Amending and supplementing certain Articles of Circular No. 32/2021/TT-BTTTT

dated December 31, 2021 issued by the Minister of Information and Communications

guiding the implementation of publications using state budget funds

Pursuant to the Law on Publishing No.19/2012/QH13 and Law No. 35/2018/QH14 amending and supplementing certain Articles of 37 laws related to planning;

Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering or tendering for the provision of products and services using state budget funds from regular expenditure;

Pursuant to Decree No.Decree No. 85/2024/NĐ-CP dated July 10, 2024 of the Government detailing certain provisions of the Law on Prices;

Pursuant to Decree No.43/2025/NĐ-CP dated February 28, 2025 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Upon the proposal of the Director of the Publishing, Printing, and Distribution Department;

The Minister of Culture, Sports and Tourism issues this Circular amending and supplementing certain Articles of Circular No.32/2021/TT-BTTTT dated December 31, 2021 issued by the Minister of Information and Communications guiding the implementation of publications using state budget funds.

Article 1. Amending and supplementing Article 5

"1. The method of implementing publications using state budget funds shall be carried out in accordance with the provisions of Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering or tendering for the provision of products and services using state budget funds from regular expenditure (Decree No. 32/2019/NĐ-CP).

2. In cases where publications are implemented under Programs or Projects approved by competent authorities and have specific implementation methods prescribed, they shall be carried out according to the approved Programs or Projects."

Article 2. Amending and supplementing Article 7

"Article 7. Responsibilities of the Ministry of Culture, Sports and Tourism

1. Managing research topics for publications, proposing annual budgets for ordering publications:

a) Before February 15 of the year preceding the plan year, the Ministry of Culture, Sports and Tourism (Publishing, Printing, and Distribution Department) shall issue a document to the managing agencies and publishers regarding the orientation of publication topics that align with political requirements for each year and phase.

b) Before June 30 of the year preceding the plan year, the Ministry of Culture, Sports and Tourism (Publishing, Printing, and Distribution Department) shall compile plans and propose budgets for implementing publications to the Ministry of Finance, while also sending them to the managing agencies and publishers to develop their implementation plans for the plan year.

c) The Ministry of Culture, Sports and Tourism (Publishing, Printing, and Distribution Department) shall approve the list of research topics and the number of publications within seven working days from the date of receipt of the publisher's request document (the request document must include the opinion of the managing agency of the publisher).

d) The Ministry of Culture, Sports and Tourism (Publishing, Printing, and Distribution Department) shall inspect the implementation of the publication lists by publishers.

2. The Ministry of Culture, Sports and Tourism shall provide specialized opinions on the content of price determination schemes of the managing agencies of publishers in accordance with Clause 3, Article 10 of Decree No. 85/2024/NĐ-CP dated July 10, 2024 of the Government detailing certain provisions of the Law on Prices (Decree No. 85/2024/NĐ-CP)."

Article 3. Amend and supplement Clause 3 of Article 8

"3. Implement the review of the pricing plan for ordering publishing products and submit the review file of the pricing plan to the Ministry of Culture, Sports and Tourism (Publishing, Printing and Distribution Department) for specialized opinions in accordance with Clause 3 of Article 10 of Decree numberDecree No. 85/2024/NĐ-CP.".

Article 4. Amending and supplementing some Points and Clauses of Article 9

2. Amending and supplementing Clause 5 as follows:

"1. Before May 30 of the year preceding the planning year, the publisher sends the plan and budget estimate for implementing publishing products, which have been approved by the managing authority, to the Ministry of Culture, Sports and Tourism (Publishing, Printing and Distribution Department) for consolidation."

"Before June 30 of the planning year, the publisher sends the list of publishing products to the Ministry of Culture, Sports and Tourism (Publishing, Printing and Distribution Department) for examination and approval of the list of publishing products."

2. Amend and supplement Clause 2 as follows:

"2. Based on the approved research topics; the allocated budget estimate by the competent authority; economic-technical norms, cost standards (if any), and current state budget management regulations to develop the pricing plan for implementing publishing products. The pricing plan developed by the publisher must be reviewed and examined by the managing authority in accordance with Clause 3 of Article 10 of Decree No. 85/2024/ND-CP."

Article 5. Amend and supplement Clause 3 of Article 13

"3. For public libraries in provinces and cities, implement the circulation of information resources in the form of publishing products among libraries within their jurisdiction as prescribed."

Article 6. Replace the phrase "Ministry of Information and Communications" and abolish some forms attached to the Circular

1. Replace the phrase "Ministry of Information and Communications" with the phrase "Ministry of Culture, Sports and Tourism" in Chapter III; Point c Clause 1 Article 4; Clause 2 Article 12; Clause 3 Article 15.

2. Abolish Form No. 05, Form No. 06, Form No. 07, and Form No. 08 in the Appendix accompanying Circular No. 32/2021/TT-BTTTT dated December 31, 2021 issued by the Minister of Information and Communications guiding the implementation of publishing products using state budget funds.

Article 7. Implementation Provisions

1. This Circular takes effect from August 29, 2025.

2. In cases where the legal normative documents cited in this Circular are amended, supplemented, or replaced by new documents, they shall be applied according to the amended, supplemented, or replacing documents.

3. During the implementation process, if there are any difficulties, please promptly reflect them to the Ministry of Culture, Sports and Tourism for consideration and resolution./.
