Pursuant to the Environmental Protection Law dated November 17, 2020;

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the proposal of the Director of the Department of Science, Technology and Environment, and the Director of the Livestock Production Department,

The Minister of Agriculture and Rural Development issues this Circular guiding the collection and treatment of livestock waste, agricultural by-products for reuse for other purposes.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Circular guides the collection and treatment of livestock waste, agricultural by-products for reuse for other purposes.

2. This Circular does not apply to the collection and treatment of livestock waste in epidemic areas.

Article 2. Applicability

This Circular applies to organizations and individuals involved in the collection and treatment of livestock waste, agricultural by-products for reuse for other purposes.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Livestock waste for reuse for other purposes includes solid organic waste and livestock wastewater.

2. Treatment of livestock waste refers to the application of appropriate technological solutions and technical measures to treat livestock waste for use as fertilizer, irrigation water for crops, feed for aquatic animals, or for other purposes.

3. Agricultural by-products (crop by-products) are secondary products generated during the process of crop care, harvesting, and initial processing of crop products in the cultivation area.

4. Other purposes refer to using them as raw materials, fuel, or materials for other production activities.

Chapter II

COLLECTION AND TREATMENT OF LIVESTOCK WASTE, AGRICULTURAL BY-PRODUCTS FOR REUSE FOR OTHER PURPOSES

Article 4. Collection of livestock waste

1. Collection of solid organic waste

a) Solid organic waste from household livestock farming must be collected for treatment in accordance with point a, Clause 1, Article 5 of this Circular, ensuring that it does not cause environmental pollution;

b) Solid organic waste from large-scale livestock farms must be collected and transported to centralized locations within the farm premises for treatment in accordance with point b, Clause 1, Article 5 of this Circular, ensuring that it does not cause environmental pollution. The collection of solid organic waste should be carried out daily for animal husbandry facilities and in batches for poultry farms and farms using biological bedding;

c) The centralized location for solid waste within the premises of large-scale livestock farms for treatment must be far from the animal housing areas, water supply points, and storage areas for livestock feed.

2. Livestock wastewater must be collected through a separate system for treatment in accordance with Clause 2, Article 5 of this Circular.

Article 5. Treatment of livestock waste

1. Treatment of solid organic waste

a) Solid organic waste from household livestock farming can be treated using one or a combination of the following methods: composting, biogas technology, biological preparations, biological bedding, or other solutions for use in agriculture;

b) Solid organic waste from large-scale livestock farms, once treated and meeting national technical standards, can be used for crops or as feed for aquatic animals. Until national technical standards are established, the treatment of solid organic waste shall follow the guidance of specialized management agencies;

c) The transportation of untreated solid organic waste out of livestock farms must comply with laws on environmental protection.

2. Treatment of livestock wastewater

a) Livestock wastewater from household livestock farming can be treated using one or a combination of the following methods: biogas technology, bio-ponds, biological preparations, or other methods for use in agriculture, ensuring that odors and putrefaction are minimized and that there is no overflow into the surrounding environment;

b) Livestock wastewater from large-scale livestock farms, once treated and meeting national technical standards for livestock wastewater, can be used for irrigation of crops or other purposes within the farm premises. The use of livestock wastewater must ensure that odors and putrefaction are minimized and that there is no overflow into the surrounding environment.

3. Encouragement is given to the use of biological preparations and the application of advanced technological and technical innovations in the process of treating livestock waste.

Article 6. Collection and Treatment of Agricultural By-products for Reuse for Other Purposes

The collection and treatment of agricultural by-products for reuse for other purposes shall be carried out in accordance with Circular No. 19/2019/TT-BNNPTNT dated November 15, 2019, issued by the Minister of Agriculture and Rural Development, stipulating the collection, treatment, and utilization of crop residues.

Chapter III

IMPLEMENTATION

Article 7. Responsibilities of Units under the Ministry of Agriculture and Rural Development

1. The Department of Science, Technology and Environment shall monitor and compile reports to the Ministry on the implementation of this Circular.

2. The Livestock Production Department, the Crop Production Department

a) Guide and inspect the implementation of this Circular within their respective fields of responsibility; report the results to the Ministry (through the Department of Science, Technology and Environment) for consolidation;

b) Take the lead and coordinate with relevant agencies and units to develop technical guidance materials for the collection and treatment of livestock waste and agricultural by-products for reuse for other purposes in accordance with actual conditions.

Article 8. Responsibilities of Provincial Departments of Agriculture and Rural Development under Central Cities and Provinces

1. Advise the People's Committee of the province or centrally-administered city to organize the implementation of the collection and treatment of livestock waste and agricultural by-products for reuse for other purposes within their jurisdiction.

2. Guide and inspect the implementation of this Circular at the local level and report the results to the Ministry of Agriculture and Rural Development (through the Department of Science, Technology and Environment).

Article 9. Responsibilities of Organizations and Individuals Engaged in the Collection and Treatment of Livestock Waste and Agricultural By-products for Reuse for Other Purposes

1. Comply with the provisions of this Circular and related laws.

2. Provide timely information and feedback to the Provincial Departments of Agriculture and Rural Development under central cities and provinces regarding difficulties and obstacles encountered in the collection and treatment of livestock waste and agricultural by-products for reuse for other purposes.

Article 10. Effective Date

This Circular takes effect from January 1, 2022.

During the implementation of this Circular, if any issues arise, organizations and individuals shall promptly provide feedback to the Ministry of Agriculture and Rural Development (through the Department of Science, Technology and Environment) for study, amendment, and supplementation as necessary./.
