beyond standard inspection equipment is required, agreements with the user entity regarding any additional costs must be made to proceed.
- During the inspection, if potential hazards leading to accidents are discovered, recommendations for corrective actions must be made to the user entity. After the user entity has implemented the corrective actions, the inspection can continue.
Record the inspection results and issue a Certificate of Inspection Results in accordance with the regulations."
đ) Replace the phrase "single hydraulic support columns, mobile frame supports, and self-propelled support frames" with "single hydraulic support columns, single hydraulic props, hydraulic support frames, and hydraulic frame supports" in Section 9.
e) Amend the phrase "10.2.1. For initial inspection equipment" to "10.2.1. For initial inspection equipment before putting into use"; amend the phrase "10.2.3. Prepare all necessary inspection tools to serve the inspection process" to "10.2.5. Prepare all necessary inspection tools to serve the inspection process"; and amend the phrase "10.2.4. Safety regulations when inspecting single hydraulic support columns, mobile frame supports, and self-propelled support frames" to "10.2.6. Safety regulations when inspecting" in Section 10.
g) Section 10.4.1 shall be amended as follows:
"10.4.1. Record the inspection results for single hydraulic support columns according to Appendix 1 of this procedure, and record the inspection results for single hydraulic props, hydraulic support frames, and hydraulic frame supports according to Appendix 2 of this procedure."
h) Abolish the quantity provision in Table 1 of Section 7.
i) Replace the phrase "single hydraulic support columns" with "single hydraulic support columns" in Appendix 1.
k) Replace the phrase "mobile frame supports and self-propelled support frames" with "single hydraulic props, hydraulic support frames, and hydraulic frame supports" in Appendix 2.
2. QTKĐ 10-2017/BCT - Technical Safety Inspection Procedure for Winches and Load Hoists with a Load Capacity of 10,000N or More Used in Underground Mining Operations shall be amended and abolished as follows:
a) Amend the phrase "with winch drum diameter < 0.6 m" to "with winch drum diameter ≤ 0.6 m" in Section 1.
b) Amend the phrase "≤ Vmax x 6 (mm)" to "≤ Vmax x 6 (s)" at item number 5 of the section "C. Load Test" in Appendix 3.
c) Abolish the "Braking Moment" test item at item number 11 of the section "B. External Inspection, No-Load Test" in Appendix 3.
3. QTKĐ 11-2017/BCT - Technical Safety Inspection Procedure for Explosion-Proof Transformers shall be amended and supplemented as follows:
a) Supplement item number 15 of Section 3: "QCVN 03:2019/BCT, National Technical Regulation on Safety for Explosion-Proof Transformer Stations Used in Underground Mines."
b) Amend the phrase "Inspection before putting into use" to "Initial inspection before putting into use" in Sections 4.3 and 9.1.
c) Section 5.3 shall be amended as follows:
"5.3. Abnormal Inspection
Abnormal inspection shall be conducted in the following cases:
- After repairs, upgrades, modifications, or changes in installation location that affect the technical safety condition of the explosion-proof transformer.
- Explosion-proof transformers that have not operated for 12 months or more.
- Upon request of the competent authority."
d) Supplement the following contents to Step 3 of Section 9.1:
"- Check light-penetrating elements (if any).
- Check the torque of cable anchor bolts."
đ) Supplement the following content to Step 3 of Section 9.2:
"- Check connecting elements and connections of the equipment."
e) Section 9.3 shall be amended as follows:
"9.3. Abnormal Inspection
- In case of repairs, modifications, or upgrades:
+ Review design documents for repairs, modifications, or upgrades.
+ Acceptance records after repairs, modifications, or upgrades of the transformer station.
+ Carry out inspection steps as stipulated in Section 9.1."
In cases where repairs affect the safety structure of explosion-proof equipment, inspection and testing steps must be carried out according to technical requirements of current standards and regulations.
If the test contents relate to equipment outside the equipment requirements at point đ Clause 2 Article 4 Circular No. 09/2017/TT-BCT and the certification organization does not have testing equipment to perform these contents, the inspection and testing must be conducted at testing organizations designated by the Ministry of Industry and Trade as prescribed.
- In case of changing the installation location:
+ Check the installation records and actual installation of the equipment;
+ Carry out certification procedures as stipulated in Section 9.1.
- In case the explosion-proof transformer has not operated for 12 months or more, review the technical safety certification records and carry out certification procedures as stipulated in Section 9.1."
g) Replace Appendix attached to Circular QTKĐ 11-2017/BCT with Appendix attached to this Circular.
4. QTKĐ 12-2017/BCT - Technical Safety Certification Process for Explosion-Proof Electric Motor is amended and supplemented as follows:
a) Amend the phrase "Pre-use Certification" to "Initial Certification Before Use" in Section 4.3 and Section 9.1.
b) Section 5.3 is amended as follows:
"5.3. Abnormal Inspection
Abnormal inspection shall be conducted in the following cases:
- After repair, upgrade, renovation, or change in installation location affecting the technical safety condition of the explosion-proof electric motor.
- The explosion-proof electric motor has not operated for 12 months or more.
- Upon request of the competent authority."
c) Add the following content to Step 2 of Section 9.1:
"- Inspect the transparent elements (if present)."
d) Add the following content to Step 3 of Section 9.2:
"- Inspect the connecting elements and connections of the equipment."
đ) Section 9.3 is amended as follows:
"9.3. Abnormal Inspection
- In case of repairs, modifications, or upgrades:
+ Review design documents for repairs, modifications, or upgrades.
+ Acceptance certificate after repair, renovation, and upgrade of the explosion-proof electric motor.
+ Carry out inspection steps as stipulated in Section 9.1."
In cases where repairs affect the safety structure of explosion-proof equipment, inspection and testing steps must be carried out according to technical requirements of current standards and regulations.
If the test contents relate to equipment outside the equipment requirements at point đ Clause 2 Article 4 Circular No. 09/2017/TT-BCT and the certification organization does not have testing equipment to perform these contents, the inspection and testing must be conducted at testing organizations designated by the Ministry of Industry and Trade as prescribed.

e) Amend the phrase "4. General Conclusion and Recommendations" to "IV. GENERAL CONCLUSION AND RECOMMENDATIONS" in the Appendix.
5. QTKĐ 13-2017/BCT - Technical Safety Certification Process for Explosion-Proof Distribution and Switchgear Equipment is amended and supplemented as follows:
a) Amend the phrase "Pre-use Certification" to "Initial Certification Before Use" in Section 4.3 and Section 9.1.
b) Section 5.3 is amended as follows:
"5.3. Abnormal Inspection
Abnormal inspection shall be conducted in the following cases:
- After repair, upgrade, renovation, or change in installation location affecting the technical safety condition of the explosion-proof distribution and switchgear equipment.
- The explosion-proof distribution and switchgear equipment has not operated for 12 months or more;
- Upon request of the competent authority."
c) Add the following content to Step 3 of Section 9.1:
"- Inspect the transparent elements."
d) Add the following content to Step 3 of Section 9.2:
"- Inspect the connecting elements and connections of the equipment."
đ) Section 9.3 is amended as follows:
"9.3. Abnormal Inspection
- In case of repairs, modifications, or upgrades:
+ Review design documents for repairs, modifications, or upgrades.
+ Acceptance certificate after repair, renovation, and upgrade of the explosion-proof distribution and switchgear equipment.
+ Carry out inspection steps as stipulated in Section 9.1."
In cases where repairs affect the safety structure of explosion-proof equipment, inspection and testing steps must be carried out according to technical requirements of current standards and regulations.

e) Amend the phrase "4. General Conclusion and Recommendations" to "IV. GENERAL CONCLUSION AND RECOMMENDATIONS" in the Appendix.
6. QTKĐ 14-2017/BCT - Technical Safety Certification Process for Explosion-Proof Control Equipment is amended and supplemented as follows:
a) Amend the phrase "Pre-use Certification" to "Initial Certification Before Use" in Section 4.3 and Section 9.1.
b) Section 5.3 is amended as follows:
"5.3. Abnormal Inspection
Abnormal inspection shall be conducted in the following cases:
- After repair, upgrade, renovation, or change in installation location affecting the technical safety condition of the explosion-proof control equipment.
- The explosion-proof control equipment has not operated for 12 months or more.
- Upon request of the competent authority."
c) Add the following content to Step 3 of Section 9.2:
"- Inspect the connecting elements and connections of the equipment."
d) Section 9.3 is amended as follows:
"9.3. Abnormal Inspection
- In case of repairs, modifications, or upgrades:
+ Review design documents for repairs, modifications, or upgrades.
+ Acceptance certificate after repair, renovation, and upgrade of the explosion-proof control equipment.
+ Carry out inspection steps as stipulated in Section 9.1."
In cases where repairs affect the safety structure of explosion-proof equipment, inspection and testing steps must be carried out according to technical requirements of current standards and regulations.

7. QTKĐ 15-2017/BCT - Technical Safety Certification Process for Explosion-Proof Generator is amended and supplemented as follows:
a) Amend the phrase "Pre-use Certification" to "Initial Certification Before Use" in Section 4.3 and Section 9.1.
b) Section 5.3 is amended as follows:
"5.3. Abnormal Inspection
Abnormal inspection shall be conducted in the following cases:
- After repair, upgrade, renovation, or change in installation location affecting the technical safety condition of the explosion-proof generator.
- The explosion-proof generator has not operated for 12 months or more.
- Upon request of the competent authority."
c) Add the following content to Step 3 of Section 9.2:

b) Section 5.3 is amended as follows:
"5.3. Abnormal Inspection
Abnormal inspection shall be conducted in the following cases:
- After repair, upgrade, renovation, or change in installation location affecting the technical safety condition of the explosion-proof lighting equipment.
- The explosion-proof lighting equipment has not operated for 12 months or more.
- Upon request of the competent authority."
c) Add the following contents to Step 3 of Section 9.2:

d) Section 9.3 is amended as follows:
"9.3. Abnormal Inspection
- In case of repairs, modifications, or upgrades:

a) Amend the phrase "Pre-use Certification" to "Initial Certification Before Use" in Section 4.3 and Section 9.1.
b) Section 5.3 is amended as follows:
"5.3. Abnormal Inspection
Abnormal inspection shall be conducted in the following cases:
- After repair, upgrade, or renovation affecting the technical safety condition of the electric detonator blasting machine.
- Upon request of the competent authority."
c) Section 9.3 is amended as follows:
"9.3. Abnormal Inspection
In case of repair, renovation, or upgrade:
+ Inspect the design repair, renovation, and upgrade records.
+ Acceptance certificate after repair, renovation, and upgrade of the electric detonator blasting machine.
+ Carry out inspection steps as stipulated in Section 9.1."
In cases where repairs affect the safety structure of explosion-proof equipment, inspection and testing steps must be carried out according to technical requirements of current standards and regulations.
If the contents of the test relate to equipment outside the requirements for equipment specified in Point đ Clause 2 Article 4 Circular No. 09/2017/TT-BCT and the inspection organization does not have testing equipment to perform these contents, the inspection and testing must be carried out at testing organizations designated by the Ministry of Industry and Trade in accordance with the regulations.
d) Amend the phrase "4. General Conclusions and Recommendations" to "IV. GENERAL CONCLUSIONS AND RECOMMENDATIONS" in the Appendix.
Article 3. Implementation Provisions
1. This Circular takes effect from August 2, 2020.
2. During implementation, if any issues arise or difficulties occur, organizations and individuals shall report to the Ministry of Industry and Trade for timely review and resolution./.
