Decision No. 120/2002/QĐ-BNN on Issuing the Forest Ranger Certificate

DECISION
REGARDING THE ISSUE OF "FOREST INSPECTOR CERTIFICATE"

 MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree 73/CP dated November 1, 1995 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree 39/CP dated May 18, 1994 of the Government on the system of organization and tasks, powers of Forest Rangers;

At the proposal of the Director of the Forest Protection Department,

DECISION:

Article 1. Now we issue the "Forest Inspector Certificate" according to the model prescribed in Article 2 of this Decision. The Forest Inspector Certificate is a special document for the Forest Ranger force, certifying that the person holding the certificate is a Forest Ranger officer working within the Forest Ranger force, used for managing officers and staff and utilized when performing official duties in the field of forest management, protection, and enforcement of laws related to forests.

Article 2. The "Forest Inspector Certificate" is rectangular, with dimensions 10 cm in length and 6.5 cm in width.

Front side: In the center is the embossed Forest Ranger emblem, surrounded by fan-shaped floral patterns in yellow, with a diameter of 2.3 cm. On the left from top to bottom is the raised Forest Ranger emblem with a diameter of 1.4 cm, below which is affixed a color photograph of the holder, under the photo is noted the period of validity. On the right from top to bottom are the following lines of text:SOCIALIST REPUBLIC OF VIETNAMIndependence - Freedom - Happiness. Certificate Forest InspectorBelow the Forest Inspector Certificate are recorded the Certificate number; Full name; Year of birth; Position; Workplace of the holder; Date ... month ... year ... signed by the Director of the Forest Protection Department, the Deputy Director of the Provincial Forest Protection Department issuing the certificate and stamped.

Back side: Background color dark green, in the center is the National Emblem in relief with a diameter of 2.5 cm. Above the National Emblem is the line of text: SOCIALIST REPUBLIC OF VIETNAM, below the National Emblem is the line of text: FOREST INSPECTOR CERTIFICATE. In the lower left corner there are two red diagonal lines crossing at the corner. (Attached is a sample).

Article 3. The Forest Inspector Certificate has a validity period of three years and is reissued upon expiration. The model of the Forest Inspector Certificate is issued by the Forest Protection Department.

The Director of the Forest Protection Department issues and manages the use of the Forest Inspector Certificate for Forest Ranger officers and staff under the Department and the National Parks directly under the Ministry of Agriculture and Rural Development.

The Deputy Directors of the Provincial Forest Protection Departments issue and manage the use of the Forest Inspector Certificate for Forest Ranger officers and staff in their units; simultaneously sending lists of Forest Ranger officers and staff who have been issued certificates to the Forest Protection Department for monitoring, management, and inspection.

Article 4. In cases where Forest Ranger officers and staff perform urgent tasks while wearing civilian clothes instead of Forest Ranger uniforms, they may use the "Forest Inspector Certificate" to present themselves as Forest Ranger officers. State agencies, political organizations, political-social organizations, social organizations, occupational social organizations, economic organizations, people's armed forces units, and all citizens have the responsibility to create conditions for these Forest Ranger officers and staff to carry out their tasks in accordance with the law.

Article 5. Forest Ranger officers and staff may use their own "Forest Inspector Certificate" as proof of being Forest Ranger officers and staff; presenting it when requested by authorized authorities for inspection.

Forest Ranger officers and staff who misuse the "Forest Inspector Certificate", alter, lend, lose, or retain the certificate when no longer entitled to use it, or allow others to use the "Forest Inspector Certificate" will be subject to disciplinary action or criminal prosecution depending on the severity of the violation.

Article 6. Forest Ranger officers and staff specified in Article 1 of this Decision, when changing units, retiring, transferring to other sectors, or being disciplined and no longer part of the Forest Ranger force, must return the Forest Inspector Certificate to the issuing authority before proceeding with transfer procedures, discharge, or retirement.

, Clause 1, Clause 2 Article 7a of this Regulation.. Strictly prohibited is the forgery of "Forest Inspector Certificates" and the use of forged certificates to impersonate Forest Ranger officers and staff for illegal activities or personal gain. Those who forge "Forest Inspector Certificates" and use them to impersonate Forest Ranger officers and staff for illegal activities will be subject to administrative penalties or criminal prosecution depending on the severity of the violation.

All agencies, organizations, and citizens have the responsibility and right to report violations in the use of "Forest Inspector Certificates" as stipulated in this Decision to the Forest Protection Department and competent state agencies.

Article 8. This Decision takes effect fifteen days after its date of issuance.

The Director of the Forest Protection Department guides the issuance of Forest Inspector Certificates and the inspection of the use of Forest Inspector Certificates.

Article 9. The Head of the Ministry's Office, the Director of the Forest Protection Department, Heads of relevant Departments and Bureaus, Deputy Directors of Provincial Forest Protection Departments, and Directors of National Parks directly under the Ministry of Agriculture and Rural Development are responsible for implementing this Decision.
