Pursuant to the Urban Planning Law dated June 17, 2009;

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Law on Local Administration Organization dated June 19, 2015;

Pursuant to the Law Amending and Supplementing Several Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

BASED ON THE GOVERNMENT DECREE NO. 52/2022/NĐ-CP OF AUGUST 8, 2022, PROVIDING THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF CONSTRUCTION;

At the proposal of the Director of the Department of Planning and Architecture;

The Minister of Construction issues this Circular stipulating the delegation of authority for the preparation of general urban planning for new cities with a forecasted population equivalent to that of a third-class city or higher.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the delegation of authority for the implementation of responsibilities related to the preparation of general urban planning for new cities with a forecasted population equivalent to that of a third-class city or higher.

Article 2. This Circular applies to units under the Ministry of Construction, provincial People's Committees, and organizations and individuals involved in the preparation of general urban planning for new cities with a forecasted population equivalent to that of a third-class city or higher.

Article 2. Delegating Authority Bodies and Bodies Receiving Delegation

Clause 1. Delegating Authority Body: The Ministry of Construction.

Clause 2. Body Receiving Delegation: Provincial People's Committee.

Article 5. Principles of Delegation

Point 1. Ensuring the effectiveness of the preparation of general urban planning for new cities with a forecasted population equivalent to that of a third-class city or higher according to management and development requirements of each locality.

Point 2. The provincial People's Committee shall undertake all responsibilities of the Ministry of Construction in organizing the preparation of general urban planning for new cities with a forecasted population equivalent to that of a third-class city or higher as prescribed by law.

Article 4. Content of Delegation

Clause 1. Delegation to the provincial People's Committee:

Sub-clause a) Organizing the preparation of tasks and plans for the general urban planning of new cities with a forecasted population equivalent to that of a third-class city or higher; performing the duties and responsibilities of the organization preparing the plan as stipulated in the Urban Planning Law dated June 17, 2009.

Sub-clause b) Organizing the solicitation of opinions from ministries; central and local agencies and organizations; individuals and communities related to the preparation of tasks and plans for the general urban planning of new cities with a forecasted population equivalent to that of a third-class city or higher.

Sub-clause c) Preparing and balancing annual budgets for the preparation, review, and approval of tasks and plans for the general urban planning of new cities with a forecasted population equivalent to that of a third-class city or higher.

Sub-clause d) Submitting to the Ministry of Construction for review and submitting

Clause 2. The provincial People's Committee shall direct the organization of the preparation of tasks and plans for the general urban planning of new cities with a forecasted population equivalent to that of a third-class city or higher to ensure compliance with legal procedures, contents, and quality of documents before submitting to the competent authority for review and approval.

Article 5. Responsibilities of the provincial People's Committee

Clause 1. Organizing and implementing the delegated content regarding the preparation of tasks and plans for the general urban planning of new cities with a forecasted population equivalent to that of a third-class city or higher as stipulated in this Circular.

Clause 2. Annually compiling and reporting the results of the implementation of delegated tasks according to regulations on statistical reporting systems of the Construction sector.

Clause 3. Being responsible to the Ministry of Construction and the law for the work of organizing the preparation of tasks and plans for the general urban planning of new cities with a forecasted population equivalent to that of a third-class city or higher.

Article 6. Responsibilities of the Ministry of Construction

1. Guide and inspect provincial people's committees in organizing the establishment of tasks and general urban planning schemes for new cities with forecasted populations equivalent to or larger than those of third-tier cities.

2. Compile the tasks and general urban planning schemes for new cities established by provincial people's committees according to the classification specified in this Circular; report within the annual work summary of the Construction sector.

Article 7. Implementation Provisions

This Circular takes effect from January 10, 2024./.
