On the basis of the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on the Organization of the People's Courts No. 62/2014/QH13;

Considering the proposal of the President of the Supreme People's Court at the Report No. 05/TTr-TANDTC dated May 19, 2016,

RESOLUTION:

Article 1

1. Judges at all levels of the People's Courts shall be provided with uniforms for use according to their tenure, including:

a) Judicial robes;

b) Ceremonial attire: for men, a suit; for women, a traditional ao dai;

c) Daily work attire includes:

- Spring and summer attire: trousers and a white shirt;

- Autumn and winter attire: a suit, a long-sleeved shirt, and a cold-weather coat.

2. Judges shall be provided with: belt, leather shoes, socks, tie, file case, and Judge badge.

Article 2

1. Lay judges shall be provided with uniforms for use according to their tenure, including:

- Spring and summer attire: trousers and a white shirt;

- Autumn and winter attire: a suit and a long-sleeved shirt.

2. Lay judges shall be provided with: belt, leather shoes, socks, tie, and file case.

Article 3

The style, material, and color of each type of uniform mentioned in Article 1 and Article 2 of this Resolution shall be specified by the President of the Supreme People's Court.

Article 4

1. Tenure for using uniforms of Judges:

a) Ceremonial attire: one set every five years;

b) Judicial robes: as stipulated in Clause 2, Article 13 of this Resolution;

c) Autumn and winter attire: one set every two years, initially two sets. For Judges in provinces and cities from Da Nang southward (excluding Lam Dong province), autumn and winter attire shall be provided one set every four years;

d) Spring and summer attire: one set every year, initially two sets. For Judges in provinces and cities from Da Nang southward (excluding Lam Dong province), spring and summer attire shall be provided two sets every year, initially two sets;

đ) Cold-weather coat: one every five years;

e) Long-sleeved shirt: two shirts every year, initially two shirts;

g) Belt: one every two years;

h) Leather shoes: one pair every two years, initially two pairs;

i) Socks: two pairs every year;

k) Tie: two ties every five years;

l) File case: one every three years.

2. Tenure for using uniforms of lay judges:

a) Autumn and winter attire: one set every five years;

b) Spring and summer attire: two sets every five years, initially two sets;

c) Long-sleeved shirt: two shirts every five years, initially two shirts;

d) Belt: two belts every five years;

đ) Leather shoes: two pairs every five years, initially two pairs;

e) Socks: two pairs every year;

g) Tie: two ties every five years;

h) File case: one every five years.

Article 5

1. The Judge badge shall be made of metal in a rectangular shape with blue color (dimensions 2cm x 6cm) and worn on the left chest of the Judge. On the surface of the badge, the left side has the symbol of the Court; in the middle is the name of the Judge; the right side has patterns to distinguish different ranks of Judges, specifically as follows:

a) For Junior Judges: the pattern on the right side has one red horizontal line, according to Model No. 1.

b) For Intermediate Judges: the pattern on the right side has two red horizontal lines (the second line is above the first and shorter, centered relative to the first line), according to Model No. 2.

c) For Senior Judges: the pattern on the right side has three red horizontal lines (the third line is centered and shorter than the second line), according to Model No. 3.

d) For Supreme Court Judges: the pattern on the right side has four red horizontal lines (the fourth line is centered and shorter than the third line), according to Model No. 4. The badge of the President of the Supreme People's Court has a five-pointed gold star designed above the center of the fourth red line, according to Model No. 5.

2. The Judge badge shall be issued once for each rank.

Article 6

Uniforms for Judges and lay judges working in military courts shall comply with regulations on uniforms for the Vietnam People's Army.

, Clause 1, Clause 2 Article 7a of this Regulation.

Judge identification card; lay judge identification card; military lay judge identification card shall be issued by the President of the Supreme People's Court.

Article 8

The Judge identification card measures 95mm in length and 62mm in width, consisting of two pages presented as follows: Front page: red background, at the top is the golden text "SOCIALIST REPUBLIC OF VIET NAM", in the middle is the national emblem of the Socialist Republic of Viet Nam, and below the emblem is the golden text "JUDGE IDENTITY CARD", according to Model No. 6.

Back page: white background, with embossed pink patterns, a diagonal red line 8mm wide running from the lower left corner to the upper right corner, with a five-pointed gold star in the center, according to Model No. 7.

Article 9

1. The lay judge identification card measures 95mm in length and 62mm in width, consisting of two pages presented as follows: Front page: red background, at the top is the golden text "SOCIALIST REPUBLIC OF VIET NAM", in the middle is the national emblem of the Socialist Republic of Viet Nam, and below the emblem is the golden text "LAY JUDGE IDENTITY CARD", according to Model No. 8.

2. The military lay judge identification card shall have the same model as the lay judge identification card, except that the text "LAY JUDGE IDENTITY CARD" is replaced with "MILITARY LAY JUDGE IDENTITY CARD".

Article 10

1. Judicial robes of Judges shall be used during court sessions or meetings when Judges participate in trials or resolve cases as prescribed by law.

2. Ceremonial attire shall be used on holidays or important events.

3. Daily work attire shall be used by Judges during working hours.

4. During working hours and while performing duties, Judges and lay judges must wear the uniforms provided according to regulations; Judges must carry their Judge identification cards, and lay judges must carry their lay judge identification cards.

Article 11

1. Judges and lay judges shall not use Judge identification cards or lay judge identification cards for personal gain or private purposes; they shall not use these cards instead of introduction letters, citizen identity cards, or other personal documents; if they lose their Judge identification cards or lay judge identification cards, they must immediately report to the nearest police station and the President of the People's Court where they work.

2. Issuance, replacement, and revocation of Judge identification cards and lay judge identification cards shall be regulated by the President of the Supreme People's Court.

Article 12

Where judges or lay assessors violate the regulations on the use of uniforms, Judge Identification Cards, or Lay Assessor Identification Cards, they shall be subject to legal sanctions according to the nature and degree of the violation.

Article 13

This Resolution takes effect from July 1, 2016.

1. With respect to the trial attire prescribed in point a, Clause 1, Article 1 of this Resolution, the President of the Supreme People's Court shall organize a pilot implementation of black long-sleeved robes for each rank of judge at certain courts, evaluate the results, and report before July 1, 2017 for the Standing Committee of the National Assembly to consider and decide. During the pilot period, judges will be provided with two black long-sleeved robes once. At courts not participating in the pilot, judges will continue to use current trial attire until there are new regulations from the Standing Committee of the National Assembly regarding trial attire.

This Resolution replaces the provisions on judicial attire for judges and people's assessors; Judge Identification Cards and Lay Assessor Identification Cards stipulated in Resolution No. 221/2003/NQ-UBTVQH11 dated January 9, 2003 of the Standing Committee of the National Assembly.

The Government and the Supreme People's Court shall be responsible for implementing this Resolution within their respective duties and authorities.
