Approving the Charter of the Vietnam Association of Mineralogy and Petrography
THE MINISTER OF THE MINISTRY OF HOME AFFAIRS
Pursuant to Decree No. 102/SL-L004 dated May 20, 1957 issued by the President of the Democratic Republic of Vietnam on the Law regulating the right to establish associations;
Pursuant to Decree No. 88/2003/NĐ-CP dated July 30, 2003 of the Government stipulating the organization, operation, and management of associations;
Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Considering the proposal of the Chairman of the Vietnam Association of Mineralogy and Petrography and the Director of the Department of Non-Governmental Organizations,
DECISION:
Article 1. Approves the Charter of the Vietnam Association of Mineralogy and Petrography which was adopted at the First National Congress of the Association on May 28, 2005.
Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 3. The Chairman of the Vietnam Association of Mineralogy and Petrography and the Director of the Department of Non-Governmental Organizations shall be responsible for implementing this Decision.

PART I
NAME, AIMS AND SCOPE OF ACTIVITY
Article 1. Name of the Association
The Association has the name: Vietnam Association of Mineralogy and Petrography
English trading name: Vietnam Association of Mineralogy and Petrography (VAMP).
Article 2. Aims and Objectives
The Vietnam Association of Mineralogy and Petrography (hereinafter referred to as the Association) is a voluntary social-professional organization of individuals engaged in the field of mineralogy and petrography. The Association is a member of the Vietnam Geological Society. The Association operates within the framework of the laws of the Socialist Republic of Vietnam and according to its Charter.
The purpose of the Association is to unite and promote cooperation among individuals engaged in the field of mineralogy and petrography to help each other enhance their talents and intellect, improve professional skills and ethics, and contribute to the industrialization and modernization of the country, thereby contributing to building a prosperous, equitable, democratic, and civilized Vietnam.
Article 3. Scope of Activities
1. The Vietnam Association of Mineralogy and Petrography operates nationwide with headquarters in Hanoi. The Association has legal personality, a seal, separate assets and finances, and a bank account.
2. The Vietnam Association of Mineralogy and Petrography may join organizations and associations in the same field within the region and internationally as provided by law.
Chapter II
TASKS, RIGHTS, LIMITATIONS, AND METHODS OF ACTIVITY
Article 4. Tasks and Powers
1. Conduct scientific research, apply new theories, scientific and technological advancements, and advanced experiences both domestically and internationally to basic geological surveys and rational use of mineral resources, while protecting the environment and promoting sustainable development.
2. Coordinate and harmonize activities of branch associations and affiliated organizations under the Association to enhance creativity, improve professional skills and ethics, increase work productivity, and improve business efficiency in activities related to mineralogy and petrography, including basic research, geological surveys, mining, processing and manufacturing of industrial minerals, quality control of mineral products, and mineral trade.
3. Provide advisory opinions, critical reviews, and scientific evaluations to the State, Ministries, sectors, and localities regarding strategies for geological development and mineral resource utilization; policies, systems, and measures related to mineralogy and petrography activities; investment projects related to foundation structures, construction materials, industrial minerals; scientific research topics, reports on geological resource investigation results and usage when requested.
4. Encourage and mobilize members' enthusiasm and creativity in participating in basic geological surveys and mineral investigations to meet the needs of economic and social development of the country.
5. Encourage and assist members in enhancing scientific and technical knowledge to contribute to training talent in the field of geology in Vietnam.
6. Disseminate geological and mineral resource scientific and technical knowledge to the public; promote and encourage innovation among cadres and workers in the geological and mineral industries.
7. Engage in economic activities as prescribed by law through the application of scientific and technological advancements to generate income for the Association's fund and create employment opportunities, improving the material and spiritual lives of members.
Article 5. Methods of Operation
1. Organize conferences, seminars, and information exchanges on mineralogy and petrography within the national, regional, and international scope as prescribed by law.
2. Conduct training courses and professional skill enhancement classes for members and the general public.
3. Organize and participate in writing and publishing geological research works, mineralogy, and petrography studies.
4. Enter into scientific and technological contracts and economic contracts to implement tasks set forth in Article 4.
5. Support research and survey activities in geology and minerals, commend and encourage creative activities, outstanding research works, and academic achievements of students, trainees, and researchers in the field.
6. Expand cooperative relations with domestic and foreign associations as prescribed by law to learn from experience and seek assistance and support for the development of the Association.
Chapter III
MEMBERS
Article 6. Members and Membership Standards
1. Vietnamese citizens engaged in geological work or related professions who have the conditions to regularly participate in the Association's activities and voluntarily submit membership applications can be considered for admission as members of the Vietnam Association of Mineralogy and Petrography.
2. Vietnamese citizens both inside and outside the country with knowledge of mineralogy and petrography, enthusiastic about contributing to the Association, and agreeing with the Association's Charter but not meeting the conditions to become regular members, may be recognized by the Association as associate members. Associate members enjoy rights and obligations similar to those of other members of the Association but do not have the right to nominate or vote for the Executive Board and leadership positions of the Association, nor do they participate in voting on Association matters.
3. The procedures for admitting and expelling members are stipulated by the Central Executive Committee.
4. Members of the Vietnam Association of Mineralogy and Petrography may join other associations.
Article 7. Duties and benefits of members
1. Members have the duty to promote and participate in all Association activities, implement the Association's Charter, and pay membership fees.
2. Members have the right:
a) Participate in Association activities, receive assistance from the Association to engage in scientific and technical activities and training both domestically and internationally, and enjoy other benefits as prescribed by the Central Executive Committee;

Chapter IV
Article 8. Principles of Organization
Article 8. Organizational Principles
The Association is organized and operates on the principles of voluntariness, self-management, financial autonomy, and legal responsibility. Leadership bodies at all levels of the Association are established through elections and operate based on the principle of collective leadership with individual accountability. Each level of the Association's organization has the right to decide issues within its scope of authority, but must not contravene the Charter of the Association, resolutions of the Central Committee of the Association, and state laws.
Article 9. Organization of the Association
1. The National Congress of Delegates;
2. The Central Executive Board of the Association;
3. The Inspection Board of the Association;
4. The Office of the Association;
5. Basic Branches;
6. Research and Development Centers;
7. Experimental Production Workshops.
Article 10. National Congress of Delegates
1. The highest leading body of the Association is the National Congress of Delegates, which convenes every five years. The Central Executive Board of the Association may decide to convene the Congress earlier if more than two-thirds of the Central Committee members or over fifty percent of the formal members request it.
The composition and number of delegates (if it is a Congress of Delegates) are determined by the Central Executive Board of the Association and elected by the organizational levels. The number of invited delegates shall not exceed ten percent of the convened delegates.
2. The congress has the following tasks:
a) Discussing and approving the term report of work of the Central Executive Board; deciding the goals, directions, and tasks of the Association for the next five years;
b) Discussing and approving resolutions to amend the Charter of the Association (if necessary);
c) Electing the Central Executive Board and the Inspection Board of the Association.
Article 11. The Central Executive Board of the Association
1. The Central Executive Board of the Association is the leading body of the Association between two Congresses. The Central Executive Board meets once a year.
2. The Central Executive Board of the Association has the following responsibilities:
a) Organizing the implementation of the Resolutions of the Congress;
b) Leading the work of the Association during the period between two Congresses;
c) Electing the Standing Board consisting of the Chairman, Vice Chairmen, Secretary General, and Standing Members;
d) When necessary, it has the right to elect additional members of the Central Executive Board, but the number shall not exceed one-third of the members elected by the Congress.
The election procedures for leadership positions of the Association are stipulated by the Central Executive Board of the Association.
Article 12. The Standing Board
The Standing Board is the permanent body of the Central Executive Board of the Association, responsible for implementing the Resolutions of the Congress and the Central Executive Board of the Association; the Standing Board convenes three times a year. In case of necessity and upon the proposal of the Chairman, the Standing Board may convene extraordinary meetings.
The Standing Board has the following responsibilities:
1. Representing the Central Executive Board of the Association to direct and manage the activities of the Association according to the Resolutions of the Congress, the Resolutions of the Central Executive Board of the Association, and must report on the situation of activities between two meetings of the Central Executive Board;
2. Deciding the establishment, appointment, dismissal, commendation, and disciplinary actions of staff in specialized departments and subordinate organizations of the Association in accordance with the law; deciding the admission of new members according to the regulations of the Charter of the Association and in compliance with the law.
3. Depending on the requirements of work, the Standing Board may establish various departments and organizations to assist and define their responsibilities and authorities.
Article 13. The Inspection Board
1. The Inspection Board of the Association has the responsibility to inspect the implementation of the Charter of the Association; the implementation of the Resolutions of the Congress.
2. Handling complaints and petitions related to members and organizational units of the Association in accordance with the law. The Central Inspection Board of the Association has the right to require members and organizational units under the Association to report on matters related to the inspection content approved by the Central Standing Board of the Association.
3. The term of the Inspection Board (five years) follows the term of the Congress. The Inspection Board consists of: the Head, Deputy Head, and Members.
Article 14. Chairman of the Association
The Chairman of the Association is elected by the Central Executive Committee; the Chairman may be re-elected but not for more than two consecutive terms;
The Chairman has the following responsibilities:
1. To be the legal representative of the Association;
2. To preside over meetings of the Central Executive Committee, the Standing Committee, and the annual meetings of the Association;
3. To manage the activities and decide on matters of the Association in accordance with the resolutions of the congress, the Central Executive Committee, and the Standing Committee of the Association;
4. To represent the Association in internal and external relations;
5. To be accountable to the Central Executive Committee, the Standing Committee, and members of the Association for its activities;
6. To be the first account holder of the Association;
7. To convene and chair the next term's Central Executive Committee meeting until a new Chairman is elected.
Article 15. Vice Chairmen
1. The Vice Chairmen are elected by the Central Executive Committee of the Association, including one permanent Vice Chairman. The Vice Chairmen are assigned by the Chairman to lead certain aspects of the Association’s work within their scope of assignment and according to the operational regulations of the Central Executive Committee of the Association;
2. When the President of the Association is absent, the permanent Vice President performs the duties of the President.
Article 16. Secretary General
The Secretary General is elected by the Central Executive Board of the Association, with the following responsibilities:
1. The Secretary General permanently handles the Association's affairs as assigned by the Chairman and assists the Chairman in implementing the daily operations of the Central Association Office; directly directs the Office and other specialized agencies of the Association (if any);
2. Perform the function of internal and external communication for the Association.
3. Organize secretarial work and compile documents for congresses, Executive Board meetings, Executive Board meetings, and annual meetings of the Association.
4. The Secretary General is the second account holder of the Association, responsible for managing the Association's assets as assigned by the President.
5. The Secretary General has an office and some staff proposed by the Secretary General, reviewed and decided by the President of the Association.
6. The Secretary General may concurrently hold the position of Director of the Association Office.
Chapter V
FINANCE AND ASSETS OF THE ASSOCIATION
Article 17. Sources of Income of the Association
1. Membership fees paid by members;
2. Donations and sponsorships from organizations and individuals both domestically and internationally;
3. Revenue from scientific and technological activities and other lawful activities consistent with legal provisions.
Article 18. Financial and Asset Management
1. The Association has independent finances and assets; management and utilization are conducted in accordance with the regulations of the Central Standing Committee of the Association and state regulations.
2. When the Association is dissolved, its assets and finances must be inventoried and disposed of in accordance with the law.
Chapter VI
REWARDS AND DISCIPLINE
Article 19. Awards
Cadres, members, and organizations of the Association that achieve outstanding results will be commended by the Association and recommended for commendation by the Vietnam Geological Association, the State, and various levels of government;
Forms of commendation are prescribed by the Central Standing Committee of the Association.
Article 20. Discipline
1. If cadres, members, and organizations of the Association violate the Charter, they shall be subject to disciplinary action. Forms of discipline are prescribed by the Central Standing Committee of the Association.
2. In cases where national laws are violated, administrative penalties or criminal responsibility shall be pursued according to the provisions of the law.
Chapter VII
IMPLEMENTING PROVISIONS
Article 21. Effectiveness of the Charter
1. This Charter consists of 7 Chapters and 21 Articles, which were adopted at the First National Congress of the Vietnam Mineralogy-Petrology Association on May 28, 2005.
Only the National Congress of the Vietnam Mineralogy-Petrology Association has the authority to amend this Charter;
2. This Charter shall take effect upon approval by the Minister of Home Affairs./.
