DECREE

Amending and supplementing certain Articles of Decree No. 139/2018/NĐ-CP dated October 8, 2018 of the Government on business operations of motor vehicle inspection services, which has been amended and supplemented by certain Articles of Decree No. 30/2023/NĐ-CP dated June 8, 2023 of the Government

On the basis of Law on Government Organization dated June 19, 2015; Law Amending and Supplementing Certain Provisions of the Law on Government Organization and the Law on Local Administration dated November 22, 2019;

On the basis of Law on Road Traffic dated November 13, 2008;

On the basis of The Government promulgates this Decree amending and supplementing certain articles and appendices of Decree No. 58/2021/NĐ-CP dated June 10, 2021 of the Government on the operation of credit information service provision (hereinafter referred to as Decree No. 58/2021/NĐ-CP).

On the basis of Investment Law dated June 17, 2020;

At the proposal of the Minister of Transport;

THE GOVERNMENT ISSUES THE DECREE AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF DECREE NO. Decree No. 139/2018/NĐ-CP dated October 8, 2018 of the Government on business operations of motor vehicle inspection services, which has been amended and supplemented by certain Articles of Decree No. 30/2023/NĐ-CP dated June 8, 2023 of the Government.

Article 1. Amending and supplementing certain Articles of Decree No. 139/2018/NĐ-CP dated October 8, 2018 of the Government on business operations of motor vehicle inspection services, which has been amended and supplemented by certain Articles of Decree No. 30/2023/NĐ-CP dated June 8, 2023 of the Government

1. Amending and supplementing Clause 4, Article 4 of Decree No. 139/2018/NĐ-CP (amended and supplemented by Clause 3, Article 1 of Decree No. 30/2023/NĐ-CP) as follows:

“4. The establishment of inspection units must be in accordance with relevant planning, including consideration of special factors of remote areas, mountainous regions, islands; encouraging the application of modern inspection technology and equipment.”

2. Supplementing Clause 7 and Clause 8 of Article 11 of Decree No. 139/2018/NĐ-CP as follows:

“7. Using tools and software to modify vehicle data and inspection data to legitimize vehicle information and inspection results.

8. Not maintaining a department to handle matters related to inspection records during periods when the unit is not operating motor vehicle inspections, except in cases of force majeure or objective obstacles as provided for by law.”

3. Amending and supplementing Clause 3 of Article 12 of Decree No. 139/2018/NĐ-CP as follows:

“3. An inspection unit whose certificate of eligibility for motor vehicle inspection activities has been revoked may only be considered for reissuance of such certificate after 12 months from the date of revocation, except in cases stipulated in Clause 3 of Article 11 of this Decree.”

4. Supplementing Clause 9 of Article 18 of Decree No. 139/2018/NĐ-CP as follows:

“9. Using tools and software to modify vehicle data and inspection data to legitimize vehicle information and inspection results.”

Article 2. Suspension of effect and abolition of certain Points, Clauses, and Articles of Decree No. 139/2018/NĐ-CP and Decree No. 30/2023/NĐ-CP

1. Abolishing Point b, Clause 1, and Point b, Clause 2 of Article 10 of Decree No. 139/2018/NĐ-CP (amended and supplemented by Clause 10, Article 1 of Decree No. 30/2023/NĐ-CP).

2. Suspending the effect of Clause 4 of Article 18 of Decree No. 139/2018/NĐ-CP (amended and supplemented by Point c, Clause 16, Article 1 of Decree No. 30/2023/NĐ-CP) until January 1, 2025.

Article 3. Implementation Provisions

1. This Decree shall take effect from October 5, 2024.

2. Transitional Provisions

Inspection units that have had their certificates of eligibility for motor vehicle inspection activities revoked before the effective date of this Decree shall be governed by the provisions of Clause 3, Article 1 of this Decree.

3. Replacing the phrase "Certificate of Eligibility for Business Operations of Motor Vehicle Inspection Services" with the phrase "Certificate of Eligibility for Motor Vehicle Inspection Activities" at Point b, Clause 4, Article 38, and Point h, Clause 1, Article 81 of Decree No. 100/2019/NĐ-CP dated December 30, 2019 of the Government on administrative penalties for violations in the field of road traffic and railway transport.

4. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees, and directly affiliated city People's Committees, and relevant organizations and individuals are responsible for implementing this Decree./.
