DECISION OF THE PRIME MINISTER

On certain benefits for military personnel, defense workers, and civil servants directly performing bomb, mine, and explosive ordnance clearance tasks

directly performing the task of detecting and disposing of bombs, mines, and explosive devices

PRIME MINISTER

Based on the Law on the Organization of the Government dated December 25, 2001;

Pursuant to Decision No. 96/2006/QĐ-TTg dated May 4, 2006 of the Prime Minister on management and implementation of bomb, mine, and explosive ordnance clearance work;

Considering the proposal of the Minister of Labor, Invalids, and Social Affairs,

DECISION:

Article 1. Military personnel, defense workers, and civil servants assigned to specialized engineering units directly performing bomb, mine, and explosive ordnance clearance tasks shall enjoy the following benefits:

1. Receiving full salary according to rank, grade, rank, and pay allowance (if applicable); enjoying other benefits and policies as prescribed by law.

2. Receiving subsistence allowance at a rate of VND 60,000 per person per day, calculated based on actual days working in bomb, mine, and explosive ordnance clearance areas.

Article 2. The funding for implementing the benefits stipulated in Article 1 of this Decision is as follows:

1. For projects using state funds, the funding for the benefit prescribed in Clause 1, Article 1 of this Decision shall be allocated from the annual budget of the Ministry of National Defense, while the funding for the benefit prescribed in Clause 2, Article 1 of this Decision shall be included in the unit price (per 1 hectare area) for bomb, mine, and explosive ordnance clearance as stipulated in Clause 2, Article 3 of Decision No. 96/2006/QĐ-TTg dated May 4, 2006 of the Prime Minister on management and implementation of bomb, mine, and explosive ordnance clearance work. managing and implementing the work of detecting and disposing of bombs, mines, and explosive devices.

2. For projects using other sources of capital, the benefits prescribed in Clauses 1 and 2, Article 1 of this Decision shall be included in the unit price for bomb, mine, and explosive ordnance clearance as stipulated in Clause 3, Article 3 of Decision No. 96/2006/QĐ-TTg dated May 4, 2006 of the The Prime Minister.

Article 3. When military personnel, defense workers, and civil servants are assigned by competent authorities to directly perform bomb, mine, and explosive ordnance clearance tasks and suffer injury, illness, or death under any of the circumstances specified in Articles 3, 11, and 17 of Decree No. 54/2006/NĐ-CP dated May 26, 2006 of the Government guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Persons Contributing to the Revolution, they shall be considered and recognized as war invalids, disabled veterans, or martyrs.

Article 4. This Decision takes effect 15 days after its publication in the Official Gazette.

Article 5. The Ministry of Labor, Invalids and Social Affairs shall take the lead and coordinate with the Ministry of National Defense and the Ministry of Finance to guide the implementation of this Decision.

Article 6. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees, and Chairpersons of municipal People's Committees directly under the central government shall be responsible for implementing this Decision.
