Amending and supplementing certain Articles of Decree No. 133/2008/NĐ-CPdated December 31, 2008

detailing and guiding the implementation ofcertain provisions of the Technology Transfer Law

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Technology Transfer Law 2006;

Pursuant to Resolution No. 35/NQ-CP dated March 18, 2013 of the Government on urgent issues in the field of environmental protection;

At the proposal of the Minister of Science and Technology,

At the proposal of Issuing this Decree amending and supplementing certain Articles of Decree No. 133/2008/NĐ-CP dated December 31, 2008 detailing and guiding the implementation of certain provisions of the Technology Transfer Law.

Article 1. Amending and supplementing certain Articles of Decree No. 133/2008/NĐ-CP dated December 31, 2008 of the Government

Amending and supplementing Clause 1 of Article 5 with the following content:

- Issuing along with this Decree the List of Technologies Encouraged for Transfer, the List of Technologies Restricted from Transfer, and the List of Technologies Prohibited from Transfer to replace the List of Technologies Encouraged for Transfer (Annex I), the List of Technologies Restricted from Transfer (Annex II), and the List of Technologies Prohibited from Transfer (Annex III) of Decree No. 133/2008/NĐ-CP dated December 31, 2008 of the Government detailing and guiding the implementation of certain provisions of the Technology Transfer Law.

- The import, transfer, and use of technologies listed in the List of Technologies Prohibited from Transfer for the purpose of scientific research and special technological development shall be governed by

Article 2. Effective Date

This Decree shall take effect from February 1, 2015. Clause 1 of Article 5 and the three Lists of Technologies mentioned in Annexes I, II, and III of Decree No. 133/2008/NĐ-CP dated December 31, 2008 shall be abolished from the date this Decree takes effect.

Article 3. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees, municipal People's Committees directly under the Central Government, relevant organizations, and individuals are responsible for implementing this Decree./.
