CIRCULAR
REGULATIONS ON THE REPORTING SYSTEM OF THE MILITARY CIVIL ENFORCEMENT DEPARTMENT
Pursuant to the Civil Enforcement Act No. 26/2008/QH12 dated November 14, 2008, amended and supplemented by some articles pursuant to Law No. 64/2014/QH13 dated November 25, 2014;
Pursuant to Decree No. 62/2015/NĐ-CP dated July 18, 2015 of the Government detailing and guiding the implementation of certain articles of the Civil Enforcement Law;
Pursuant to Decree No. 35/2013/NĐ-CP dated April 22, 2013, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;
Considering the proposal of the Director of the Civil Enforcement Department under the Ministry of National Defense;
The Minister of National Defense issues this Circular to regulate the reporting system of the Military Civil Enforcement Department.
Article 1. Scope of Regulation and Applicability
Article 1. This Circular stipulates principles, responsibilities; types, procedures, deadlines for reporting; forms, contents, timeframes for implementing the reporting system of the Military Civil Enforcement Department (hereinafter referred to as the reporting system).
Article 2. This Circular applies to the Civil Enforcement Department under the Ministry of National Defense, the Civil Enforcement Office under the General Staff, military regions, and the Navy Command (collectively referred to as the Civil Enforcement Office at the military region level); relevant agencies, units, and individuals involved in civil enforcement activities within the military.
Article 2. Principles and Responsibilities for Implementing the Reporting System
Clause 1. Ensuring timeliness, completeness, accuracy, and compliance with laws on civil enforcement and this Circular.
2. Responsibilities
Point a) The Civil Enforcement Department under the Ministry of National Defense is responsible for implementing and guiding, directing, inspecting, auditing, and urging the Civil Enforcement Offices at the military region level to strictly implement the reporting system as prescribed in this Circular.
Point b) The Civil Enforcement Offices at the military region level are responsible for implementing and guiding, directing, inspecting, and urging subordinate officers and staff to strictly implement the reporting system as prescribed in this Circular.
Article 3. Types, Procedures, and Deadlines for Reporting
a) Periodic reports include: Monthly, quarterly, semi-annual, 10-month, and annual;
Point a) Regular reports;
b) Ad hoc reports, thematic reports;
c) Statistics on civil enforcement.
2. Reporting procedures
Point a) The Civil Enforcement Office at the military region level shall report to the Commander of the military region and equivalent positions, and the Civil Enforcement Department under the Ministry of National Defense.
Point b) The Civil Enforcement Department under the Ministry of National Defense shall report to the Ministry of National Defense.
Point c) The Civil Enforcement Office at the military region level and the Civil Enforcement Department under the Ministry of National Defense shall report to competent authorities as prescribed by law.
3. Time limit for reporting
Point a) Regular Reports:
Annual Report: From October 1 of the previous year to September 30 of the following year.
Monthly Report: From the first day to the last day of each month, implemented 12 times a year;
Quarterly Report: From the first day of the quarter to the last day of the third month of the quarter, implemented 4 times a year;
Six-month Report: From the first day of the reporting year to the last day of the sixth month of the reporting year;
Nine-month Report: From the first day of the reporting year to the last day of the ninth month of the reporting year;
Twelve-month Report: From the first day of the reporting year to the last day of the twelfth month of the reporting year.
Point b) Ad hoc reports and thematic reports: Implemented according to the requirements of the Civil Enforcement Office at the military region level, the Civil Enforcement Department under the Ministry of National Defense, or the requirements of the Military Court, the Military Procuracy, and competent authorities as prescribed by law.
Point c) Statistics on civil enforcement: Implemented according to the laws on civil enforcement statistics.
Article 4. Reporting Forms
Shall be prepared in writing, formatted on A4 paper size in accordance with the Ministry of National Defense's regulations on the format and technical presentation of administrative documents of agencies and units in the military and related laws.
Article 5. Contents and Timeframes for Reporting
Clause 1. Regular Reports
Point a) Content: Reporting on the implementation of state management functions and specialized management of civil enforcement in the military; performing tasks assigned by the Ministry of National Defense or as required by competent authorities.
b) Time:
Date of preparation of the report: The day following the end of the month, quarter, six months, nine months, or annual period.
Date of submission of the report: The date stamped on the postal service, military mail, faxed report, or the date received if submitted directly.
Deadline for submission of the report: The Civil Enforcement Office at the military region level shall submit to the Commander of the military region and equivalent positions, and the Civil Enforcement Department under the Ministry of National Defense before the fourth day of the next reporting period. The Civil Enforcement Department shall submit to the Ministry of National Defense and competent authorities before the seventh day of the next reporting period. In case the reporting date coincides with a public holiday, it must be reported on the first working day immediately following the holiday.
Clause 2. Ad hoc reports and thematic reports;
Point a) Content: Reporting on state management and specialized management of civil enforcement in the military, as required by tasks or by competent authorities.
Point b) Timeframe: Implemented according to the timeframe specified by the competent authority requiring the report.
Clause 3. Statistics on civil enforcement: Content and timeframe for reporting as prescribed by laws on statistics and civil enforcement statistics and regulations of the Ministry of Justice.
Article 6. Effectiveness and Responsibility for Implementation
Clause 1. This Circular takes effect from December 21, 2015, and replaces Decision No. 86/2006/QĐ-BQP dated May 18, 2006, of the Minister of National Defense on the reporting system for civil enforcement work in the military.
Clause 2. The Director of the Civil Enforcement Department under the Ministry of National Defense; the Head of the Civil Enforcement Office at the military region level, and commanders of relevant agencies, units, and individuals are responsible for implementing this Circular./.
