DECREE

OF THE CHAIRMAN OF THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM

NUMBER 12 DATE 3 FEBRUARY 1947

CHAIRMAN OF THE COUNCIL OF MINISTERS

PURSUANT TO DECREE NO. 1 DATED DECEMBER 20, 1946 ESTABLISHING THE COMMITTEES FOR PROTECTION,

PURSUANT TO DECREE NO. 41 DATED MARCH 29, 1946 REGULATING THE PRESS SYSTEM,

PURSUANT TO DECREE NO. 159 DATED AUGUST 20, 1946 REGULATING PRINTED MATERIALS,

AFTER THE COUNCIL OF MINISTERS HAS REACHED A CONSENSUS,

ISSUES THE DECREE:

Article 1

PERIODICALS AND BOOKS MAY ONLY BE PRINTED AND DISTRIBUTED WITH THE APPROVAL OF THE PROVINCIAL CENSORSHIP OFFICE.

HOWEVER, FOR PERIODICALS, THE PROVINCIAL CENSORSHIP OFFICE WILL ASSIGN STAFF TO OVERSEE CENSORSHIP IN THE PROVINCES WHERE THEY ARE DISTRIBUTED.

Article 2

OTHER PRINTED MATERIALS AS DEFINED IN DECREE NO. 159 DATED AUGUST 20, 1946, SHALL BE CENSORED BY THE RESISTANCE ZONE COMMITTEE.

THE RESISTANCE ZONE COMMITTEE WILL ASSIGN STAFF TO OVERSEE CENSORSHIP IN THE PROVINCES WHERE SUCH MATERIALS ARE DISTRIBUTED.

Article 3

PRINTED MATERIALS APPROVED FOR PRINTING BY THE RESISTANCE ZONE COMMITTEE MAY CIRCULATE IN OTHER ZONES.

Article 4

IF THE RESISTANCE ZONE COMMITTEE DOES NOT APPROVE PRINTING, THE AUTHOR OR PUBLISHER MAY APPEAL TO THE PROVINCIAL CENSORSHIP OFFICE. THE PROVINCIAL CENSORSHIP OFFICE WILL MAKE THE FINAL DECISION.

Article 5

THE RESISTANCE ZONE COMMITTEE HAS THE AUTHORITY TO ORDER THE SEIZURE OF PRINTED MATERIALS DISTRIBUTED WITHOUT PERMISSION.

Article 6

PROVISIONS CONTRARY TO THIS DECREE ARE SUSPENDED FROM ENFORCEMENT.

ARTICLE 7

THE MINISTER OF INTERIOR SHALL ENFORCE THIS DECREE.
